      I'd written about this company not providing the warranty coverage described. Turns out, the dealer admitted to the warranty. However, new problems have arisen that have become a burden, not only financially. The truck I've signed to lease purchase comes at a total price of $72,690, which includes my down payment of $3,000 ($500 less provided by my Truck Carrier, Landstar) and 42 monthly payments of $1,695. Anyone with experience in this market would know a semi truck in this price range and year would have been reconditioned into nearly refurbished state, mechanically. However, the condition of my leased semi truck has become much more than questionable. I have already broken down on enough components to understand that this truck was given a conditioned problem. I have five years of experience, nearly one year accounts as driving for owner-operators and four years working for established carriers. And not once, had I'd driven a truck, even those ranging up to 800,000 miles, break down as much as my leased semi truck. The true value needs to be accounted for and I do believe Lone Mountain should be responsible in correcting the situation. In the amount of downtime I've spent this would calculate to lost potential earnings in a market that I kept falling out of. I have agents that try to track my shipments to provide me with freight to continue working with minimal downtime but I have to continually pass up, due to maintenance. So I have lost potential wages and spent exponentially all earnings on maintenance on top of a high payment of a non maintained semi truck. I have already invested nearly 8 grand in maintenance and 7 months of payments. I've had the VGT actuator, alternator, fuel pump, four batteries, a brake chamber and now the radiator have all needed to be replaced since August 2023 when I obtained the semi truck. The truck is worth less than $40,000, the price the dealership would sell it for. I need a trade, price adjustment or credit of payment.

      *** ***** leased a used commercial vehicle in August of 2023. The truck was sold As-Is with no warranty from Lone Mountain (As-Is sheet signed by *** ***** is attached). The truck did come with a warranty from the manufacturer that covers the engine and the aftertreatment system. We also give every customer the option to take the truck to have it inspected at the shop or mechanic of their choice. We make it very clear with every customer during the underwriting, sales, and closing process that they are 100% responsible for all repairs on the truck throughout the lease. *** ***** agreed to this each time. 

      When *** ***** applied for the truck he didn't have any experience in driving his own truck, but we approved him because he was going to a good carrier. At that time he told us that his plan was to set aside $500-1,000 per WEEK for maintenance. That is significantly more than he says he has spent on the truck so far, which averages $1000/month. In addition to that, the repairs he mentioned in his complaint are all pretty minor and shouldn't result in any significant downtime. It also looks like he may not be utilizing the factory warranty because one of the invoices he sent was from a Freightliner dealer. In order to use the warranty the truck has to go to an International dealer. 

      In February we offered to possibly offer him additional help with his payments if he sent us documentation of significant repairs. At that time he advised that he was too busy to send us anything.

      If *** ***** isn't comfortable with being responsible for the maintenance of the truck throughout the lease and on the small ticket items that fall outside the manufacturer warranty he may want to look into returning to be a company driver.

      I am rejecting this response because:

      Lone Mountain offers to fix any defect found at the time of purchase, however, that does not mean faulty components can be detected if they are tested and in a functioning range, for a short time based on the computer diagnostic. Some parts can be rebuilt to temporarily run and I do believe they have done so to this truck.

       

      The parts on this vehicle could have come from elsewhere, which I do suspect to be true in the case of the alternator. It was an ACDelco that is no longer manufactured or even under the same part number. 

       

      The truck functioned in range during my testing phase, however there were still faulty components, including the batteries.

       

      They (Lone Mountain) want to use my testimony of maintenance escrow as an excuse of their truck having faulty components. A signature of a contract does not rule out faulty equipment.

       

      They (Lone Mountain) would also like to take this time to attack my character and not once have I had to call out a fault in their being. In which case they should be called Lone Shark Truck Sales. As you can see attacking their fault has nothing to do with the truth or resolution of the matter.

       

      They (Lone Mountain) have proven to not have the decency or fairness to admit they sold a salvaged truck in which they swapped parts off of.

       

      I know for a fact certain components have much more rust than the overall amount of the truck itself, proving some abuses to the truck.

       

      I have decided they do not need to recieve any invoice other than the one described as ************. They have clearly made assumptions of what I need to do for service and did not state the reasoning of receiving the invoice. Clearly another attempt to mask the actual events.

       

      The situation with ************ will remain seperate, and my service with them was not a Cummins warranty claim. That matter makes little to no difference in the big picture. At that time all they had to offer was the different of one payment but they requested every single invoice of repairs. The situation was my truck was stuck at ************ for two weeks and they weren't repairing it. I had to tow the truck.

