The Business was contracted to provide services for the filming of a production. An invoice was sent and paid for preproduction on March 15, 2024, for $*******. The business stated that a refund would be made immediately but it has not been received. The business owner stated that due to personal issues at home and a lack of focus on his part, he could not complete the project. The project was supposed to cover the pre-production starting with the ******* payment. During this time no receipts or deliverables were presented. When I started questioning him about the receipts, he started communicating less. I feel that this is breach and fraud by deception.

      Business response

There was an abundance of service deliverables completed by Leel Wan Productions for the client that were documented and/or witnessed by the client. Yet, much like the attached documented confirmations, the client refuses to acknowledge rendered services she received firsthand with her complaints, despite increasing pre-production requests on an adhoc basis and being satisfied only inflight of ongoing services being rendered.

Once Phase 1 and Phase 2 preproduction services were complete (totaling over 25 documented deliverables to the client), the client confirmed she forecasted at least 3 core characters had to be re-casted, with no previous script exposure. Once this was assessed, LeelWan Productions team concluded that the clients finite production timeline could not feasibly be completed without risk of quality and further exacerbating unplanned scope, that created a significant work life balance on the core resources with minimum budget.

Hence, Leel Wan Productions shared sentiments appealing to the client, as the Leel Wan Productions offboarded from the previously anticipated next pre-production phase. The paid invoice covers the completed pre-production phases 1 & 2, which were proven to be received and effective in the attached documentation and per witness testimonies if needed. Due to the burn rate of completed adhoc requests, rendered services significantly exceeded the ~$4k preproduction invoice amount, over a rigorous span of the documented 4 months (for over 6+ onboarded contracted resources) from Leel Wan Productions, averaging an unethical ~$170 budget per contractor each month which the company could not condone further.

During the completion of the documented 25th service deliverable,  Leel Wan Productions *** onboarded ********** as a scriptie, who was given sensitive login details to our Celtx system in efforts to aid in the script editing process. Both parties, ***** and Nene, created a collusion of tortious interference by using our system to edit the script, agreeing to pay Nene $500 for the final script specifically, while the client is demanding a full refund for the incurred invoice, dismissing the script fee agreement and receipt of all experienced rendered services to the client from Leel Wan Productions ***, per the complaint.

To detail, after Leel Wan Productions ***. withdrew from pursuing the next phase of pre-production, ********** and Sylky colluded into committing unauthorized violations of login access to Leel Wan Productions systems. The collusion was demonstrated in ****'s efforts to help the client steal our software services and receive payment for the script, while the client disputes payments for all agreed pre-production services rendered over 4 months including the received final script completed by **** in our system.

This activity takes place after Leel Wan Productions *** communicated a consideration of a refund with Sylky Diva, to retain the client long-term, despite discontinuing the project. Once unlawful behavior was noted, no further losses could be absorbed in efforts to retain the client relationship

      Business response

      06/24/2024

Sylky Diva  is continuing to commit fraud and defamation to induce distress, per the following facts: There was no signed agreement by both parties, as required by the contract to be valid, due to pre-production activities that consistently increased, upon adhoc requests made by the client that is proven within the attachments of our initial response and client calls. She mentions in her rebuttal numerous deliverables that were completed, that were initially "not received" in her initial BBB complaint. In her BBB rebuttal, ***** shares numerous growing dollar values related to numerous unsigned and/or documented agreements that were being negotiated in draft but not signed, as a more long term negotiation was being considered due to the growing essential preproduction efforts and related budget needed in real-time. Client failed to share deliverables for paid invoice had started months before the invoice was issued, though it was issued on the same day as our draft contract. It should be noted the draft contract forecasted 2 weeks of preproduction, though 4+ months were completed, also confirming the contract is not directly related to the preproduction invoice due to growing preproduction essentials for quality outcomes. Please see the attachments detailing that the presented budget the client shared was confirmed to be unrealistic as preproduction needs grew as she proceeded to require our services for more tedious pre-production activities. When warned of project risks, the client would deflect shared risks to Leel Wan Productions staff sharing Its ok. I have crazy faith multiple times, leaving no remedy for the project quality needed for Leel Wan Productions to reasonably continue with pre-production services into Phase 2, which would have been the second invoice that was never rendered due to Leel Wan Productions quality concerns for essential preproduction activities. Per the attached invoice detail, the payment was for pre-production services only, which was 4+ months of completing over 25 pre-production adhoc services that were clearly proven in our last response attachments and have been attached again for more transparency. Client was advised invoices would stop until Phase 1, adhoc, burn rate for completed services could better be assessed by Leel Wan Productions. Hence, mention of future invoices that were issued are fraudulent, as there was not a $25k invoice shared with the client from Leel Wan Productions.

