***************************, operating as Lash Girl Academy, peddles fake postsecondary/vocational education certificates operating out of ********** at the time I met her while I was a student at ************************* Academy in Coeur d'Alene, ID. Her dealings with me, and likely others, involve coercing individuals into signing non-legally binding contracts. (I had an attorney review the documents I signed and she confirmed that the aren't legally binding.) Regarding her deceptive practices,********* knowingly shifted her business operations from ********** to ***** to evade regulations and exploit vulnerable individuals because when I met her, she was boasting and advertising Idaho's licensure requirements in an attempt to my own knowledge and belief, to circumvent Sections 7362-7395.2 of the California Business and Professions Code. She was running a scam operation in ***** hiding behind her business license in ********** until she registered this business on 4/18/2024 registering at an address of a legitimate business owner to attempt to legitimize her fraudulent program. This conclusion is supported by my three-month defense against her fraudulent debt collection attempts, centered on a contract that was neither valid nor legally binding. Despite her persistent efforts, all attempts were unsuccessful. It became apparent that she sought legitimacy by obtaining a business license with a legitimate business address. This strategic move suggests she became aware of the necessity to legitimize her operations after understanding my defense to her fraudulent practices. She leverages payment options like Afterpay and Shopify to induce consumers into signing contracts with "commit now, pay later" terms, shifting liability to third-party sources. Additionally, the exorbitant cost of her program, lacking legitimacy or accreditations, is unconscionable. This scheme exploits a loophole by utilizing third-party buy-now-pay-later applications and exploiting Idaho's lax licensing requirements.

      Business response

      05/13/2024

      Dear BBB
We are writing in response to the complaint filed by ******************************* regarding her alleged dealings with our company, Lash Girl Academy. We appreciate the opportunity to address her concerns and provide clarity on the situation.

First and foremost, we want to emphasize that ************************* claims are entirely without merit and appear to be a retaliatory action stemming from her own financial obligations and legal matters. It has come to our attention that ********************* is currently in collections for her contractual obligations with our academy. Furthermore, *************************** has obtained a protection order against her sister, ***************************** (also known as ******), due to certain threatening behavior towards her and the business Lash Girl Academy . Please refer to Protection Order Case (*****) # CV28-24-0859 + Police Case # *******.

In ************************* written complaint she states she does not have a contract with Lash Girl Academy, contrary she does indeed have a valid contract with Lash Girl Academy, which is currently in default. Her attempt to disavow any contractual relationship with us is baseless and does not absolve her of her responsibilities under said contract. Please see attached legal collection letter from an attorney in regards to Ms. ********* contract.

It is evident that *********************, along with her sister, is engaged in a malicious campaign against our academy. They have resorted to filing false and frivolous complaints in an attempt to coerce us into resolving ************************* financial and contractual obligations outside of the appropriate legal channels.

Please be advised that we are actively pursuing legal representation to address these spurious claims and protect the interests of Lash Girl Academy. We will not tolerate any attempts to intimidate or manipulate us into taking actions that are not in accordance with our policies and procedures.

We request that this complaint be dismissed, as it lacks any substantive basis and is clearly part of a broader scheme to harass and defame Lash Girl Academy.
Thank you for your attention to this matter. Should you require any further information or clarification, please do not hesitate to contact us.

      Sincerely,
      Lash Girl Academy

      Customer response

      05/15/2024

I am rejecting this response because:

Regarding the statement made by this business that "********************* is currently in collections for her contractual obligations with our academy," I must clarify that this is a material misrepresentation. *************************** filed a small claims suit in *************, to which I responded and unequivocally substantiated that no contract was existed. Upon receiving service of this request for Order, *************************** realized the lack of substantiation for her claims and promptly filed a Request for Dismissal. Subsequently, she attempted to engage a debt collection agency to collect on the fraudulent claim. Please refer to the " ***105 REQUEST FOR COURT ORDER AND ANSWER, " SC Details and ************************** for further investigation and consideration.

As for ******************************* assertion that she "obtained a protection order against her sister, ***************************** (also known as ******)," this is again another material lie from *************************** and attempt to defraud and extort another system meant to protect citizens and consumers. She filed a temporary protective order, falsely claiming that my sister "used a weapon to threaten her," despite my sister being in a different state at the time. This action constituted a felony attempt to obtain a protection order under false pretenses. No protective order was granted due to lack of evidence. Furthermore, ***************************** baseless allegations have no bearing on her fraudulent attempts to collect on a non-existent debt against me. Please see "PO."

Regarding ******************************* claim that "************************* written complaint" states she does not have a contract with Lash Girl Academy, this is again, a material untruth. I spoke to the attorney who drafted and served the demand letters, and it was confirmed that *************************** employed a monthly legal service to send demand letters to collect on said fraudulent debt. The attorney was provided with evidence that proved the absence of a valid contract or debt, and never represented *************************** as a client. If you review the timeline of the demand letters with subsequent attempts extorting several other agencies and means, it will reveal the desperate and criminal attempts *************************** made to coerce payment of a fake debt.

It is imperative that you thoroughly review all provided documents, understand the timeline of ******************************* criminal behavior and extortion attempts, and take immediate action.

      Sincerely,

      *******************************
