      I bought a car from Jaram, it was broken down and in the shop more then it was on the road, **************** issues. I've sunk thousands of dollars into this vehicle trying to get it running but it is toast now. I had paid around 800 dollars in advance in car payments and when I had the vehicle brought back to the lot I asked for the money back I paid in advance for car payments and he refused to give me my money back. I should not have to still pay for a car that won't run and a car that I don't even have anymore. All I want is the money I paid in advance for car payments.

      I have been the owner and operator of Creekside Auto Sales for over 17 years. I offer in house financing, through myself as the lender, to customers who require that to obtain a vehicle. I have sold *********************** multiple cars and considered him a great customer and friend. He purchased the **** Kia ******* on 3-1-23. He made a down payment, and contractually agreed to 21 additional monthly payments. The vehicle was test driven by **************** before he purchased it, and an "AS-IS, NO WARRANTY" document was signed by him. Creekside Auto Sales is a car lot. We are not a service station, or a mechanic shop open to the public. I do retain the services of mechanics that provide repairs  to vehicles (before they are sold, and prior to putting them into inventory or advertised) to make sure they are as safe, and as mechanically sound as possible. On occasion I have offered their services to customers who are in need of assistance with the direct communication and understanding that they are extremely busy, and while they are 1/3 the cost of actual repair shops, it could possibly take a very long time to provide any needed repairs to their vehicle. 

      *************** was excellent at making his monthly payments, and because my interest rate is prorated for early payoff, he actually was 2-3 monthly payments ahead of schedule. ***** requested a couple of minor repairs (A leaky coolant overflow tank, and a front wheel Hub and Bearing replacement) and I went out of my way to assist him with those as quickly as possible. It was certainly still a week or so wait to get it in, as the mechanics are very busy doing there actual responsibilities, and rarely have time for extra work. The repairs were made, and parts were replaced. ***** noticed a CV axle boot that was leaking grease and told me about it. I told him that it would be a week or so until we could look at it, and that was the last I heard or saw him. 

      I came into the office the morning of 5-22-23 and his car was parked in front of my lot with his plates off. I never talked to him, or saw him drop it off in any way. I texted him, and told him I would attempt to repair it as soon as possible, and he replied that he was done with it, and that it was a voluntary repossession. I told him that he was still responsible for the loan he signed for, minus any money that the vehicle got at the auction when I sold it. I asked him about the complaint to the BBB and he said that he never made one, but possibly his son did. I told him that I was surprised that the complaint wasn't truthful, and he stated again that it was his son that made it, without his knowledge. He stated he still did not want the car, and I could sell it at auction. 

      Two weeks later, ***** called my cell,  and asked me about refunding him his advance monthly payments, I told him that after the car was sold at auction, the balance owed would be deducted by the monies earned on the car and he could possibly be refunded, or charged any difference. I advised him that as he was ahead on pmts, he could certainly just come and get his car back, and drive it until he wanted not to. With his pmts being current, I told him it was his car, and he could just come get it. I assured him the vehicle was still in his name, and his name was still on the title with Creekside as a lienholder still. He asked me if I could repair the vehicle for him before he came to reclaim it, and I said again that I could, but it would take some time. I asked again about the untruthful accusation to the BBB and he said he would talk to his son. As of now, the vehicle is on the side of the road near my lot, waiting for my mechanics to  have time to replace a catalytic converter for him. He has texted me several times asking if it has been done in the past 4 days, and I told him that it has not, and It could possibly be done this Wed or Thursday. 

      Thats where we are at, and I am very disappointed and discouraged that I ever offered to assist him in the first place. ****** learned. No good deed goes unpunished. Thank you!
