      On Feb 9, 2024 I reviewed and signed a contract with Over The Top Concrete to have concrete done in my backyard. The estimate was $7850. They were supposed to start March 4, 2024. On March 13, 2024 I was told they could begin on Monday March 18, 2024. I agreed and they had dirt delivered March 18th. On March 21st an employee sat in front of our house for about an hour until the owner showed up. The employee wheeled a small amount of dirt back and left (with no communication I might add). On Friday March 22nd Shilo (owner) and his team were here doing the dirt , and framing. Then ***** stated hed start pouring Monday March 25th. At 8am on March 25th ***** stated he was grabbing a few things then headed our way. At 9:13am when I messaged to check in Shilo told me that concrete was running a few hours behind and that it'd be about 1:30pm before they could get here. At 1:30pm **** (my husband) checked in and ***** still had no ETA. ***** then told **** that hed be here March 26th at 9am. ***** came on Tuesday with 1 truck. On Tuesday afternoon, ***** verbally told us hed be here Thursday March 28th to finish the job, as my husband **** texted Shilo on Monday March 25th to let him know we had other jobs scheduled to have done per Shilos word that concrete was gonna be done Monday March 25th. On Friday March 22nd we paid the balance of the job in full for the amount of $7850. This has been an inconvenience to my family and my dogs as well. I gave ***** till Monday April 1st to finish the job or refund me the money, if the job was not done or a refund not made I would pursue other actions. He came and finished the job on April 1st however left a mess in my backyard. I have been trying to get him back here since April 1st to clean up the nails and concrete and put my rocks back where they belong. Its just excuse after excuse.

      On top of this job not being done in a timely manner, it was also done very poorly. They (Over The Top Concrete) took off the spout for the gutter (the one that directs rain water away from the house) and never put it back on, they did not clean up their nails, which is irritating as I have kids and dogs. They did not clean up the concrete that spilled out and looks like a mess, they moved the rocks in my fire pit and never put them back. My husband was concerned about them making sure they capped all sprinkler heads. Today we turned on our water and at the very least 2 sprinkler heads were/are missed causing water to eat at the dirt. We now have dirt coming out of the corner and falling out. ***** (Owner) claims he spoke to my husband about the sprinklers and how he would need to cut the lines, ***** in fact did NOT speak to my husband about that, because if ***** did, my husband would have asked him to cut the lines or re-rout the lines to prevent them not capping the sprinkler heads. My husband was extremely concerned about the sprinklers. On another note, I asked for the concrete to be the same length on both sides of my fire pit. Plans were changed, ***** states he spoke to my husband about this but again he did NOT as the plans would not have been made by my husband without my consent. I have a video showing how he left my back yard. ***** pushed out a section that was not discussed thus cutting into my fire pit. I am unhappy with the lack of communication by *****, the lack of discussing plans with both home owners, the lack of cleaning up after himself as well as not properly capping all lines. You can also see where they decided to wash out their wheel ****** and leave the concrete in the rocks. ***** blamed the weather for weeks however I have proof of weather for the month of March.I am requesting a refund in the amount of $3,925

      The job was completed over a month ago. There was some miscommunication between the husband and wife on what the husband and I talked about. The job is poured , everything cleaned up and I even brought in extra rock which I paid for to put around the firepit and edges of concrete which was not my job to begin with. This complaint was done premature cause of miscommunication. Yes the job took longer then expected but we can control weather or other acts beyond our control.

      I am rejecting this response because:

      I contacted Shilo on April 25th @ 4:48 pm regarding the fact that there was not a capped sprinkler and I have water coming up from the concrete. I have tried to work with ***** multiple times. He claims my husband told him where all the sprinklers were, however my husband did NOT put in our sprinkler system. In the contract both Shilo and I signed it states he would cap or re-route and sprinklers. He did not cap all my sprinklers I found 3 that were not capped. ***** stated hed be here the week of April 29th and a lot of my messages go unanswered. Its now May 3rd and he never came. He stated that IF he did anything hed only pay for 1/2 the cost of the sprinklers being re-routed. Yet in our contract he puts he would re-route or cap ALL. He is in violation of his contract. However, if I was the one who was in violation of our contract and I didnt pay him this would be a whole different situation. My grass is dying, my tree is dying and my berries are dying. This is unacceptable and not good business. I will never recommend this company to any person.

      Can we hold off sending anything to Over The Top Concrete about what I just submitted earlier tonight? He finally contacted me and I'm giving him till Tuesday to come over and cap the last sprinkler head to complete this job.

      We hired Over The Top Concrete to do some concrete work at our residence which we received an invoice for on 02/06/2023 (see uploaded document) and had the work started mid February. The first pour of concrete was poured and we agreed to make 3 separate payments: 1st payment of $6,200 was paid upfront in cash prior to the 1st pour 2nd payment of $4,650 was paid in cash after the 1st pour after 70% of the job was to be completed but only 40% was done and not to our satisfaction as the stairs that were poured were not equal risers and bulging out and the concrete slab has water puddles (see uploaded photos)3rd payment of $4,650 was to be paid after the final pour which was not paid for.After several months of the concrete work not being completed and multiple promises of it being completed we decided to hire another contractor to redo the stairs which costed ** an additional $3,000 and complete the job that was started but not completed. We overpaid Over The Top Concrete more than the amount of work that was completed and are asking to be reimbursed for the 2nd payment of $4,650 and $3,000 that costed ** to have the stairs redone for a total 0f $7,650.00

      Yes we contracted to do the work but we had terrible weather with snow and rain for a couple months so we waited on pouring. The face of the stairs are different size and that was explained to the homeowner as he was there when we poured and finished them and he was ok with them. This complaint is coming from the brother and not the homeowner himself. Again they were both there the whole time we were working and oked everything along the way. I do agree that a partial refund is due but definitely not in the amount they are asking. We had done all the prep work as far as removing the grass and bringing in road base, corex pipe and rebar. I also was never given back my lumber, stakes and rebar cutter. Ill agree to a partial refund to resolve this matter. But the quality of work was great and again approved as the homeowner was there and even paid for the steps after they were poured,
