      I paid a security deposit for ***** **** apartments February 2022. I know several people that have moved in I have not been offered my apartment or my security deposit back. I would like my security deposit back as this company is impossible to reach. They never answer the phone and my lease would be up by now. Communication has been horrible well actually nonexistent. I should not be left without an apartment and not have my money returned $750 that is.

      This was over a year ago. The customer cancelled and therefore the deposit is non refundable. However, The customer filed fraud with her financial institution and the money was replaced back into her account. We did not fight this even though we could in an effort to end this and have no further dealings with the customer, as she came in later and wanted to know where her apartment was. This was some time after she cancelled.

      I am rejecting this response because:

      This company did fight the dispute and here’s proof of my bank returning the funds to merchant. This company is breaking Georgia codes 44-7-31, 44-7-34 & 44-7-35. This apartment complex has done this to several people. The lease this company made is also in major violation of the Georgia tenant landlord handbook. My lease has come and gone and no documentation on my security deposit mailed to me.

      My son (************) and i signed a lease with ********************* on ******* and paid them a $750.00 deposit. The lease stated that the move in date was ********. Before the move in date we started getting emails that the apartments would not be ready until *********. We were fine with that.. Now it seems every other month we are getting a email pushing the date even further back, As of ******** the apartments are still not completed and the last email sent to us on ******** stated that the apartments will not be ready to move into until the end of ********* and that was only if they got in the elevators. I believe we have been more than patient with these people. I have requested several times for the deposit to be returned so my son could find him somewhere to live. i have been told that we would break the contract and the deposit could not be refunded. We have not broke the contract. They are the ones that have not lived up to their contract. We are simply wanting the $750.00 deposit back so he can move on from this. Please let me know how i need to move forward. It is not fair that they have this money and we still have no apartment.

      Business Response /* (1000, 11, 2022/11/08) */ Mrs. ******* released a unit while the apartment complex was under construction. We told her then that there were supply chain issues and we were going to have the complex ready of remove in and soon as possible, but that if she leased a unit, the security deposit was non refundable. After almost 10 months of construction we realized we were going to be delayed because of an unavailability of elevators, along with a few other things. We send out an email allowing people to cancel and get refunds. She did not take advantage of that window. We have real costs associated with leasing the units. Have of the deposit we pay in fees and expenses. She waits until we are 95% through with the project to tell us she wants out of her agreement. Because she has waited this long, it affects our ability to re lease the unit in time. We have offered to let her out of her lease which we did not have to do. I have offered to give her half of her deposit back which we did not have to do. The other half of her deposit will not cover the expenses of leasing the unit to her. I will lose money as it is, but she feels if she complains long enough I will just lose more. My son and I have went back thru every email we have received concerning this apartment and neither one of us has received a email offering us the full deposit back. When the lease was signed there was no mention of the move in date being pushed back now is it stated anywhere in the lease agreement that the actual move in date may change. i have been asking since ************* for a refund on the deposit and have gotten no where with these people. On Monday ************* i turned this matter over the the ****************** and i have filed suit. i have discussed this with a attorney and the lease has been reviewed. The lease states we could move in on ********. We are now almost a year past that date and the apartments are still not ready for move in. Mr. **** did send me a email stating that he had to pay a secretary and maintain a website and that was one reason he could not refund our whole deposit. As a business owner myself i know the cost of doing business and a secretary and website is a business expense he would incur either way. The simple fact od the matter is my son needs his money back especially since they have not held up their end of the lease.
