DFI has investigated alleged actions regarding License Nos. HI-340467; HI-340287. It is stipulated that DFI has substantial evidence in its files to support, after hearing, findings of fact and conclusions of law supporting the Notice of Charges filed in this matter on May 15, 2013 that would result in the revocation of Respondents' respective mortgage loan originator ("MLO") and mortgage loan originator company ("MLOC") licenses.
The Respondents understand that they have the right to have a hearing before the Office of Administrative Hearings, Department of Commerce and Consumer Affairs on this matter and to be represented by legal counsel at such a hearing, as well as a right of judicial review of the result of such hearing, but freely and voluntarily waive their rights to a hearing and to representation by legal counsel at such a hearing. Also, the business freely and voluntarily surrenders all records, contracts, loan documents, and agreements stored in file cabinets, boxes or electronically to the DFI.
The DFI agrees that in consideration of this Stipulation and Order it will forgo the imposition of fines against the business in this matter. By entry of this order, MLO and MLOC licenses are revoked, effective the date of this order.
