First contact with company was on Thursday, October 28th, 2021. Louis ******* came over and discussed the job, we did a walkthrough, I pointed out what needed to be done. He set his fee for the work and we agreed that I will provide the materials. 10/29/21 I received written agreement 20% labor paid after the start; 40% after the kitchen cabinets completed; and 40% at completion of the job ( see attached). He estimated the timeframe for finishing to be 2 weeks. On Monday, November 1st work started at my residence; as agreed he received the first and second payment. 11/15/21 we had a disagreement about the backsplash not properly done and ask that he fix the issue before continuing with grouting. Mr. ******* walked off the job without telling me, had his workers remove all equipment and left my garage door opened. I called him and he simply states "if you don't like my work, then find someone else to finish." This is unprofessional. He left the following incomplete, the floors (dining room, hallway) baseboards unfinished; kitchen fixtures ( I have no sink), gas stove unhooked, stairs unfinished, upstairs bathroom skylight and paint undone. I want this company to honor their agreement or pay to have it completed.

      Business response

      11/23/2021

Kudos Construction is very serious when it comes to clientele confidence. Our number one priority here is customer satisfaction. Nevertheless, the personnel here at Kudos is as important. Through a recommendation from her sister, our company arrived at Mrs. Florence's home in which we took part in a grand remodeling throughout her home (interior painting, sanding down & painting floors, and finishing the basement). A contract was signed by Mrs. Florence which stated what the job would consist of. However, from the start, Mrs. Florence was not in agreement. We received many complaints from our personnel working on this project, stating that Mrs. Florence would speak to them in a disdain and scorn manner, disrespecting the work being done. There was an agreement on the exact work that was to be completed which was not respected. Mrs. Florence would constantly ask for extra work to be done that was never in our agreement, in fact we had to pay for some material out of our own pocket at one point to try and satisfy our client. Unfortunately Mrs. Florence saw this as an advantage and did in fact take advantage of Kudos Construction. Extra work was done that was not in our contract and even so, Mrs. Florence wanted more from us and continued to harass our staff working in her home. She threatened to post a bad review, which she did knowing it's very important for Kudos Construction to maintain itself a company of excellence. Unfortunately, this is how we came to a conclusion to discontinue working on Mrs. Florence's home project.

(The consumer indicated he/she DID NOT accept the response from the business.)
      My response to Mr. Montoya:
      1. In reference to work "interior painting, sanding down & painting floors, and finishing the basement"
      - There were no floors to be painted and I don't have a basement.
      2. In reference to "..from the start Mrs. Florence was not in agreement."
      - I agreed with the work we discussed because on Friday morning October 29th, 2021, I met Mr. Montoya at Home Depot near my home to purchase materials to begin work on November 1st, 2021.
      3. In reference to "We received many complaints from personnel...stating Mrs. Florence would speak to them in a disdain and scorn manner" Mr. Montoya never mentioned to me in the 10 days' time about complaints from his staff, this is an attempt to evade responsibility to justify his behavior and, in the process, smear my name. The examples below are not the actions of a person who treated his staff with contempt. In fact, I was cordial and accommodating to his staff.
      - I would offer coffee in the morning.
      - Provided lunch on 2 occasions to his staff to show my appreciation.
      - Provided water and use of my restroom.
      - When one of his employees' truck broke down parked in my driveway, Mr. Montoya asked if he could leave it overnight - I allowed this, turns out the truck was in my driveway for 2 nights because the employee could not get it repaired right away. I never asked to be compensated for the inconvenience.
      - Too, when one of his employees' accidentally cut his hand, I was concerned and offered to clean and bandage the cut.
      4. In reference to "disrespecting the work" Not sure what this means, but my expectation was that the work would be done according to what I envision the final product would be. Mr. Montoya had a problem with me voicing concerns and working with me to conclude the work satisfactorily.
      - For example, when I bring up the issue with the backsplash, the unsymmetrical pattern of the tiles, Mr. Montoya's response is "what do you want me to do about this."
      - Another example, when I asked that if he could address the dining room floor where I noticed a dip, unevenness on one side of the room; Mr. Montoya dismissed my concerns and tells his employee to continue installing. Subsequently, I had 2 other contractors' assessment and they noticed the dip right away.
      5. In reference to "extra work to be done that was not in our agreement." On November 11th, 2021 around 3:15pm, Mr. Montoya and I discussed painting the stairwell and the upstairs bathroom. He quoted a price and I agreed to pay. I asked that he include the labor cost and any additional materials he purchased with receipts to the final invoice.
      6. In reference to "She threatened to post a bad review" The morning of November 15th, 2021 Mr. Montoya disappeared without a word to me, leaving my home unsecured. I texted him with no response and then called his cell. During the call was the first time he said that he no longer wanted to continue the project. His reason was because and I quote "if you don't like my work, then find someone else to finish". My complaint is factual. As a consumer I have every right to file a complaint about the unprofessional behavior Mr. Montoya exhibited. I hope my complaint will assist others to make an informed choice.
