I found Idaho Jewels Poodles website through an online search and found some cute puppies and got interested. I read through their Health guarantee and contract and it seemed doable so I contacted them, was approved for "Mater" and put a $500 deposit on him as required to hold him for me. This would go towards the purchase price of $1300.00 in total. I asked if they would be willing to meet for delivery of the puppy as I am 3.5 hours away in **** and they advised it would be a $300 delivery charge to meet in ***, ** or $175 to meet in *****, **. That was more than I was willing to spend so I declined and made the drive to *****. **. I was given the same contract via email and in paper form that was on the internet website. I noticed that I did not have the *** Limited registration application for the puppy as stated in the contract, page 1, paragraph 2. That states " OPTIONAL *** PACKAGE: The adoption price includes the *** registration application. In this optional *** package, Breeder has partnered with the ******************** to bundle these other valuable items for only $100."When I emailed the company asking about the application they stated they won't provide that until the puppy is neutered. I asked where in the contract that is stated and they confirmed it is not. ( I have email proof of the conversation.) I advised this is a breach of the contract and I would like to have the Limited registration papers as that is what I have paid for, or I would like to be reimbursed at 1/2 the purchase price as the contract has been breached and I was not in agreement to not receiving those papers. They concluded they will not send the registration papers, nor will they refund any amount of the $1300.00 purchase price and the only thing they kept bringing up was for me to take him back to them for a full refund. I advised we made a commitment to have him as our family member and I did not want to be bringing him back.Business response

We provided the limited AKC registration application papers to ***************************** via email on 3/27/22 and the original paper application was mailed to her physical address via certified mail on 3/28/22. ***************************** acknowledged receipt of the emailed papers on the morning of 3/28/22; therefore, the health guarantee and agreement has been completed by both parties and this complaint is satisfied.Customer response

I am rejecting this response because:although the application was submitted, it was not paid for as stipulated in the contract and only sent after I submitted this complaint. They offer the additional services with *** registration if you pay extra but are stating they wont pay for the registration just the paper to print the application. This is not what's in the agreement and the contract was breached. There's also a timeframe with these, it needs to be provided same day. As I've stated before, I am no longer interested in doing business with them and if half of the cost of the puppy is not refunded, I'll be going to small claims, where I will be asking for 75% as per the law for not fulfilling the *** paperwork.

**************** picked up the puppy referenced in the Agreement from us on Friday, 3/25/2022 at 4:10pm, as indicated by the signed receipt of the puppy and photo, both of which are attached. After supplying **************** with the *** registration application via email on 3/27/2022 at 3:37PM, she acknowledged receipt of the application and accepted our apology the next morning, 3/28/2022 at 8:02am. Those emails are attached for reference.
We also mailed the original *** registration application via certified mail to Ms. ******* address which she had supplied to us on the Agreement on Monday, 3/28/2022. A copy of that **** receipt is attached.
Following her email acknowledgment, **************** asked about the *** registration processing fee that the kennel club charges when registering a dog. We explained to her that the associated registration fee would be her responsibility as the new owner of the puppy. We, like most breeders, do not pre-pay for *** registration of any puppy; rather, we supply the *** registration application, as specifically indicated on the signed Agreement. We are attaching the Agreement with highlights on the 1st page for ease of reference of the language which is the subject of this complaint.There is no time limit stated in the Agreement, nor was there ever anything indicated either oral or written surrounding any deadline or timeframe within which the *** registration application would be provided to Buyer. **************** received the puppy on Saturday, 3/25/2022 at 4:10 pm. We emailed the application to **************** on Sunday, 3/27/2022 at 3:37PM, less than 48 hours after receiving the puppy. She acknowledged receipt of the *** registration application on Monday morning, 3/27/2022 at 8:02am.
We have fulfilled the terms of the Agreement in full, supplying the dog as described in the Agreement as well as the *** registration application as stated in the Agreement in an expeditious manner. **************** retains possession of the puppy; therefore, there are no grounds for further consideration.
