June 2, 2023 I called the office of Marvin **** Dang to inquire about a wage garnishment order sent to my employer. The lady said that because the case is closed and sent to another firm. It is actually a firm that Marvin Dang works for *****************************. I called again 2nd time and she hung up on me. Very unprofessional. I just want information about what this debt is.

Thank you for forwarding my law firm (Law Offices of Marvin Dang) the matter that a *********************** sent to the BBB.

However, we have not been able to find an account in our files for a ***********************. Additionally, we researched the court records and could not locate a party named *********************** for which there is a wage garnishment.

However, late last week we received a motion from a *********************** claiming to be a ******************

For privacy reasons, if they are the same person, we would need from *********************** the last 4 digits of her social security number and her birth date so we can compare that information to what we have in our file for ******************

Once we can confirm that they are the same person, we will be able to reply to the BBB complaint.

      Thank you.

I am rejecting this response because:

My apologies for not answering in a timely manner. The ********** of Marvin ** Dang did not ask me for my SSN and did not ask for clarification to identify myself. Neither did they ask me any questions. I called them as soon as the garnishment notice was delivered to my workplace. The first lady who answered the phone told me that someone would return my call and would assist me if I called the number on the garnishment notice. The second time I called, the lady hung up the phone on me. Both times that I called I provided them with both the name on the notice and my married name as well as my case number. I just wanted an explanation and clarification.

      Thank you for your time,

      ***********************

      Sincerely,

      ***********************

These people have started garnishing my payroll check without any notice at all.. they didnt follow any of the rules. I was never served with courts papers. I called my company I worked for to get their number and they havent answered the phone all week. I have Emailed their website and no response. I called the courts and the only way to resolve is by contacting the lawyer who filed it who is ***********************..

The Law Offices of Marvin S.C. Dang, LLLC ("****") requests that ************** withdraw his BBB complaint against **** or that BBB dismiss the complaint against ****.

The reason for this request is that contrary to what ************** alleges, **** did NOT garnish his payroll check.

The garnishment action was done solely by another law firm: **************************************** and its attorneys ("***********************").

*********************** currently represents the Plaintiff in the lawsuit against ***************  The Plaintiff in the lawsuit, i.e. the Judgment Creditor, is National Collegiate Student Loan Trust ("Plaintiff/Judgment Creditor").

Attached are two public documents filed with the *************** Court which confirm that *********************** is the law firm that garnished **************' employer Bayada **************** ("**************** employer"):

           1. "Declaration of Judgment Creditor for Garnishment of Wages." Circled in red are the names of *********************** and its attorneys who are indicated as representing the Filing Party, i.e. the Plaintiff/Judgment Creditor for the garnishment.

           2. "Return of Service."  The Return of Service shows that the process server served the "Declaration of Judgment Creditor for Garnishment of Wages" on **************' employer.  Circled in red are the names of *********************** and its attorneys who are indicated as representing the Requestor of the garnishment (i.e. the Plaintiff/Judgment Creditor).

Because **** did not prepare, file, or serve the garnishment on **************' employer, ************** is incorrect in his allegations against ****.  If he has any concerns he should contact *********************** at the phone number on the documents..

In fact, when ************** telephoned the Law Offices of Marvin S.C. Dang, LLLC earlier today, he was specifically told to contact ************************************

Accordingly, the Law Offices of Marvin S.C. Dang, LLLC ("****") requests that ************** withdraw his BBB complaint or that BBB dismiss the complaint.

      Thank you.
