I went into this business to see if they would be able to install new tires onto my 2012 Ducati, Italian Superbike on Thursday the 4th of May 2023. I was told it would be no problem by the owner of the business who I know as *****. He then went onto his computer and began to look up prices for a quote. He then ordered 2 new ******** tires for my motorcycle, without asking me for any type of deposit or payment at that time. I work for a local delivery service and I actually delivered the tires to his shop myself when they arrived the next day. On Tuesday the 9th of May 2023 I then delivered my Ducati to his shop in the back of my personal sprinter van. I specifically remember that in order to unlock the handlebars on my bike, I had to put the key into the ignition, which I did. I then started my bike and drove it down the ramps, out of my van, and into the parking lot of Sport Motors, where ****************** took delivery of my bike into his custody. I then shut off the bike by turning the key into the off position and I left it inside the ignition, specifically knowing they would need it to work on it. I then went inside, filled out and signed a work order for my bike, also writing down the other issues I wanted them to fix, aka a leak in my lower radiator, and a missing spring on my kick stand. Over the next several weeks I would go to the business on multiple occasions enquiring on the status of my bike and was mostly told they were waiting for parts. After the first part of June I was told they had all the parts and were waiting for the mechanic to get thru their other projects until he was finally able to work on mine. Finally, on Thursday the 22nd of June I was told by ***** that it would be done by the end of the following day, and when it wasn't, we told them we wanted the the bike back. They then returned it back to us with no key and said they didn't know where it was at. That was my only key and the dealer in SLC says it'll be $2,350 to replace.Business response

Customer brought in his machine in a van. Not ridden in. The machine was put inside our locked compound and if the key was in the ignition it would have been there the entire time. We never heard the machine run and the only person that we could see in the compound around the machine on security was the customer. The customer said that he came in and started the machine while it was in our compound. Why would he do this is beyond our understanding. No one in the dealership ever recall seeing the key in the machine and we do not remove keys from their ignitions when they are in our locked compound. This looks like a customer who is looking for us to pay for a key that he has lost. These are specialty keys and not one that would be used in any other machines in our inventory or possession. It is very uncommon for a customer to bring a machine in for tires other than riding it in. I do know that the machine had enough tread on the tires to be ridden and the only reason that we could come up with that it was brought in by van was the customer was not able to ride it do to no key for ignition. It is also strange that a customer would not have a spare key made at some point to avoid any situation like this.Customer response

I am rejecting this response because: That response insults my intelligence and it is beyond my comprehension that they would think that! I have literally over a dozen very credible people that will vouch for the fact that I have never been without the key to my Ducati The reason I didn't drive the bike in is because the Ducati Dealership in *********, where I had the bike serviced back in March of this year, recommend that I do not drive the bike with the current tire condition for the fact that they are both lacking safe tread and also are mis matching with the front one being a ******** and the back one being a Michelin. The bike also is has a leak in the radiator as well as the side stand spring being broken which doesn't allow it to stay up, in the riding position, both of which I wrote down on the work order for them to fix and is also another reason the dealership said not to ride it. As for me saying I started it in the their compound is total nonsense which I never said! I told him that I started it in the back of my van when I was dropping it off, right after I used the key to unlock the handlerbars, before I rolled it out and into his possession. The only reason I was on his camera system is for all of the times over the 6 plus weeks he had my bike that I stopped there after hours to look thru his fence at my bike to see if they had done their job and fixed it yet! I also asked them on numerous occasions to please get my bike out of the weather or possibly even cover it up to protect it from the multiple hail and rain storms that it sat outside thru the whole time they had it. Yet I was told every time by ***** the owner that it was fine and wouldn't hurt it, even though it's never been thru a single storm the whole time I've owned it! Finally as for the reason I've never had a spare key made is because I am very competent and would never misplace the key to my super bike. If they won't compensate me for my losses I will just have to take them to small claims court!
Sincerely,
