Kidz 'n' Kicks is a vendor soccer program operated by entrepreneur ******* ********. He signed a contract with my school, ******* ************ ********** *********, to teach reliably and on time and to communicate effectively with myself and his clients (see attached). Of the first six lessons, he cancelled two at the last minute (the first for an illness, the second for car repair) and was late for two without advance notice. After the first absence, I told him that he needed to let me know as early as he could of any absence so we could be sure to give parents ample time to make plans. When he was absent the second time, it was within an hour of the class itself and was non-emergency. After the first tardy, I was clear that he'd left me with his students as the only adult (a violation of school policy, as well as that of our parent church) and compromised safety of children -- and that this was unacceptable. When he was tardy the second time, I told him I'd begin calling and texting him two hours before he was due to arrive. The first day I began trying to help, he would not answer phone call, text, or email two hours out. An hour later, when he finally communicated, it was by text to tell me he was at an auto repair shop. I surveyed the 15 soccer parents to see how they felt about two the first six (four taught of eight total) lessons being cancelled, and a fairly even number of responses were upset, nonchalante, or deferred to my judgement. On October 8, I let Stanley know, as he'd violated both the dependability and communication our contract was designed to secure form our vendors, we would find another soccer program. As he'd collected parent money in advance, I directed him to refund the parents half, as he'd only delivered on half the classes. I told him that, in good will and faith, I would waive the profit-share requirement of the contract. Over two months later, he has not refunded any money and is not communicating with me at all
