On or about 5/2021 ******************* began building a home for me at *********************************************************************. By ******, 2022, *** approached me requesting another $80,000 draw, making a total of nearly $375,000 paid. We were 16 months into the project and it was about half completed. At this time he signed a letter stating the job would be complete by 10/31/22 or he would relinquish any claim on profits from the sale of the house. I further asked that if he were not totally done, he have all materials with paid invoices on site by the end of October. On 11/1/22 my husband and I met with *** because the house was in essentially the same state of completion with no materials or paid invoices. I asked if the following had been paid for/ordered: ************** , Light Fixtures , Plumbing fixtures (some), Fireplace , HVAC , 5 Exterior Doors, Garage Doors (ordered-not paid), Cabinet install, Door hardware, Shower door, backsplash tile, shower pan, Counter tops, Insulation in crawl space, Appliances, Grading/Landscape, Painting, Carpet, exterior driveway, Power to the house (ordered-not paid). None had been paid for. I hired another contractor to complete the project and my additional out-of-pocket expense was $175,000. I asked if he had any of my money left, he said yes. None has been refunded. Because of his neglect, we missed the prime selling market. The home was put on market 2/27/23 without landscaping for $619,000. Landscaping was added in May, and a price reduction to $579 on 6/5/23 without an offer or sale. I have talked with other clients of **************** who have reached out to me with the same complaint. It appears he enjoys older buyers who do not use bank loans from whom he can secure direct draws. He likes to be paid as both General and sub contractor and use his personal spray foam insulation business. He frames, roofs, installs windows and essentially dries-in the project. Things stall when he has to hire subs because the double dipping stops.
