We (my wife, ******, and I) entered into a contract with Kieffer Design Group (KDG) in February , ********************************* conjunction with a proposed new build (house) in *****, *****. After months of delays in permitting, projected shortages of key building materials and escalating costs, we decided to terminate the project in May, 2022. While we did not break ground on the new construction, we obtained a permit for our architectural plans, removed the previously existing structure on the lot and readied it for construction. It is now a vacant lot. To initiate the contract, KDG requested a $4000 retainer, which was provided. In addition, we were provided services from KDG in the amount of approximately $1900. These monies were billed separately and not offset vis-a-vis the retainer. These monies were paid. Upon contract termination, we requested a refund of the $4000 retainer. KDG (Ms. *********************** replied that during the course of delays in the project that she had turned down other business and therefore she was entitled to keep the retainer. This is despite the fact that the contract (attached) does not provide any such contingency. Our desired resolution is the refund of our retainer.Customer response