       

      Radiator repair cost $4,000

      Batteries $1,000

      Alternator $500 plus labor

      Fuel pump $1,500

       

      As a dealer to not have an overall idea of its' condition and need service on every component adds stress to the engine and drains my wallet of more expense repairs, such as a engine overhaul which can cost up to $50,000 to rebuild. Transmissions can also be costly and there is no telling if they will fail, especially when the other components are bursting monthly.

       

      They (Lone Mountain) create a false visual that repairs are seamless and swift but the truth of the matter is availability of technicians and availability of parts. The fuel pump, alternator and radiator were parts that still had to be shipped and were out of stock. This adds downtime, in addition to what I have stated about the market.

       

      My earnings in the market do not match what was anticipated, although it will on good weeks. Remaining in downtime for maintenance does not help keep me in the market.

       

      The cost of a high monthly payment on a truck they put absolutely no effort in preparing does not equate to a successful market.

       

      Lone Mountain intention may not be to sell truck but to bankrupt drivers. This statement equates to my consideration as a company driver.

       

      I wanted to give them a chance to make it right but they have proven what they do is sell junkyard trucks to drivers they do not respect.

       

      All I asked for was the opportunity to review the neglect of this truck's condition before sold and make an adjustment in all fairness. Apparently, that meant that I am irresponsible and unable to maintain my finances and maintainance. They would rather bring me down and damage my reputation thatn to simply state no. Which I still disagree with their answer.

      Lone Mountain purchases all of our trucks in bulk from large fleets and manufacturers. His truck was purchased directly from the manufacturer and had only one previous owner. Lone Mountain has had 11,722 owner operators complete our program, but at this point it seems very unlikely that Mr. Swain will add to that total.

      If a couple minor repairs over the course of eight months of running a used truck are too much for him to handle then he can simply return the truck. 

      We will offer to let *** ***** return the truck to us by Wednesday, April 10th. If the truck is clean and in normal condition we will delete the lease from his credit and go our separate ways. If he chooses to decline this offer and stay in the truck, then he will continue to be 100% responsible for all maintenance on the truck going forward, which is what he has been told from day one.

      Thank you for your consideration in this matter. Unfortunately, I am in Florida at this exact moment and under a load. I will not be able to return the truck by your agreed date of the 10th based on Hours of Service and travel. I will also state this is not enough time for me to accept a return due to the fact I would have to prepare the truck by clearing out my belongings and detail to your satisfaction.

      Overall, I am unable to accept your proposition mostly due to time constraint, I am unsure this will be the right resolution.

      We reached out to Mr. ****** to tell him why we could not finance him at this time, but he ended up screaming hysterically and hanging up the phone on our credit manager, so it would probably be better for him to seek financing with someone else at this point.

      I had the truck for 2.5 years with a year left before it was fully paid off. i was almost there but after some devastating issues at home and after a missed payment was repoed. now legally they were within their legal rights to do so -and i think its a great program overall---------------------but it's what happened next that really surprised me and i dont know if its just someone who messsed up at lone mountain or what but id like this resolved ASAP----------------------- they repoed the truck after 2.5 years of payments with a year left. in the beginning of the lease the offer is no finance charge or interest charge just down payment and a set number of payments until payed off which sounded great.........................................so the original price was *** and I put ** down then I made a total of ** monthly payments out of ** at $**** a month $**** x ** = $****** plus the ** down thats $****** right. So i gave them *** and the starting balance was *** so theres a balance of *** i would owe right. now theres no finance charges just a set amount of payments or you owe the diffrence right. but some how apparently the 2013 ********* *** i leased in 2017 for *** with APU and brand new rebuilt ******* motor in excellent working condition that they leased to me for *** sold at auction in 2019 FOR ONLY $***** dollars lol....maybe they sold it to them selves at that price.....did i get hustled????......honestly im really not sure....hopefully its just an error.........and they had the nerve to put a $** balance on my credit report like it was a legitimate balance . i was contracted at ******** super strict on maintanence let alone the way i babied the truck. in two years a *** working truck in great condition with a rebuilt motor sold at auction for ** with no notice of sale no no invoice no explanation no nothing... UNREAL!!!!!!!! somebody messed up here it makes no sense i dont know if there was a paperwork error or what but this definitely needs corrected

He can contact us if he would like to make an arrangement to have this balance taken care of and removed from his credit.

      I'm challenging the validity, reporting and accuracy of the statements you've made.

      This ACCOUNT that is SUPPOSEDLY NOT ONLY RECORDED BUT YOU SHOULD ALSO HAVE PHYSICAL DOCUMENTATION FOR IN YOUR SYSTEM falls under the FCRA, Fair Credit Reporting Act, Section 609.

      I AM ASKING YOU please verify these records and all statements you've made here. If you cannot verify ALL the statements made here in response to my complaint, I request you remove this data from my credit report.

