      RENTED THIS (7/16/23-7/23/23) V**ATION **** FOR 8 PEOPLE 4 ADULTS, 4 CHILDREN ON 11/29/22. GOT A PHONE CALL IN LATE JUNE 2023 INFORMING ME THAT OUR BALCONY AND THE **** WERE UNDER REPAIR. IF WE STILL WANTED THE **** THEY WOULD REDUCE COST BY 50%. I ASKED IF THEY HAD OR KNEW OF ANY OTHER **COMMODATIONS IN THE **** FOR 8 PEOPLE. I WAS TOLD NO. WE AGREED TO STAY AND THEY DID REDUCE COST. UPON ARRIVAL WE NOTICED THE ENTIRE BUILDING WAS UNDER MAJOR STRUCTURAL REPAIR. THERE WAS NO ADDITIONAL PARKING AVAILABLE, SEE PHOTO. I CALLED ******************* (OWNER) HE ADVISED WE SHOULD DOUBLE PARK 2ND VEHICLE IT WAS "APPROVED BY THE COUNTY". DURING THE COURSE OF THE **** A NOTE WAS PUT ON WINDSHIELD AT LEAST TWICE STATING "DO NOT PARK HERE". UPON ENTERING **** TEMPERATURE WAS 83 DEGREES, AFTER SEVERAL ATTEMPTS TO GET **** ********* CALLED ******************* ASKING FOR SOMEONE TO COMEOUT AND LOOK AT IT. HE TOLD ME NO ONE WOULD COME OUT ON A SUNDAY, BUT HE ALREADY HAD SOMEONE COMING OUT 1ST THING MONDAY TO LOOK AT IT. (INDICATING HE KNEW THERE WAS A PROBLEM). WHEN I ASKED HIM WHAT WE SHOULD DO HE SAID "TOUGH IT OUT" AND HE WOULD PAY FOR BOX FANS. MY WIFE AND I SPENT THE ***** IN A HOTEL DUE TO HER HEART CONDITION. THE OTHER FAMILY STAYED. ON MONDAY MORNING THE ** GUY SHOWED UP TO FIX ****, AFTER REPL**ING A PART AND HOSING DOWN OUTDOOR **** HE GOT IT COOLING SOME WHAT. HE INFORMED US THAT HIS BOSS HAD TOLD ******************* THEY WERE GOING TO STOP COMING TO REPAIR THESE ****S BECAUSE AFTER REMOVING EXTERNAL ****S FROM THE SUPPORT BALCONIES TO A CORNER WITH NO VENTILATION (4 ****S P**KED TOGETHER). SO BASED ON THAT THEY ALL KNEW THERE WAS A PROBLEM WITH ** ****S BECAUSE OF MOVING THEM FROM THEIR ORIGINAL LOCATION. TEMPERATURE NEVER GOT BELOW 77 DEGREES THE ENTIRE ****. WE COULD NOT OPEN OUR WINDOWS BECAUSE THE SCREENS WERE SHREDDED. ******************* ASKED US TO LEAVE TWICE DURING THE **** STATING HE WOULD REFUND OUR MONEY. WE HAD NOWHERE ELSE TO GO.THIS **** SHOULD NOT BE RENTED DURING THE CONSTRUCTION.

      When the guest booked our condo they were told of the construction and the balcony and pool being closed and that they could cancel and recieve a down payment refund $300 which they paid to reserve the unit or they could continue with the reservation at a 50% discount on the Rent for the week. they took a few days to respond and accepted the discount. a few day before their arrival our daughter had been in the condo and she said the air was not cooling like it should and that it would only reach 75 degrees. i then scheduled Air Conditioning Eginerrs to come look at the unit they were scheduled the day after these complaining guest arrived. on the day they arrived the air was not cooling at all and the air Company will not come out on sunday. i explained this to the guest and they asked what would you do? i told them i would tough it out but if they didn't want to i would refund their money 100%. they took a couple hours and decided to stay. Note the condo has 9 windows and only 2 window had bad screens all the other windows are new with new screens.  the ** guys showed up on monday and corrected a bad Capacitor and the unit was cooling, i never heard from the guest that the unit didn't cool below 77 for their entire stay. we thought all was good. little did we know!!  the guest could have departed at anytime with a refund and there were condos avaliable in the area just non could be booked and the discounted price that these guest had gotten from us to start with. so there was a place for them to go just not so CHEAP.

      I am rejecting this response because:

      In response to NO ONE coming out on a Sunday, the serviceman said they were always on 24hr/7 call with *************** until air units were moved for construction.

      Bad capacitor was not the only issue, there was a component inside the unit that had to be replaced and then the serviceman had to hose off the coils on the outside unit because it was not protected from the construction debris.

      *************** was aware of this because I sent him a text and he acknowledged that they were having to do additional work on the unit in order to get it to cool.

      When we got phone call about construction we asked about other units available. He and his wife both said they knew of none. When talking to him on Sunday after discovering the ** issues he never mentioned that he knew other units available. ***** was never mentioned or brought up and it was never an issue.

      No we did not contact him further, ** guy had done the best he could with the circumstances. Each time we spoke to *************** his response was for us to leave and he would refund our money. My main concern was creating an issue where by he would try to remove us from the unit. Since he mentioned the word CHEAP I will agree he is CHEAP otherwise he would have told us of other units or places that could accommodate us. He chose not to do so until this complaint. This building should not be renting to anyone until all major construction is completed and all ** units are back where they should be in order to work properly.

      My next contact will be to code enforcement. and the building inspector in *********************.

      We are sorry to hear that the ***** Family thinks we are not telling the truth. 

      1. ************************** of ***************** will NOT respond to Rental units on Sundays. please Feel free to call ************************* of ************************** ************ she will verify this information. 

      2. we had heard from our daughter the unit was not cooling down all the way (only to the mid 70's) so we scheduled the company to come out on Monday after the ***** family arrived on Sunday. they would NOT respond on Sunday. per the company owner. when the ***** family arrived it was not cooling at all. on Monday I received a text from ****** with Air Conditioning Engineers saying "bad capacitor, your cooling now". 

      3. yes they sprayed water on the outdoor condensor to clean it. this is my understanding. i'm not an ** guy. so not 100% sure what...

      4. we know there are other units he could have rented, not from us, but other rental companies. he could have googled, but we had no other units to rents in our inventory. 

      5. i wish they had contacted us further. we could have responded. but we cant read their minds. the ** company says to me, your cooling, and the guest dosent call. we assume all is good. to take is a step further, the next guest arrived after the ***** family and it was not cooling below the mid 70's. so we purchased a portable ****** btu Air Conditioning unit that we put in the unit the day after the guest called. this portable unit assist the existing ** unit and keeps the unit cool. but again we cant fix the problem if we dont know about it. 

      6. *********************** Building inspectors are regularly at our building insuring safety etc... this is normal part of a building permit process or renovations.
