I bought a $26,000 car from Emoji Auto Sales and Detail (a used dealership) in ****** ** on Mon. March 13, 2023 after test driving. I live 1.6 miles from the dealership and I drove straight home pulled in the driveway and asked my husband if he wanted to go for a ride. The engine was still running but the gas pedal would not allow the car to go. I immediately called Emoji and told him what was going on. He sent 2 of his guys over to change the battery out the very next morning of Tues. March 14, 2023. I left the house to go fill the gas tank and the car started jolting/jerking. I drove straight to Emoji to talk to the other guy in the office and the 2 guys that came to switch out the battery. One of the guys told us that they had this same issue and it was one of the buttons under my steering wheel. ***** immediately said hold up and took it for a drive and agreed something was wrong. ***** reminded me that I paid for a full warranty through Credit Acceptance (Lender). As soon as I got off work on Wed. March 15, 2023 I took the car to ****** Dealership for diagnostic under warranty. ****** called and told me it needed a new transmission. The *************** called me on Thurs. March 23, 2023 and declined the fix and said it was a pre-existing issue. I went to get car from ****** on Fri. March 24, 2023 and had to pay a $166.15 Diagnostic Bill. I have stayed in contact with Emoji through all of this by phone calls and texting with them saying they are here to do what they need to help. On Mon. March 27, 2023 I got a msg that they could cancel my warranty so I would get that money back to use towards the used transmission and he could call around for prices for me on labor. I told him that ****** and ******* Body Shop here in Winder both advised against a used transmission due to the kind of vehicle and he said he was going to talk with *****. I never heard anything back so I reached out today Wed. March 29. Now he won't do anything and it is not his responsibility.

The customer has been employed with our company's competitor prior to the date of sale and currently.  This claim can give them an advantage over our company.  After having the unit for over seven months, this is the first notice of any issues with the unit.  The customer signed the Buyer's Guide stating that the unit is "As Is - No Dealer Warranty" and declined the purchase of an after-market warranty, service contract, and GAP on the contract.  The customer can be contacted at KMB Auto ********************** located at **************************************************************, which is 2.4 miles from our dealership.  She lied to the BBB and the finance company regarding the miles on the unit.  Attached is the signed contract with the correct mileage and buyers guide.

I am rejecting this response because:My job has nothing to do with the jeep purchase andas far the the finance company I was financed threw Emoji as a buy here pay here  they **** the on that sold my contract to the other company and i was unaware of this .  I did speak to ******* on several occasions about the repairs i has to have done and i accepted the fact as is no warranty on the culuth and front end repairs i did because there is nothing i could do but when all that did not fix these problems i was having and i had the jeep checked out to **** out why that's wen i found that the maine frame was rusted all the way threw and i send pic earlier of this  this was something that had been there and they had most likely seen and just ignore and the owner partner at the time ******* and couple of the prev employee we all got along great i sent them customers. i never knew there was another owner there.  when i called about the mileage that the finance company told me was ****** not ****** i called to speak to ****** but the owner got on the phone yelling telling me he was not responsible for the misinformed mileage or the frame and he would not even consider talking to me.  i do not believe i has this 7 months before telling it because if he had not fired the prev employee they would be able to tell you that his company gave the mileage to the finance company.  his company is responsible for selling a vehicle to me with the frame busted.  I want my down payment back of $3500 and my 4 payments. and the money for the repairs  that i had to have that did not correct the problem cause the problem could not be repaired. I would settle for the down payment back and call it even.  like i said the clutch and front en repairs i did take as is  but not the main frame that could have killed me or my grandchildren if we haven't found it and the only reason he is complaining about my job is because he is aware that i know the laws in selling a vehicle like that.  . if he can not find it to at least do that much  then i would like to taske this in to court and will be reporting it to the used car broad.

      Sincerely,

      *********************

Her job has everything to do with this purchase. She plays a very important role at the dealership she works for. **** knows how to purchase a car and what to look for.  Also, Emoji Auto Sales & Detail has the right to sale our customer accounts to another finance company anytime we choose. This is a common practice with buy here pay here dealerships. We have contracts that are compliant with Georgia laws. We have not broken any laws. We promote rebuilding credit through our buy here pay here program. She was aware of the mileage. The contract she signed clearly shows the correct mileage. And so does the Carfax report. She was given a copy along with her contract. Corporate will be counter suing **** for false claims against Emoji Auto Sales & Detail.
