      This BBB complaint concerns $5433.56 paid to Stylish Stems on August 2021 and October 5th 2023 for the floral arrangements in the **** / ******** wedding. On August 2nd 2021, a contract for bridal bouquet, boutonniere, floral arrangements, centerpieces and floral arch was executed with Stylish Stems LLC, and signed by ***************************** as lead designer. That contract has been breached and a full refund is requested. Section 10 of the August 2021 contract states Stylish Stems shall not be liable to Client for any claim, including for non-performance or incomplete performance of the Services, whether in contract, warranty, tort, or other legal theory, for an amount in excess of the price actually paid by Client to Stylish Stems. The amount paid by the Busorgins was $5433.56 . Due to the limited liability clause of this contract, that is the amount demanded now (the price actually paid) due to contractual breach. Stylish Stems ignored phone calls and emails regarding this.This contract *************** section 5: Stylish Stems prepares floral to be fresh and in good form specifically for The Clients event. This clause was breached as the clients notified Stylish Stems LLCs delivery woman immediately upon delivery of the boutonniere that it was not the shape specified and thus not in good form.On October 27th 2023, the agreed upon hundreds of flowers for the floral arch were missing. Workers at the venue in *******, ******* also had to redo some of the provided product, costing time and resources. This was a further breach of the contract section 5. The event profile specifically states greenery draped on the back of bride and ****** chairs. Instead, Stylish Stems LLC draped a ribbon over the chairs which is not the same as greenery, nor is it a suitable substation of flowers. As Stylish Stems LLC (Blosm Designs its AKA is not registered to do business in the ****************), multiple poor reviews of its service are available on Yelp and elsewhere.

      Thank you for reaching out, and I appreciate the opportunity to address your concerns.  It deeply saddens me to hear the ways in which you feel like the contract was breached. As I delve into each point you've raised, please know that I do so with the utmost empathy and consideration of your perspective, and that my goal is for us to be able to reach a mutual understanding.  Your points to which you feel like the contract was breached are in black, and my responses will be in red:

      This contract specified the following in its section 5: Stylish Stems prepares floral to be fresh and in good form specifically for The Clients event. This clause was breached as the clients notified Stylish Stems LLCs delivery woman immediately upon delivery of the boutonniere that it was not the shape specified and thus not in good form (see Stylish Stems design page for October 27th 2023 event, attached).

      Attached is a side-by-side comparison of the boutonniere picture taken from the inspiration details, and pictures (one of which you provided) of the delivered boutonniere. Both are phalaenopsis orchids. While no one flower is ever a perfect replica of another, the photographs below show the delivered boutonniere to be in good form, and matching the inspiration details. I am so sorry you were not happy with the boutonniere. Based on what mother nature could provide us, we believe we delivered the best match to your inspiration picture.  This is in accordance with clause 6 of our contract, stating, Client acknowledges and agrees that flowers *** not arrive exactly as set forth in the event profile due to circumstances beyond Stylish Stems control. (Attached below the pictures for your reference).  

      On October 27th 2023 the agreed upon hundreds of flowers for the floral arch were missing.

      Im not sure where the confusion happened, but this statement is simply untrue- according to the quote (attached below), you were to receive 100 blooms (not hundreds as you stated). And there were quite literally hundreds of blooms in your arch as shown below.

      There are, in all photos of the arch, over 200 individual blooms. There are easily counted 86 stems on the left side and 82 stems on the right side of the arch, which would conservatively total 168 stems providing over 200 blooms (as some are multi-bloom stems) You received more than double the number of blooms for which you were quoted. In addition, the arch is larger and more bloom heavy than the inspiration picture on the design details.  Again, please see a side-by-side comparison picture below.  My team and I are so proud of this arch.  It is beautiful, designed to the details, matching your color palette, and you look absolutely stunning in front of it.

      Workers at the venue in *******, ******* also had to redo some of your provided product, costing time and resources for the couple. This was a further breach of the contract section 5.

      Again, after speaking with my team and the other vendors onsite, this statement is simply not true. There was a team of three of our designers onsite for the entirety of the event designing, moving, and tweaking arrangements, which was witnessed by all other vendors onsite. We do not permit other vendors to redo our products or floral, that would be a huge liability on their part.  My team even jumped in to help move furniture in assistance of another vendor, all with the common goal of delivering ***************** to you.


      The contract provides that the bridal bouquet shall include quicksand roses, blush bride protea, white peonies OPENED, peach mother of pear roses, light pink small allium, cream majolica spray roses, caf au lait dahlias. The white peonies were not OPENED despite this specific instruction in the Stylish Stems design sheet (see attached). This is an instruction that cannot be substituted per the contracts section 6. The contract executed provided the following: Client *** expect slight variations in color or arrangement from any images that *** be included in the Event Profile. In the event that the flower type, color, size, or quantity differs from those originally ordered, Stylish Stems shall make the appropriate substitutions to match the Event Profile as closely as possible.

      Flower condition (blooming) is not covered by this clause. The poor flower condition, unremedied, has led to this demand letter.    

      Again, this statement is untrue.  The flowers were in fact very open, in good condition, and blooming Please defer to your professional photos, as well as the below attached (more than 15 videos and additional pictures that I personally took) that display your bouquet as it went out for delivery.  In addition, my team routinely takes dozens of their own pictures and videos, while onsite which, again, show the same healthy, ***********, and beautiful flowers.

      The event profile specifically states greenery draped on the back of bride and ****** chairs. Instead, Stylish Stems LLC draped a ribbon over the chairs which is not the same as greenery, nor is it a suitable substation of flowers. This was yet another contractual breach.  

      I appreciate the picture you included with this statement, as I was confused by what part of the greenery was missing from the chairs. In your included picture from your event, it shows the greenery on the back of the chairs. I have included another picture with a side-by-side taken from the event details. Once again, we added even more flowers and greenery to this design than the inspiration picture and what was quoted.

      There are a few final areas I would like to address. In regards to the allegations of a breached contract as a whole, I would like to note that in 2021 you originally breached the contract with us when you cancelled your original date. This cancellation was less than 6 months out from the event date.  The planner reached out to reschedule another date in 2021 which I agreed to do based on sincere care for you and your health situation.  The first rescheduled date was cancelled, and then, in 2023, at your request, we decided to honor the deposit you made, nearly 2 years prior in 2021, even though we were under no obligation to do so.  By cancelling the original date in 2021, the contract was nullified altogether (see attached below).

      Not only did we honor a deposit, which we were not contractually obligated to, our onsite designers graciously stayed with you through changes, moved arrangements so that you could have them pictured in multiple spaces, and worked overtime to add more floral and perfect your designs, as well as assisted other vendors. This was all in an effort to over deliver on what was quoted.  The delivered designs are completely in-line and even larger and more lush than your written quote and inspiration photos.
      Again, we truly wanted you to have the most beautiful event possible, in accordance with your design details.  We had hoped you would have loved everything, and Im heartbroken to hear you did not. I do however, stand behind the truths that myself and my team delivered *****************, in accordance to your design details, honoring a deposit we had no contractual obligation to allocate towards services, to fulfill a contract that was breached by the cancellation of your original date, and in doing all of this, we went above and beyond in sincere efforts to please you.
