On July 8th, 2022 I agreed for ************************* to sell 400 ****s and ****s comic books on consignment. He charged a 75% commission, 3 to 4 times the going rate. Not knowing that it was a bad deal, I agreed to the commission, hoping to get some money from comics I had bought as a child. ******** promised to pay sale proceeds quarterly.Six months later, I had heard nothing from ********, and received no money, and he didn't answer emails or voice mails. **** showed that almost 100 of my comics had sold. Thousands of dollars were due to me, even after the 75% commission.A lawyer advised me to send a Demand Letter. This was mailed on January 28th, 2023, and delivered on February 1st. ******** acknowledged receipt of the Letter in an email sent to me on February 2nd. My demands were 1 Immediate cessation of all sales of comics that I consigned 2 The prompt return of all unsold comics to me 3 A complete accounting of all sales 4 Payment of all money owed to me.Two comics were sold after the Demand Letter was received: on February 5th and 6th.When I saw that these comics were sold after the cease date, I told ******** in an email that "I expect you to either (a) cancel the sale, or (b) give me the entire proceeds from the sale, since the 25% agreement is no longer in effect." After 3 months of emails to get action. I received the proceeds from the legitimate comic sales, minus the 75% commission. However, instead of sending me 100% of the two sales made after the Demand Letter, ******** sent me only 25%, even though I had revoked his right to sell those two comics. ******** claims that offers on the two comics were received before the Demand Letter. But he didn't ship the comics until after the Demand Letter was received, so he could have easily canceled the sales. Im asking for the other 75% of the sales price of those two comics. Action Comics #*** sold for $64.99 Amazing Adult Fantasy #8 sold for $465 for a total of $529.99 minus $132.50 (25%) paid to me = $397.49
