      I am rejecting this response because: I would like to add that the behavior of the owner of this company has been nothing short of shocking. I have grave concerns about the owner of this company, as I feel I can no longer trust him due to the constant changing climate regarding the financial aspects of this project. I no longer feel safe working alongside him. I am genuinely terrified of the person I have come to know in the past few weeks. ********************************* failed to give me the working prototype and regretfully could not submit my documents to immigration for my pitch deck for the app to acquire my business ***** As I did not have any footage to make promo, or proof until last month or so, and only after I had complained on this did he get serious about my project after 4 years. My ability to stay legal in ******** is dependent on my ***** which I had to get an education **** instead due to his negligence I was unable to obtain proper documentation for immigration. I had intended to legally open my business here in ********, he was very aware to which, his response was none. The psychological warfare using his child as leverage against me has been nothing short of heinous, and at this point his actions and views do not reflect the company I own in any way. He would send me pictures of his son and constantly bring up his personal issues to me as excuses for his failures to properly deliver or compensate the agreed amount or deadlines. For 4 years I gave nothing but kindness, leniency, and understanding. I have received hatred, disdain, and the true colors of a man I once called a friend are now in full view for me to see. How could anyone want to take money away from someone because they see an improvement in their life is beyond me. This behavior has shown me something truly unbecoming, and something truly sinister here. He has shown his interests do not remotely lie or align with the values of this company, and he does not support the artistic expression of the owner of PYRE.

      I am filing a complaint and requesting a refund that is past due. Pixels x Code did not provide the work/services when requested, postponed numerous scheduled meetings, refused to communicate via phone for collaboration purposes (stated only text **************** when asked, and was unprofessional. I paid the company $5,000.00 on 12/01/2023 after the contract was executed on 11/30/2023. Due to a noticeable absence of engagement and inability to provide evidence of contract work, a Letter of Termination was issued on 12/16/2023 by both parties after a dispute. A close-out and transfer of files was held on 01/05/2024. A certified check refund for $3,750.00 (75% of the amount paid) was to be issued by Pixels x Code within 30 days (01/15/2024) per the agreement, both verbally and in writing. The time frame has elapsed, and no refund has been given. I sent a follow-up email requesting the refund status and tracking number of the certified check to be sent. However, the company is further delaying the payment that is past due.

      ********************* is filing this complaint in a short-sighted and impatient manner. In reply to ******** request for an update on this refund on Tuesday, January 16th, ****, we notified him via e-mail that we were aiming to mail his check by Friday. That notification and e-mail received no response from ******. Subsequently, our accountant then scheduled a meeting with the bank at their earliest time, on Monday. We received this complaint and our accountant reached out to ****** today (Saturday, January 20th, ****) in order to resolve. We would prefer that ****** withdraw this complaint and notify the BBB of such.

      Please see the following attachments for proof of service of e-mail stating when we were aiming to mail the check and for proof of service of e-mail working to resolve this matter between our accountant and *************

      I am rejecting this response because: I am rejecting this response because, per the contract agreement (page 8 of 10, item #** "Termination and Refund"), termination was directed from both parties. Following this termination, a letter was issued by Pixels x Code on December 16th, 2023, that "the refund will be processed within 30 days on our net-30 payment cycle for billing from the date of this letter." As we discussed in our recorded Zoom call, payment was to be received within 30 days, along with a tracking number. Pixels x Code provided no email, notice, or form of communication after the 30 days had elapsed. I followed up via email on 1/16/24 (31 days after) only to be told, "We are finishing up working on this. We are aiming to get this mailed out this coming Friday, 1/19/24, at the moment". Again, I have yet to receive any notice or tracking number ensuring my payment was on its way or that they intend to pay me.

      ********************* is filing this rejection to our complaint in a completely dishonest manner. Not only did we offer to send a wire transfer in order to expedite his refund, but we were persistent in our communication. Despite this, ****** rejected our response here and claimed that we had no intent to pay him. Yesterday, we mailed his certified check at the time we promised following Friday - on Monday - as discussed to him. We made every effort to get him his refund. Because of ******** dishonest complaints to you, the Better Business Bureau, we sent a cease and desist letter to him alongside the check. We understand that ****** needs this refund, but we will not put up with being bullied, especially when we have gone above and beyond to both deliver the work that was completed and issue a refund as desired (AND offer faster ways to get it).

      Please see the following attachments:

      - Proof of Service of e-mail providing a photo copy of the certified check, tracking number, and cease and desist notice.

      - The current status of the *** tracking number and shipment for the certified check and aforementioned notice.

      - A scanned copy of the certified check.

      - The cease and desist notice itself.

      - Screenshot proof we followed up and offered to wire transfer the amount ahead of time.

      We hope and wish for this message to be the last of them from and to ******. If it is not, we will proceed with litigation to defend ourselves. We will not tolerate false, defamatory, or disparaging claims and allow our business to be damaged by such. Please close this complaint.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ******** and found that Pixels X Code is providing false accusations. Attached is correspondence received shortly after the complaint was filed. I am NOT the one lying, disparaging, dishonest, or being fraudulent. I'm only stating the facts (with evidence) of what has transpired and that I wanted to get my refund within 30 days after the breach of contract. The emails and text messages received from Pixels X Code after the complaint were unnecessary and unprofessional.

      I received my refund and satisfied with the outcome. Thank you for your help on this matter.