Communications with ****** decreased due to her unreasonable tolerance to increase pre-production activities that would pay under minimum wage with no lawful work life balance for the work completed, to the point the companys portfolio and ending client satisfaction was not practical to proceed to Phase 2, as Phase 1 was completed to align with the paid invoice, as supported per Sylky Diva's BBB rebuttal, sharing Leel Wan Productions continued to complete received deliverables further, which we did not initially list, that she acknowledges receiving even after the agreement was severed. This is what ******* text in her rebuttal is referring to, though the message was shared from Leel Wan Productions in a very endearing and attempted relatable tone, in hopes to preserve the client relationship for another potential project in the future. Shortly after, Leel Wan Productions discovered egregious unlawful actions against our company committed by this client, as she proceeded to interfere with our contractor relationships, by onboarding our contractor (named ********** [please see confession by client in written BBB rebuttal] as she still finds her illegal data extraction, client data deletion, and inciting a compete agreement with our contractor as she was fully satisfied with our Contractor's work that was completed within our company's CeltX system (our script writing system Sylky refers to as ******* system) to be justified despite being unlawful; for the exact same project and a portion of the paid services Leel Wan Productions invoiced ******, in order to create a kickback agreement to pay the contractor without having to pay Leel Wan Productions for their completed and/or ongoing work to justify a full refund. ********** was granted limited access to the client data script writing system to only complete the 3rd/final script revision, which she illegally "paid $15" in extra fees to gain access to our company files to delete Sylky's records (as confessed by ***** Diva's BBB refund response rejection) as an unlawful admin to receive double payment from the client and Leel Wan Productions, as Nene and client colluded to manipulate refund fraud and kickbacks.  Upon discovery of unlawful actions and collusion, services were no longer available to the client indefinitely due to illegally deleted company documents from our system as well as creating competing agreements with our contractor, as an unlawful attempt to further fraudulently claim a refund request, through malicious defamation to cause damage to Leel Wan Productions.

Prior to clients illegal actions, Leel Wan Productions did consider a refund for client retention. Yet, ****** refused to accept the terms without us committing to egregious slander and libel against ourselves, much like she has been unethically hostile here in the complaint and rebuttal. When considering a full refund for *****, **** responded to ******** Production's refund request for the work completed in our system, **** proceeded to threaten and verbally assault Leel Wan Productions staff, as a rebuttal to refund the fully satisfied client. ***** fails to recognize received deliverables in hopes to receive more deliverables through manipulative theft, predatorial kickbacks and defamation. Client details numerous completed deliverables in previous rebuttal, including the illegal manipulations in our system to justify refund for completed work with "full satisfaction". ********** was paid by Leel Wan Productions as approved by client, due to lack of trust of clients displayed dishonesty. Yet, client persists to request full refund despite completed deliverables proven in last rebuttal and displayed in both partys attachments. Emotionally charged liable and illegal client document deletion will not be rewarded with a refund. At this point, the client is only attacking Leel Wan Productions with hostile, inconsistent defamation due to emotional retaliation for their unaccepted illegal behavior.
