      On 12/7/2023 I engaged in communication with representatives of Boss Lady Renovations named **** and *****************************. I was finishing up the construction of a building and needed the driveway and land around building covered as it was just dirt. **** and ***************************** told me they had many years of experience in everything that had to do with concrete, rocks, and landscaping and that if they ever receive any complaints they come back and fix it. What was communicated with ********************* was that he would go around the entire pad with 8' timber post outliners, grade the West side of the property, put down hay on the slope, add a ramp at both entrance doors, do a 50x34' concrete pad in front of building and a 24x16' concrete pad at top of driveway and the rest was going to be four loads of crusher run. Total price $16,050. On the last day he said he basically miscalculated and needed another load of crusher run, but I didn't want to pay for more. He then stated that he would not do some of the things that he had said he would include because he never put it in writing. I saw that four loads were delivered so I made final payment. I have since found out, that what he had delivered was not crusher run, but a cheap inferior concrete wash out substance that is creating a mess in my parking area and needs much more to cover. In order to settle, I'm accepting a refund of $3,800 which is the price of four loads of crusher run that I need and that I paid for and I handle the labor myself. If that offer is not accepted I reserve the right to file a suit for more things not included in this complaint such as other material and labor.

       On 12/07/24 we were referred to *************************** through another contractor. We were advised that she had issues with another contractor that had taken her to court and she felt he had taken money form her. We later found that it was no fault of the contractor. Per the conversations with *************************** and the contract that she asked to have updated. She wanted the following done:
      3 Tandem loads of crusher run graded out, 40 x 50 concrete slab 4 inches thick 3000 psi, front entrance 6 ft. long and 24 ft. wide will be 6 in. in depth from ( 6ft. x 25 ft only) all other is 4 in. in depth, 320 Lineal foot 4/4/8 Timber out liners and 1 handicap sign installed. 

      She then later changed the following because of lack of funding: 
      At the top of the driveway are as follows 25 x 16 only 6ft x 25 is 6 in in depth the rest of driveway is 4 inches in depth, the bottom of the driveway changes to 50 x 36. Then she added  additional load of crusher run.
      As per her complaint about going around the back of the building, ***** increased the size of the parking area, so therefore there was not a miscalculation on the crusher run. What was needed was a 5th load after the change. Then when ***** was told that she needed another load she stated she had no more funds. We then told her that when she rebuilds her funds we would return and do the back area.
      So the  above was completed to *****'s satisfaction and on 12/18/23 she made final payment based on completion of the project. There were no complaints while *************************** was writing the final payment. There will be no refunds on this job that has been completed and paid in full per customer satisfaction!!

      I am rejecting this response because:

      The respondent is failing to address the actual issue.


      I did not receive four loads of crusher-run.


      Im attaching an email sent to Boss Lady Renovations on December 28th where I describe my complaint about not having received the correct product of the four loads of crusher-run I paid for per contract. They didnt respond to that email and they also didnt agree to come to mediation to discuss the issue. This is my third effort to work this out with them.


      Im also attaching a statement from a Georgia home and commercial builder stating that the product graded out at my office location was not four loads of crusher-run. What was delivered and graded out were four loads of a wash-out substance in addition to broken up disposed countertops (with mesh still attached) that you can pick up both for free at various close-by locations.

      Since I was charged $1,150 for the one added extra load in the contract, I paid $4,600 total for the four loads I didnt receive.  I am willing to accept a refund of $3,800 if we can settle through BBB which will also settle other issues mentioned in the original complaint.

      ***************************, is not due a refund. Due to the job described in the contract was done! *************************** signed off on all of the changes that she requested. Then she paid the contract in full after doing a walk of the property. I also have all changes and correspondent's with ***************************. We as a business can't control that *************************** ran out of funds for the project. We told her that when she replenished we would come back and do the other things she needed for the projects.

      I am rejecting this response because:

      Again the business is failing to respond to the fact that I paid for four loads of Crusher Run, and business delivered only what is considered trash: Concrete Wash Out and Broken Countertop Tiles, no Crusher Run was delivered. Client has refused to work this out or even attempt to discuss it.
