I called for information on whether they could help with my tax issues. They immediately asked me to pay $495 but said that would only be used if I used their services. I decided not to proceed and have not received any refund. I have all of the communications asking to refund/cancel.

      You have the wrong company.

We are located in ******** Hawaii and we have not spoken with your or received any payment from you.

There are several companies nationwide that have similar names.

You should contact your credit card company and dispute the charge.

We have not called your or received a call from you.

We have not received any payment from you, we would not collect any payment until an engagement letter is signed.

Please contact the correct person or company that actually contacted you and that you paid.

      Thank you

I hope you have other locations that you operate your business out of. I personally couldn't find any other addresses for this business but a friend of mine and myself as well received a call from some one named **** from tax relief service's I asked Aldi where is her business located just because I know it's tax season and scammers are out for your blood sweat tears and everything else they can take from you. **** replied she's located in ********** then i took the phone from him and began to speak. I said so I know this is scammer season and I know people are out to bleed people dry collect their info and taxes if they haven't filed this year yet. So you either don't know the state your business operates from or you are one of those scammers then she asked if she could place me on a brief hold put me on hold for two minutes then a man picked up the line said he was some fancy tax preparer boss name I can't remember exactly what he said but it sounded important then he said they was in **** I just had another scammer call and ask me for my I.D.me login info that's the info that let's me know if my social security number is being used by an unauthorized person I get an email notification if someone tries. So if you give that login info up you can kiss your Identity goodbye and they will have the upper hand because I.D.me is through the *** once they gain access to your login information you're basically screwed. Identity gone. I say all that to say this BE VERY CAREFUL ****** the business if you have to read reviews ask questions that only employees would know. never give your login info to anyone over the phone and if they ask for it or don't know something as simple as their company's state they operate it out of collect all the information you can about them and report them to the police the *** and the company they are claiming to be a part of. Money is the root of all evil so beware

      We are located in Hawaii.

We do not cold call or have any agents or advertising outside of Hawaii.

There are several companies nation wide that have similar names and I even beleive one to two using the same name.

We have also been told the some of these scammers give them our information and "spoof" our telephone number.

Again, this is not our company or anyone acting on our behalf.

      Aloha

Date of transaction: 10/182023 Amount paid: ******* David Ramirez and I met on 10 18, 2023 and agreed for him to research my tax problem and help me retrieve any money do me by the **** that day we discovered that there was $15,000 the *** had that I never received from my ************************************************* the next day and also filled out a request form to receive a copy of my 2017 tax return, I asked him when the tax refund of $15,000 would likely be received. He said a couple weeks thats when I agreed to pay him the $1500 because I knew that I would have money that I needed to pay down some debt in collection that Ive in agreement with a debt collector after four weeks you know I inquired hes hardening office his receptionist usually is the one who would speak to. She said shed have him call me. He did finally he said that he had ordered that money and you know just another couple weeks probably at the six week ***** I also received a letter from the *** stating that my 2017 return copy that I ordered was unavailable , I took the documentation over to him he wasnt there. I left a coffee with his receptionist he had called me a couple days and said that its not available we can file a freedom information act request the next day I decided to re-review the documents sent to the *** I did provide to David Ramirez and after examining them, it became clear that the reason why that they did not send me the 2017 tax return was due to the request form not being completed properly with putting my ex-wife information down so theres incompetence there now I have to wait another up to ***************************************************************** on December 7 to let me know that my refund is on its way. I said oh great you got a hold of the *** he said yeah its another 46 weeks I gotta go bye he didnt order it until December 7 week nine after I paid him he finally orders the refund now Im waiting another 4 to 6 weeks and I doubt he still filled out the new request form to receive my copy of my 2017 so Im gonna turn services within requesting a full refund its putting me into a financial bind, which I did let him know that I was in section 8 housing I had very little extra money that it was critical that I received that refund in a timely manner so that I could be able to pay him and not impact my other obligations in a negative manner I will be filing a power of attorney revocation with the *** and providing him one as well, and I would like a full refund

I provided most of the information that what you sent me as your forwarding of my complaint states not provided:  here it is again

      employee name:  David Ramirez

      Date incident occurred:  10/18/2023

      Date incompetence discovered: 12/7/2023.

      Business response

Due to *** disclosure laws I am able to provide a limited response.

First I do not and can not control the time frame of the *** and its processing  of requests or refunds or processing of requests for tax returns.

some Clients had personal situations and are looking for someone to blame.

somw clients have unrealistic expectations and myself or anyone will never be able to meet those.

i can tell you that I provided what was provided for in our engagement and more.

anyone who files a joint tax return is able to obtain a copy of a prior year tax return that was filed jointly with only one of the spouses signature..

the fact that someone has unresolved personal issues do weigh on me but as I stated I cannot control the processing and issues of *** personnel or policy directly.

i Can say that I went above and beyond in this situation and we did more than what we were retained for.

