On 09/17/21 I went to purchase a car from E&P Rodz Auto Sales in ************, **. I found a car I liked(2014 Audi A3) and put $3,150 cash down payment and also a 2010 Kia ****** This was valued at $5,850 from the dealership. I was told that a sensor needed to be replaced to fixed the misfire. I was told this would be completed in a weeks time. I was never contacted about the Audi being ready for pickup so I contacted the dealership ~a week later. I was then told it was another issue with the Audi and it would need repaired. Another week went by and I was never contacted by the business. I had to constantly contact the business to try to get the car that I made a down payment for, as well as left my trade in with the business. It has been 3 months later now, and I tried to get my down payment and trade in back. I was told that it would be another 2 weeks to get it repaired, or they would give me half of my cash down payment back and that is it. I contacted my local police department and they informed me that they have heard of the same issue from multiple people with this business. They advised me to take them to civil court to resolve the issue.Business response

I was surprised to hear that ****** filed a complaint about us since I had spoken to him on 12/14/2021. ON 9/17/21 Xaria ***************** and her boyfriend or husband came in and wanted to purchase a vehicle. *********************** did not like any of the other vehicles but the 2014 Audi A-4. We made her aware that the vehicle had a misfire and it needed some work on it. She had a 2010 *** ***** that she traded in and she agreed that she would continue to drive that 2010 *** until the 2014 Audi was fixed. She was aware that there were a lot of cars that were being worked on and that it may take time to fix the vehicle, at which she agreed. Three weeks later the car had the sparks plugs and the coil pack replaced. A couple days later we spoke to Xaria and let her know that the vehicle was still misfiring and that it was going to take more time to look at and then we would determine what the problem was, and was told also that she would not make a payment on the vehicle until she had the car with her nad running. Xaria said that it was fine. In mid November Xaria called and said that she was going on vacation and that she would contact us when she would return. Xaria Contacted us in the beginning of December which she was told that it was the heads and that we would take the heads out and send them to get worked on. We called ArnoldsMotorsto get the heads repaired and they told us at that point that they were backed up and that they only had two guys that work on those and that one was on vacation. Xaria came in and she was told what the situation was. She wanted to breach the contract at that point she was told what the policy was which , and that meant that 50% of her down would be returned , but we did not want the customer to be disappointed we said that we would return 80% of the down and she said that she would go home and her and her husband would then talk about it and get back to us. Later we found out that they had bought another vehicle and they had no plans of wanting the car anymore. We spoke to Xaria and we have agreed that we are returning most of their down payment. She agreed to it and she said that she was happy with the decision. So according to the customer ************************* said that he did not want to report to us that it was his boss who did it without his permission. We have now resolved the situation according to us and the customer. Please let me know if there is anything else that we need to do.
