      I purchased a property in **************** for $130,000 back in April 2021. Of which I gave $100,000 down payment leaving a balance of $30,000 which the owner agreed to finance, and current balance is about $15,000. The financing went through Amerititle based in *************. Apparently the loan had a balloon payment that I missed, but when I called them in March because I received multiple payment coupons with $227 (when my payment was regularly $500). When I asked why I received these the person who answered just told me to continue making my payments which I have and have never been returned/rejected by AmeriTitle. Now I get a notification that my property will be going into foreclosure and That I owed a 5% penalty for not paying off loan on time. Is this the way AmeriTitle scams people out of money and takes away their property!!! I called to see if they would remove the 5% penalty as they failed to provide with accurate information when I called, per Lincy there is nothing wrong with what they did and they don't reject any payments received unless account is closed. Well if you sent the loan to an attorney, basically the account is now closed with AmeriTitle so why are they continuing to take my payments???

      Amerititle's Long ************************* received signed instructions between the parties in order to service said account, they were received and accepted on April 20, 2021.


      The buyer signed to a Promissory Note and Trust Deed on April 5, 2021.  The terms of the Note and Trust Deed state that the loan is all due and payable by April 24, 2024.  The Note also states there will be a 5% late payment penalty should payment be received 15 days after the due date.


      The complaint in question, is that the client was not aware that payment in full was due by April 24, 2024.  The attorney representing the lender's interest, contacted the client via certified mail with a letter stating payment in full is due and that they would be imposing the 5% late penalty on the balance owing.  If payment in full was not received by 11:59pm on May 31, 2024, his client would seek foreclosure on the Note and Trust Deed, not Amerititle.  The 5% penalty was enforced by the lender's attorney, not Amerititle.


      The payment coupons that were made reference to, are sent out at the beginning of each new year on all accounts serviced by ********************.  Her payment coupons would reflect the amount of the monthly payments due, which were her monthly P&I payment of $222.00, plus the $5.00 disbursement fee per the signed agreement.  She chose to make $500 monthly payments through ACH withdrawal from her ********** account.  In October 2023, she was put on certified funds required as she had 2 NSF's on her withdrawals from her bank account.  ******************** had to front those NSF's payments and had to wait for reimbursements to be made by the client.


      Amerititle is a neutral third party, not a lender, we process the payments received in accordance to the parties instructions.  I have attached documentation of the signed Long Term Servicing Agreement, Note, Trust Deed, attorney letter, payoff and the account print out, the client has paid in full as of May 29, 2024.

      This is a complaint with the AmeriTitle based in ************, **. Their agent told me a time in which to send a wire and the information was in fact wrong. They have similarly displayed incompetence in drafting paperwork and searching title.
