      Purchased a home from Tresidio in May 2022. Our home (In master planned development) was not graded properly on both the West side and North side. Numerous requests have been make to properly fix the situation, but nothing is being done. The West side of the property sits on a hill next to another lot that is a much lower elevation. Our property has been eroding down into the adjacent lot. Not only is our landscaping eroding down into the next lot but our fence foundation and the fence itself have been eroding/falling into the next lot. The fence will shortly fall from the erosion. The fence contractor who came to look at the falling fence stated that if he resets the fence posts, it will accelerate the erosion and worsen the problem. He as also contacted Tresidio homes to explain this. Still nothing has been done. This is not to code and should be rectified.The North side of the property was graded way too steeply. It unsafe, unusable, not to code, and unmanageable. Not only is the grade too steep, but it was landscaped with small rocks that create a slide. I have fell numerous times attempting to walk on that side of the house. The rocks continue to erode down this grade and are being held in place by a thin plastic fence. This fence was not designed as a retention barrier and is beginning to bow outward from the weight of the rocks. It is only a manner of time before this fence falls under the weight off excessive rock.We have made numerous requests for repairs and nothing is being done. All that is needed is for the home builder Tresidio to fix these issues properly in a manner that will sustain.

      Our understanding of the situation is as follows. We entered into a contract to sell this home to you in March of 2022. At the time, the home was partially complete (cabinets were installed inside and the stucco was in process on the exterior). The rear fence was already installed by the neighboring home builder and the grading was complete in both the rear of the home and the side yard. The contract did not contain any request for the right side yard to be graded differently. The backyard was already pretty flat as shown in your photo.

      In this community, and others with similarly sloping lots, it is customary for the lower property to put in retaining walls as needed so that the fence can be on the property line and the retaining wall can be on the lower side. The primary purpose of the retaining wall is to allow the lower home to slope their grading away from the foundation and prevent runoff from above. As such, it isnt typical to have retaining between a house and the common area. Because your lot is lower than your neighbor to the left (looking from the street), we installed a retaining wall on that side. Because your lot is higher than your rear neighbor and the common area to the right, we didnt and wouldnt put in retaining walls on your side of the fence/property line. The neighboring builder and homeowner to the rear will ultimately be responsible for installing the retaining wall on their lot and for ensuring that the fence doesnt erode down the hill into their yard.

      We received your warranty claim regarding this issue in June and worked with you since that time to try to come up with a solution that is satisfactory. In August we came to an agreement with you to put in a two-block high retaining wall inside your fence line on the right-hand side and regrade the right side to be flatter. We also agreed to put in one row of retaining block in the rear to stop any erosion that *** be happening from your side because of the poor grading and lack of retaining wall on your rear neighbors property. We felt this offer was generous since the side slope is within tolerance and because we cannot install retaining walls on property we do not own or control. The rear fence collapsing will ultimately be up to your rear neighbor to correct since their slope is not controlled properly.

      When our landscaper showed up onsite with the retaining wall block material on September 12th, you sent them away saying that you were no longer okay with the solution. While we were trying to work with you to come up with something else you would be happy with,the Sheriff called and asked us to remove the material from the street, which weve done. We are in the process of getting bids to remove the fence on the right side, put a retaining wall on the property line, and then put a new fence at the top of the retaining wall about a foot inside the property line. Weve communicated with you that we are working on that process. We apologize that it isnt happening as quickly as you would like. Once we receive the bids, were planning to share them with you to see if you would like to participate in paying for your preferred solution or if you would like to stick with the original solution proposed.

      We understand your frustration with the grading situation, but we do feel that the grading was existing when you made your offer to purchase the home. We also want to reiterate that we arent able to perform grading work or put retaining walls on property that isnt yours or ours (your back neighbors property, and the side common area).We are committed to helping where we can (even though we didnt install your back fence), and if we need to put larger rock in your side yard because the smaller rock is sliding, we are certainly happy to do that as well.

      We truly strive to have happy homeowners and are willing to go above and beyond what our warranty states and what most builders would do. We will continue to communicate with you as we work to find solutions.

        I am rejecting this response because: First of all, when the walk through was done, the yard was completely dug up.  There was no fencing, and it was impossible to tell what the yard was going to look like.  At closing, the yard was still not complete.  When we arrived, we saw how unsafe the side yard (north) was because of the steep grade and loose gravel.  We also observed that our backyard was eroding and knew that our back fence would fall if this wasnt addressed.  We were told that the developer of the neighborhood was supposed to have put in a retaining wall along the west side of the property (back fence).  We were told by different contractors that this did not happen simply because they ran out of bricks. We were also informed that Tresidio agreed to this deviation of original plans. This is unacceptable because all home builders in this neighborhood and the developer were aware that the yard needed a retention wall. In fact, the South fence was originally built without a retention wall until it completely fell over. That fence was removed and the retention wall had to be built before the fence was put back. 

      Second, we were never told what Tresidio was planning(in regards to a fix) with the side yard(north) until the landscaper came and informed us they were going to put in a small wall on the inside of our fencing.  We informed Tresidio this was not an appropriate remedy and would cause us further problems.  As far as the West(Back) fencing, no one at Tresidio has ever informed us of ANY proposed fix. I am asking that Tresidio do the appropriate work that should have been done from the very beginning.

       
      The property grading is not done appropriately, and not to building code, and not to original design. I would hope that Tresidio would want to do the right thing for their customers before and after the sale. It should not take calls to the BBB, the registrar of contractors, and ultimately a construction attorney to remedy the situation.

      I filed a complaint with the BBB about the improper grading of my new home build. The problem was never resolved, BBB never contacted me and assumed the issue resolved, IT IS NOT RESOLVED. BBB do not close the case when you do not notify my of any required response. complaint #********. is NOT RESOLVED!

      I am truly baffled by this email and have no idea what BBB is asking for? The original complaint was clear and concise, not sure what you are asking for?
