      On July 21, 2022, *** Bennett Roofing company installed my roof. Upon completion of the installation, I noticed additional damages on the ceiling. I sent pictures to the owner *************************** informing him of my concerns regarding the additional damages that werent there prior to the installation. He verbally refused to address my concerns over the phone & texted a racist comment stating someone mustve shot in my ceiling & to never contact him again. Now hes trying to ******* me out of an additional approximately $1000 for late fees and $500 for a advertisement discounted sign that he decided not to put in my yard and breaking a signed contract that clearly shows he discounted me $500 for advertising sign in yard. Additionally, I dont him late fees because he refused to rectify, resolve, or address my concerns. I had to get a roof inspector to inspect my roof on 09/28/22 which was when I could afford one. The inspector ******* reached out to *** informing him he had inspected my roof & that I am ready to pay but not until I receive my warranty and invoice. Mr. ******************** yet refused to return roof inspector calls, text, or email. Later, I get a letter from Dans attorney and now *** is trying to ******* me out of an additional approximately $1000. I only owe $9479.33 of which $3700 is loss of depreciation amount that Allstate will pay roof contractor upon receiving invoice indicating work is complete. Also *** did my roof without a permit because I called the city to inquire. They informed me that he did not purchase a building permit. He later purchased a permit after the work was done. Hes trying to defraud me for additional money. Im soliciting your help with resolving this most important matter.

      In response to ***************, she was referred to us by another customer. We worked with Ms. ******* adjuster several times to get her roof passed. We finally got her roof passed and everything approved only approved only for her to tell us she didn't have the money to pay her $2,000 deductible, being that she was referred by someone we had previously worked with we agreed to finance her deducible for 10 months for $200 a month  starting July 10th as stated on signed contract, also stated on contract if payment was not made on the 10th of each month a $25.00 late fee would be added. We have not received a single monthly payment or late fee to date. Also roof has not been paid for, also stated on our signed contract it states that failure to pay within 30 days of completion work carries a $100 late fee penalty and failure to pay with 60 days will begin 10% interest compounded annually until payment has been received, all of this was signed by *****************

      We had the roof scheduled a few days before installment and she contacted us and wanted us to put it off for a few days because the Tax Assessor was coming out and she didn't want the the new roof installed before he came out because it would make her taxes more, this seemed shady and we should've at that point stopped working with her but since she was referred by a loyal customer that we trusted we completed the job.

      As soon as the job was complete she started sending pictures of holes in her ceiling saying it was caused by roof installment, looking at the pictures its obvious the holes were already there because they had dried/cracked caulk in them, also there is an attic between the roof and the ceiling so there is no way anything to do with roofing could cause these issues. In reference to the racist comment we have never met *************** in person so we have no idea of her race. We worked through email and phone conversations since she was a referral from our customer. We have subs that completed the roof.

      We were also informed by our referred customer that **************** had already spent her first insurance check and that is why she was causing issues and apologized for referring her  to us, she had no idea she would do this to us.

      We had no conversation with another roofer, she had one of her friends start calling us and harassing us and leaving reviews on our ****** account and we never done any work for him.

      A permit was not required to do her roof, but since she only brought it up afterwards, we pulled a permit and got it bonded as well, all of this is attached in her file. This is also an additional fee as stated per contract.

      We went out of our way to work with **************** and still have not received payment, this is why it has been turned over to a collection attorney, the late fees she's mentioning are accrued as stated above for her monthly payments and late charges that she signed and agreed to.

      In response to Mr. *** ********************/***************************** allegations, regarding tax assessors office I did say wait and changed the date of my roof installation appointment because my tax assessor appointment had already been made with the assessors office so he took my words and now turning them around to whatever he assumed just grabbing straws .  Also, I told to come on July 21st after my tax assessor appointment due to Covid 19 as well because I didnt want too much traffic at my house.  Mr. ******************** did make a raciest statement and I quote his exact words were it  look like someone shot up in your ceiling, those are gunshot holes.  Therefore, yes I took that as a raciest statement because it depicts that black people and low income people live where gun violence occurs. I was shocked to hear him say that after he saw the pictures which to me he admitted that he saw the holes himself same day after his workers had installed my roof. In conclusion, Mr. ******************** is fully aware and has been for months now that I was ready to move forward in paying him after I got my roof inspected professionally because he refused to do so. However, Mr. ******************** refused to move forward because he want to ******* me and defraud out of more money saying I owe him additional money for late fees and penalties when I do not. This could have been resolved months ago but Mr. *********************  unprofessionalism behavior prolonged everything himself by continuing to reluctantly refusing to give me my warranty and invoice which again he himself prolonged the transaction. Also, I had to get my roof inspected which took time again because of his unwillingness to address my concerns. The individual who referred Mr. *** ******************** apologized to me for referring him and stated to me that they will never refer anyone again to him for roof services.

      As previously stated all attached forms are signed by **************** and all work was completed, and on all paperwork stated all the late fees and penalties for non payment. Payment has not still been received. It also stated on our contract is that homeowner is responsible for all attorney fees, this case is now in the hand of our attorney and they gave her until January 24,2023 to make final payment before taking her to court. Payment has not been received by attorney either. Also **************** just stated the the homeowner that referred us would not recommend us again is untrue. This homeowner has referred us to two additional homeowners which we roofed both since this incident and they are both happy, and apologized to us and told us she didn't know **************** was like this. ****** has not reached out to us or our attorney for final payment and late fees and penalties are accruing. We just spoke to ********************* after receiving this response who is the homeowner that referred us and said *************** was a complete liar, she blocked her on her phone and told her to never come to her house again. ************** also stated she would come to court as a witness.
