      I recently contacted Pono Kai Resort to explain my medical and financial hardship situation. Due to this I can no longer afford a timeshare that has no value, and no one wants. Unfortunately, the resort has no sympathy for medical hardships. I feel misled by sales tactics, as I was told you can sell it or rent it out at the time of purchase. That is not true. You can't rent, sell, or give it away. I do not want to leave this burden on my sons who have nothing to do with the timeshare.I've survived a stroke, recently changed jobs, and moved to a new state that required me to take a $25,000 a year pay cut. It has made it difficult for me and I am close to retiring. There's no benefit from it and has been a wasteful venture for me. I've done some research and came across information that if there's a catastrophe at the resort such as a hurricane, etc. that it would be the timeshare owners that would absorb the cost of the repair. I never was told any of this at the time of purchase.

      We have received this owner's request for a deed back of her timeshare interval and informed her that in order to have the interval removed from her name, she would need to sell or transfer to a new owner.  While we do understand and sympathize with her medical and financial hardships, the Association does not and is not required to accept the deed back of intervals.  The owner does have the option to rent or sell the interval at any time.  The owner indicates that she felt misled at the time of sale, so the complaint being filed against the Pono Kai Resort is inaccurate as neither the resort nor the current management company were involved.

      I am rejecting this response because:

      The last statement of the Pono Kai Resort states "The owner indicates that she felt misled at the time of sale, so the complaint being filed against Pono Kai Resort is inaccurate as neither the resort nor the management companies were involved."Wouldn't that mean I did not make any agreement with the current Pono Kai Resort and therefore can also be released from the contract for the same reasons they have cited?Sincerely,

      The response to this owner's original complaint simply stated that neither the Pono Kai Resort nor the Pono Kai *************************** was the sales company through whom the owner purchased their timeshare interval.  This has no bearing on the fact that the owner is deeded into this interval and is responsible for annual maintenance fees to Pono Kai ***************************.   Unless the timeshare is sold or transferred to a new owner, the owner remains the deeded owner of record and is responsible for the maintenance fees associated with the timeshare interval.

      I am rejecting this response because:#1 it certainly does have a baring because the contract was falsely represented and now they are trying to retract the information that was presented by the person that was representing pono Kai resort. I should not be held to a contract that they feel that they don't have to honor. I would never have entered into a contract that will NEVER end.NO ONE should should have to be held to a contract that will never end without an option for release. That is exactly why I asked if the was a buy back program, and was told there was.This to me is a scam. They have been paid the cost of the time share(with. The first year). They can resell it for much more than I paid for it. That means the profit at least twice as much.