Refunds reissued by the *** can take on average 6 to 8 weeks, many times longer.

processes have been initiated but nothing happens at the *** in a couple of weeks in their fastest processing times.

i never guarantee any specific time or outcome because I have to obtain all case facts and information.

      this case was no different.

We almost every case the there are numerous resolutions but all cases are different because of the facts and circumstances on the clients situation.

for example, if someone has a unissued refund check from years ago, there are numerous complications to getting the *** to reissue it.
Sometimes the process can be initiated quickly, but other can take weeks and even months depending upon the facts. Lost or stolen refunds need to go through a tracer and will take months.

      Complaint: 20991695

I am rejecting this response because:

It is a false statement for which I have direct evidence to refute. I have a receipt and bank statement showing that I paid  Tax Relief Services ******* on October 18th 2023 after with the understanding that a prior year tax refund of over $15,000 that was being held by the *** due to being returned to sender would be sent to my current address and should be received within a couple of weeks.  Its clear now that he said 2 weeks to cause me to feel confident with paying him right then.  Prior to paying the $1500 to David Ramirez, I made him well aware that my resources were very limited and that I had been . Homeless since 2019 until September 19 if this year and has recently been granted section 8 housing with the assistance of the VA. As I am now a 100% disabled wartime veteran honorably discharged from the *********.  Telling me I would receive the refund in a couple of weeks was willful deceit as I discovered because the *** states on thier website it will take 4 to 6 weeks to process and receive that type of refund request.

Additionally He was to order a copy of my 2017 Tax Returns last week I received a letter from the *** stating that a copy of that return was unavailable for unspecified reasons refer to enclosures.  I took that letter to his office.  His front office worker made a copy and assured me she would make David Ramirez aware of it and that he would follow up with me.  On December 4th I received a voice mail from David Ramirez stating that hec had good new that my tax refund was in its way.  I will receive it I  4-6 weeks.  Concerning the copy of my 2017 return he stated there wasnt allot we could do about The copy of my 2017 return maybe we can file a freedom of information act release request sometimes documents are just unavailable the *** he stated.  I quickly concluded that he only requested my refund that day. Lets do the math:

I paid for that service on Oct 18  2023 after he stated he would request my refund right away and should see it in a coupe of weeks.  I receive a voicemail from him on Dec 4, 2023 stating that my refund is in its way but will take 4-6 weeks.  On Dec 4th it had been nearly 7 weeks from when he said was ordering it.  That means he neglected to order it .

Also after further reviewing letter from the *** stating that my 2017 Tax return  and included the request (separate from the refund request)  was incomplete due to it being a a joint return it should have included my ex-wifes information and signature.  The 2 areas of the request form for my ex wifes info were circled and date/time stamped by the ***.  So now we are 8 weeks into the process and still at the start line.  Its out a financial strain on my life due to his deception and incompetence.

Im starting to think a better use of my time is likely to go down to the ******** District courthouse and file a small claims suit against tax relief along with ensuring that the veteran and military ********* of **** are fully aware of my experience with this business.

      Sincerely,

      *******************************

It is clear you have personal issues and are fabricating facts.

i did not create your tax situation, you did!

I dispute your unfounded assertions 100 percent.

I will issue a refund to end the matter.

I will mail a refund next week when I return from the mainland.

Do not email, telephone or come to our office and do not contact me or any of my staff.

Talk about a personal attack.  I must have personal problems?  I have been 100% professional and quite patient I might add.  Following up after the time lines you gave were exceeded.  Asked to see the *** written policy on  situations pertains to me only to be told I dont know know where to find it in the *** tax code by your staff or given eroniius information. By you, ******* I adjective if  be prepared to send supporting documentation regarding my claim of financial disability with my 2018 tax returns since I was submitting beyond  the three year time limit.  I also asked what exactly would I need to submit.  Your reply to that was an Enphatic No thats not the process.  The process is to submit the 2018 tax returns , then wait for them to get rejected by the *** and then seek the exception.  ****, that not correct If you got to irs.gov and search the irs tax code it clearly v states that evidentiary documents showing financial disability must be included when submitting a beyond 3 years late tax return.  The reason I paid you the **** is for your expertise and experiences so that we would get it right the first time avoiding months long delays.

I did not fabricate anything I stated about anything I recanted from a verbal, email or voice mail.  Thats a complete fabrication on your part to state that and shirking responsibility for dropping the ball at every juncture and demonstrating incompetence regarding your knowledge of the current tax code requirements.   If your going to keep up with making like Im lying and have personal issues in a very derogatory context the Id say choose not to refund my money and well let small claims court decide.
