      I paid ******************* a sum of $9,000 to replace my roof. He took my money and the roof got done, but he never paid the subcontractor. The subcontractor has placed a lien on my house requesting his money since he has not been paid by ******************* and is not able to get in contact with *******************. ******************* also misrepresented himself to me stating that he was a licensed general contractor. He is in fact not licensed and uses a family members license. This information was not disclosed to me before he touched structural walls in my home. I have been informed by the framer that ******************* also did not pay him for framing work done at my property. I paid ******************* a sum of $20,000 for all framing to be done at my home. The framing was not finished as the framer would not continue work since he didnt get paid and I had to terminate my contract with ******************* due to negligence and unprofessional business practices. I informed ***** ***************************, the actual license holder, of the situation but he did not rectify it either.

      It's only so much I can say due to the ongoing litigation between the client and I. However, I will say that I'm a up and coming General Contractor out of *******. Working under a general contractor as an apprentice is a requirement before I can sit in for the exam. I've expressed this several times to ************** and her colleague. During construction things happened. This is the purpose of having a general contractor. Someone to ensure that the work done by subs is done safely, up to code, and in a timely manner. The roofer and framer both had issues that needed to be addressed prior to final payment. It's funny how ************** hired us to protect her asset but jump to extreme measures to degrade us for doing our job. In conclusion, work wasn't up to our standards at the time ************** breached the contract. This is the reason payment wasn't made to no one. She chose to go this route in which it's definitely a long process but I guarantee we will see this to the end.

      I am rejecting this response because: ************** continues to lie. I was never made aware nor was my project manager that ************** is not licensed. It wasn't until the permits were approved that we saw the permits were not under his name. I then asked ************** for a copy of his license as my lender requires one, he directed me to the permit site. I explained to him that the permit had another entity's name and asked him if he himself was licensed. He never answered the question, I have proof of this. In speaking with the license holder **********************, his words to me were that he has nothing to do with what ************** is doing and simply lets him use his license. The roof was paid for in full Feb 2022 and was not completed until April 5th 2022 (permits for the project were approved in March 2022). The contract with ************** was not terminated until April 21st due to his breach and constant lies. From April 5th to April 21st, ************** did not tell me anything about the roof or framing not being satisfactory or that there were any issues with the work that was done, nor did he mention that to them, I have proof of that as well. In fact, ************** told me these trades were completed on April 13th and that I could call for my bank inspection so that I could pay him another $43,000, I have proof of this. No mentions of work not being completed or up to code. I visited my work site on April 16th and found that while the roofing, brickwork, and siding were done, the framing for the upstairs had not been completed nor what was done by the stamped plans. ************** was informed that a lien would be placed on the property and did nothing about it despite me paying ************** for the roof in full back in Feb 2022, I have proof of this. ************** intentionally did this hence my complaint. There was no reason for ************** not to pay the roofer or the other subcontractors since I already paid him in full for these trades.
