      I contacted Rodriguez Enterprises after they posted on a ************** about their business doing decks both remodels and new construction. I requested a bid to have the deck sanded down as it had been painted by the previous owners. The owner ******** and her husband came out to assess the job and provided a quote of $960 to sand down the deck so that we could stain it ourselves. They contacted me on 4/9/2023 to say that they would start the following morning and requested 50% ($480) up front. When they arrived the following morning, 4/10/2023 I had a check ready for them, which they cashed. After a day and a half, they claimed that the paint was too difficult to take off and that they would need to charge more to complete the job. They suggested that we tear down the deck and rebuild. They offered a quote to do so. We opted to go another direction and requested a refund of the deposit as they backed out on the contract. ******** said that they would only provide a partial refund (half the deposit) as they had to pay their employee for the work he did. I reminded her that was her responsibility not mine as she gave a quote that we accepted. If they underbid the project after seeing it first hand that was their responsibility not mine. She refused to send the refund.

      After talking with **** and discussing that we were no longer going to finish sanding the deck because it was impossible to take all the paint off and have it looking like new. We discussed the different options of tearing the deck apart and using the opposite side of the wood and the pieces we couldn't use we would buy new. We gave her and her boyfriend a bid for re-using the existing wood as well as buying new. She said she needed to think about it more and would let me know. It was a week after that she contacted me and said she was going a different way and wanted a full refund. I explained to her that I would give her half the refund because my employee worked 12 hours x $20 an hr equals $240. The deposit she gave ** was $480 so half would be $240. She refused half the refund and said she would take legal action. We did not have a signed contract.  The only agreement was a verbal agreement.