      I am requesting a re-investigation of the statements you've made here and the data that appears on my credit report that you provided to EXPERIAN and other credit agencies as well as all statements you have listed as valid in your BBB complaint response statement here on 10/10/2022, your company has responded to my complaint and stated that the information which appears in your response is verifiable and therefore cannot be deleted.

      I admit it I couldn't make the payments anymore but I made my payments until I went through ** ****** ******* *** **** ** ****** ****** **** ** *********** ** ****** *** ****** *** ** *** **** ****.
      yeah i couldn't mentally do it anymore and I lost the truck
      But you sold me the truck for ***
      And only 2 years later you someone at your company sold that same truck
      with only an additional 40k additional miles for only $*****
      I babied *** **** ***** the truck
      it had a fully rebuilt ******* motor that ****** ********* put in it
      I didn't put more than 40k miles on the odometer
      How is that commercially reasonable. I recommend your company to many people the only part that's not right is this part I had every intention of paying off my truck I didn't know 2 years later what I would be faced with.

      From $****** to $****** In 2 years that's more than **% i just don't understand.

      You didn't send all of the documents I requested.
      I can only assumme you don't have all of them.


      1.) I never got the full lease agreement like you claimed below. you only sent page one. Page one of the lease agreement was sent. Not the full lease. No fee schedule or terms nothing.

      2.) payment history contains a fee for $**** just titled miscellaneous and other random fees you added for $** and $** for reversed charges?
      MY bank statements don't show any reversed charges to lone mountain or ****** ******* or **********. Im assuming these are just hidden fees you charge to make money on the back end.

      3.) You sent a invoice receipt for 4 batteries thats dated over a month before the truck was even repossessed. On top of that I just tires and batteries on the truck the start of October.

      4.)you said the repo FEE was $**** but the note you sent me says it was actually $**** not $**** ands its dated 1/14/2020 its not even a reciept its a pdf note. Anyone could've made that. maybe it was just another miss statment like you claiming repo fee of $**** and you've been reporting this innacurate balance to the bureaus for 2 years.

      5.) The Bill of sale document is incomplete. It also contains a sales receipt document that is completely blank with a title document that says ****** ******* is the owner which is lone mountain.

      6.) why didn't you send the After sale documents: Your required to send both post repossession and post sale letters and I never received one. You need both of those to collect a deficency balance. those notices contain important information like when you intend on selling and where the sale will be. I had a right to get an appraisal before you sold the Truck but you decided to not inform me and sell the truck for more than **% off at your ********** website while you wrote the rest off on your taxes.

      Obviously you didn't investigate close enough.

      The truck had a rebuilt motor from ******* I put maybe 40k-60k miles on the truck it was well taking care of.

      So let me get this straight you sell me the truck for *** then two years later you turn around and sell it for **% off at your ********** site as a tax write it off and then come after with inflated fees saying lets make a deal.

      How about you stop trying to squeeze every last nickle outta people or actually look at the **** documents.

      That same truck is selling today for ** ***** or more

      ******************************** There are certain car dealerships, leasing agencies, and financing agencies out there that refuse to work with people on late payments and instantly repo the vehicle the minute a late payment happens. **************************************************************************************************************** I was PERFECT with payments until my very first time I needed a couple weeks to get passed renewing insurance and registration on my truck along with a couple maintenance issues that popped up all at the same time. I needed to fix these issues in order to keep running. I called and spoke to them on the phone and explained my situation BEFORE the due date and they lied to me over the phone telling me they will work with me with the payment. I was honest with them and told them I didn't have the exact day I could pay back but will do my best to get caught up ASAP. The day my payment was due and it became late they told me to drop my truck off to their ** location. Also I was told that once I turned it is they would tell me the remaining balance to pay off once they auction it off. That never happened. The FULL remaining balance is still showing up on my credit report. They scammed me and they know it. They are one of these ***** businesses that lease people a vehicle and as soon as they are late on one payment they instantly repo the vehicle and lease it out again. My credit is ruined, I went out of business, and they love every minute of it ***********************************************. They need to get this off my personal credit NOW.

      Business Response /* (1000, 5, 2022/03/28) */ Mr. ******* leased a truck from Lone Mountain several years ago and after a few months of having the truck he fell behind on payments. We don't have all of the notes from that time because it happened so long ago, but since it looks like he did drop the truck off at our location we are willing to agree with him and just write off the balance and remove the trade line from his credit. I am glad Lone Mountain has agreed to have the entire balance removed from my credit. Lone Mountain needs to handle this swiftly or this complaint will be reopened. The complete removal of this from all the credit agencies is all I am asking for and as long as Lone Mountain follows through with what they agreed too in their response there will be no further issue. I will be monitoring this situation to make sure this is followed through to completion.
