At purchase of a vehicle at *** in ************************************************************************************ 2019 the vehicle was inspected by *** and it was determined based on the warranty of the simoniz coat that the vehicle had to be repainted. The work was outsourced to GX body shop. The work was lined up, then ***** hit and brought everything to a halt and the work was not done by GX body shop. Beginning of this year, 2023, I was at *** for another issue and it was brought up that the warranty work was still active and I was encouraged by *** to contact GX body shop again. After contacting GX body shop and after several back and forths with **** at GX body shop, it was agreed that I have a few dents taken out by another body shop as well as purchase a few parts on my own expense, for **** at GX body shop to do the work he was paid for by said warranty through ***. The appointment with GX body shop was set for 05/15/23. At that time he refused to do the work and agreed to pay the money he got paid from the warranty, to pay back to me. The amount he got paid is $ 2,874.He has not paid back.Business response

customer had the estimate done in 2019 for paint related issues. When the warranty was approved, ***** had stated and everything was shut down for a while so nothing was done. Fast forward to 2023, when we agreed to complete the repairs that was estimated 4 years ago, the vehicle came back with lot of new damages. A crack in the passenger fender, large dent on the passenger side quarter panel all the way to the rear bumper, large dent on the drivers side quarter panel and drivers side door, passenger side rocker panel had a tear, front and rear bumper had impact damages and tears, the roof was cracking. All these issues were not on the vehicle back in 2019 nor were they a part of the estimate. Customer asked if we could just do the repairs as a part of the original estimate and we said no we cannot repair all those damages for free. Customer said she had "someone" that could fix the damages then she will bring it to us and we can just refinish the car as per the estimate and we agreed to it as long as the repairs were up to industry standards. The vehicle come to us on the 15th, with primer over spray all over the vehicle, islands ( which occurs when the repairs and prep isn't done properly) was all over the repair areas, there were damages to the front bumper that was not repaired, the rocker panel was not repaired, the rear bumper had incomplete repairs, and even the repaired area was very wavy. And this is the reason we declined the refinishing of the vehicle. We have already stated we will give the refund amount but she will have to sign a release form and as stated in the messages, we will contact the customer once the documents were ready.
