HPS Construction Services (HPS) started our small bathroom and kitchen condo remodeling in May 2022. By the third day of the project HPS had already withdrawn 75% of the project for labor. Twice they withdraw from my account without my knowledge or permission. I paid for all the material. We were told by ***** (Director of Operations) one-week demo then build-back the bathroom. We were without use of our only toilet for 7 weeks, no shower, no lighting, non-licensed plumber, and for several months no bathroom sink. Were still without use of our kitchen since October 2022. The toilet leaked and asked HPS to fix it. They installed the bathroom cabinet cutting a large hole to the back-panel and realized after it was installed it was the wrong size cabinet, removed it and didnt fix the hole. Grout was not properly sealed, all the blue tape marking the tiles were taken off by the lead worker who said h*** take care of it later but didnt do anything. Painting is terrible, no baseboard back of toilet and discovered a toilet and sink leak. *** sent email after email asking HPS for work status and project schedule. No one check the work.We have emails and texts from HPS management reflecting mismanagement of the project and promises things would improve from July of last year ---no change! Early October a worker brought to our attention that the kitchen cabinets dont fit. HPS took the measurements prior to ordering the cabinets. Between October stoppage of work through December, we repeatedly asked what the status was on the cabinet situation and reorder. HPS worker came in twice only to remeasure the kitchen cabinets again and left. Twice we asked HPS management to meet and no response. HPS didnt communication, respond to emails or perform any work for weeks. HPS didnt complete the project, breached the contract and was overpaid. We asked to cancel the contract for non-performance, deficiencies, and breach of contract for non-licensed plumber.HPS Construction Services, Ltd. Response

This client is leaving out the rest of the story, and much of what she attacks us about is not true, especially saying we withdrew from her credit card without authorization; the contract has her signed approval for progress pmts processing. The fact remains that client significantly changed the kitchen layout at the last minute and we found out in December that it requires $600 new special order cabinets. Besides, as you know, from the previous change orders you made, you pretended that this special one of a kind kitchen cabinet design to accommodate an oversize fridge was originally part of your contract. It was not, nor were the other changes, and you are lying to shift blame to us regarding the netted tile which is spelled out in the contract. Evidently, you havent read your contract nor the requisite Disclosures+Miscellaneous. *****: Here is a partial response to your yesterdays illegal termination letter and subjective rationalizations, which have been addressed in the last 15 or more emails we sent and/or responded to out of a number approaching 150 plus texts. We have been dilligently trying to find a mutually fair settlement. The law says we and the client should reach a mutually acceptable compromise. In the overview, ninety percent of the history you cite leaves out the other side of the story, such as stop work for Additional Change Orders, your mis claim about not be notified of netted tile (in contract), nor there being no mention of a new, oversize fridge in original contract requiring stop work and wrong cabinet which you previously had approved and paid for, or your requested no work days, nor building elevator availability, nor recognition of the nationwide worker availability problem----not even recognition of the $5000 original 3 day valid Federal Funds Discount which you delayed on approving contract for around 4 to 6 months and yet we still provided the discount; we have documented erroneous statements and claims made by you in your perception of this project timeline, in particular, omission of stop work due to Addl Work Orders Required at your request, except for the taller fridge accommodaton to be documented in the last couple of months of the year. Left out of this one sided, fake news review by the client claims regarding the netted tile and the last minute change requested by her for a taller, bigger fridge, plus the change order, the painting change order, the flooring change order, and your unilateral termination without allowing even access to your site to continue taking steps, all are not documenting nor acting in Good Faith and Fair Dealing, the bedrock of State Law.Review from T. HPS has long delays for resolution on a project and lack of communication with customer, even after being fully paid. Labor shortages, over tasked and material supply issues are some of the excuses used, there's no commitment to right the wrongs of botched worked done on the task for my home. I'm frustrated and have grown impatient with HPS, but need to wait on them to correct their sub standard work or hire another to correct the wrong and pay the additional cost. Hope my situation is an isolated case and hoping a company with such a high rating on BBB will expedite this matter and do the right thing.HPS Construction Services, Ltd. Response

This client had a small specialized job that basically only HPS does as a multi Licensed Contractor. He needed siding replaced, which we did, but which took two days, as expected. However, there is only one vendor who handles the specialized trim pieces for this old house, and they did not have it when we originally got the specialized matching grain improved siding. Just by way of update, the trim pieces came in this week, and we will be installing them tomorrow, Saturday the 5th of March, weather permitting, or perhaps Monday the 7th. This client is demanding but he knew the facts. Yet, as you can see, does not provide the whole story, and evidently delights in trying to hurt our body of employees and their families, knowing there is a nationwide including ****** Pandemic related Supply Chain and labor crisis, and that 57% of contractors nationwide report running behind on completion by almost two months. HPS is in our 28th year and we have the best, the lowest complaint ratio in the entire state of residential licensed contractors, ****%, and they were all (10) of them, about one every two years, were adjudicated in our favor because they almost all had insufficient evidence of what they were saying, and they mostly were trying to just get a money back gift.Customer Response

Closing comments from customer. HPS isn't the only contractor that can do this type of job. The job took two days as mentioned over a one month period, really three days with corrections that were needed. I don't consider my home old, it was built in ********************************* stating only one vendor (Honsador) has the trim gain that's matching for my home. I don't feel I was demanding, as this two day project took place over a 6 week period, with two days of actual work. If me having to constantly follow up with the contractor for updates is demanding, due to a lack on communication with me the customer, than I guess that pictures me as demanding? I don't delight in causing harm to a company or it employees, but I did request a different crew from the original, due to poor workmanship on replacing **************. Totally understand the pandemic and supply situation, which created labor issues, but not communicating these delays to the customer with updates was not good in keeping me abreast of the delays. I addressed the poor workmanship with pictures for corrections, which some were addressed, after much back and forth dialog with HPS. I ended up fixing the remainder with the help of a friend, as I gave up and didn't have the energy to continue the call for more corrections that weren't addressed and needed. I'm now satisfied after I made the remaining corrections and can now paint and close out this project. I wish HPS well and hope they will focus on communication with customers and quality control of workmanship when a project is completed, as customers are paying good money and have expectations.
