On 5/13/2022 . I accepted a proposal to have some drywall repair done at my home. I submitted a prepayment in the amount of $1400 on 5/16 which was cashed on 5/31. A target date was set for 5/31 to begin work. On 5/31 the start was deferred by the vendor due to personal reasons. A new target was set for 6/6 which moved to 6/7 and was ultimately deferred again on 6/7 due to health concerns on the part of the vendor. I cancelled the proposal on 6/7 due to all of the delays and requested a refund of my prepayment. As there is no verbiage on the proposal that any money prepaid is not refundable, we negotiated and agreed on 6/14 to a reduction of my refund to $1100 in order to account for the vendor's monies spent on materials and his time gathering them. Throughout the months of July and August I have made periodic status checks via text messages that a check be mailed to me. I received some messages back stating he was awaiting monies from other jobs and then would refund my $1100. Communications have been poor from him recently, sometimes going weeks without a response to my texts. Today, 8/30 I was able to reach him by phone. I asked for an update and he again gave me the same excuse of waiting for other job monies to come in and promptly hung-up on me. I have all of the text messages retained and I'm asking him to return the $1100.
