Entered into an agreement 8/18/23 for installing landscaping and a concrete patio at my home in the amount of $13,216.94. Deposit of $3,965.08 was made 8/18/23. Work began at my home 9/18/23. An invoice amount of $3,965.08 was paid 9/19/23. I received a text from the landscaper 9/22/23 stating there had been a mistake in the original quote amount and that it would cost an additional $3,327.24 to complete the project. In subsequent text messages three options were provided by the landscaper, none of which included finishing the project for the originally quoted amount. These options were rejected and I presented an option of finishing the project as originally quoted for an additional $1,000, not $3,327.24, which seems more than reasonable since none of this is a fault of mine. The landscaper rejected the option and has now refused to complete the project. I am left with a complete mess - torn up landscaping, non-working irrigation system, unfinished concrete patio, piles of debris in the road, etc.Business response

We encountered an unexpected anomaly in our original estimate that made it impossible for Green Edge to complete a portion of the project as initially planned. We sincerely apologized to the homeowner for this inconvenience and would like to meet in person to discuss a path forward. The homeowner refused.
In our effort to address this situation, we presented three potential solutions:
1. Pay an additional $3,327.24 to complete the project as originally designed (Green Edge cost, no profit).
2. Opt to cancel the project; in such a case, Green Edge would not charge him for any work that had been done on the work we could not complete.
3. Collaborate to redesign the project to better fit your budget.
Unfortunately, the homeowner declined all three options.Consequently, we offered to return ************* to its original state at no cost to the homeowner since we could not complete that specific portion of the project. Regrettably, he also declined this offer.
Additionally, he informed me that we were no longer permitted on his property unless the work was completed as initially discussed.
I emphasized to the homeowner that two crucial aspects of the project, irrigation connection, and fencing, remained incomplete and that it is in the best interest of all parties to address these issues promptly.
To ensure a satisfactory resolution, we arrived at his residence on Tuesday, September 26, 2023, first thing in the morning. Our objective is to complete the cleanup, finalize the irrigation, and reinstall the fence as discussed.
I would like to reiterate that the homeowner was not charged for any work that could not be accomplished.Customer response

I am rejecting this response because the scope of the original agreement has not been completed and the business owner has not been able to identify anywhere in our signed agreement where the business owner is allowed to change the cost of the project when there is no change in scope (see attached correspondence). Also, the options presented by the business owner are not in good-faith as they leave me with either an incomplete project or having to cover the full cost for a mistake that was not mine. I offered to pay an additional $1,000, which is absolutely reasonable and generous, and was promptly rejected by the business owner.Additionally, I asked that nothing more be done on my property unless it was to complete the original scope, to reinstall the fence and gate, and/or to fix the sprinkling system and grass (see attached correspondence). The business owner picks and chooses what he submits.
The bottom line is our contract has not been adhered to (breach of contract) and the business owner has left me with an incomplete project and taken no responsibility at all.
Sincerely,

Since our last correspondence the business owner has cancelled our contract and left the job unfinished. To finish the job, I now have to solicit additional bids and we are now running up against cold weather, which will cost more for concrete. In addition, the aggregate base placed and compacted by Green Edge will need to be removed and replaced as no new concrete contractor will warranty their concrete unless the base is prepped by them. Yet another reason Green Edge has absolutely dropped the ball.
Finally, Green Edge was asked several times to identify the provision in their contract where Green Edge is allowed to change the cost of a project without a change in scope. Green Edge chose not respond to any of these inquiries.
**** is a nice enough guy, but he is a sweet-talker. When it comes down to it he is not a man of his word and is unwilling to take accountability for his mistakes. I would not recommend Green Edge to anyone. In fact, I had recommended them to a few folks and have since had to rescind those recommendations. **** has already lost out on additional business as a result of this.
