We rented a machine (Cratcho ** **** gal) with a 3 year contract from Lowe Rental starting on September 5, 2022 (referene number EUS0002883, Serial Number **********. The contract indicates the machine would be New, includes service and maintenance, as well as preventative maintenance visits. From the beginning, the machine that was delivered was "refurbished" and not new. As early as November, 2022 the machine was already causing problems, but Lowe Rental was able to send a technician to fix it. However, the machine was always making loud noises and we requested service many times early as March 3, calling and emailing them to send a technician to service the machine. They either did not respond or delay sending a technician until May, when the machine completely stopped working. Lowe Rental than claimed that we were responsible for the machine being damaged and non-salvagable and we had to cover covering the remainder of the contract and the cost of the machine ($4,680.02 + tax). Our position is that they breached the contract by 1. Not providing a new machine 2. Not having responsive service and maintenance 3. Not delivering on preventative maintenance visits. Had they sent a technician when we requested service, perhaps the machine could have been salvaged. When we blocked their payments, they sent the remainder of the contract and cost of the machine for collections. We believe this is predatory business practice and we should not be liable for this. We are only requesting that the credit collection be cancelled, even though we lost a lot of business because of the machine failing, as it was responsible for one of our top selling products at the restaurant. Supporting documents uploaded include contract and several email threads requesting service.
