      Hello Respected ********** ** (*************************, *********************) signed a contract on Thursday 6/30/22 with *****************************, Vice President of Fox Valley Construction and Remodeling **** (http://www.fvcrhome.com/) for home remodeling projects. It is a fixed fee contract with 50% paid deposit at the contract signing. The work started on Monday 7/11/22. Over the 7 weeks (until Thursday 8/25/22) we had multiple issues - Contractor's employees threatened me and my wife in our home(we called 911 but did not file a formal complaint), left work incomplete, damaged other rooms in the home, and have hardly finished 50% of agreed projects. On Thursday 8/25/22, we met and agreed with ****** about our intention to finish the in-progress projects and discontinue not-started projects from the contract. ** requested to provide the final accounting from the work completed and provide a refund from the 50% deposit, since the price for the work completed was lower than the deposit amount. ****** sent us the cost/price accounting on Monday 8/29/22. ** noticed multiple additional charges without any prior agreed price. The accounting did not acknowledge or include a refund for damages to the other part of the home. Therefore, we sent him our proposal to the revised cost/price accounting on Tuesday 8/30/22, and informed ****** that we should meet and get an agreement on the contract, cost/price accounting, and settle the refund while continuing the in-progress work. ****** did not acknowledge and sent his employees to work on **dnesday 8/31/22. However we did not let his employees come in the home and requested to talk through the agreement first. ****** sent the revised cost/price accounting on **dnesday 8/31/22. ** noticed multiple additional charges without any prior agreed price or Change Order, again. Since then we have reached out to ****** multiple times to resolve and get a refund for the work not completed and to repair damages his employees caused to the other part of the home.

      Subject: In response to the accounting received from Fox Valley Construction & Remodeling, *** on October 3, 2022

      We reviewed your accounting and in response amended the expected refund amount to $4,357.35.

      With this amended letter we are including the following for your reference.
      1.     Amended proposed accounting statement as of October 6, 2022
      2.     Inline comments to your accounting sent on October 3, 2022
      3.     The receipts for the cost we incurred, including material and labor, for the incomplete work in the second floor hall bath.

      Additionally, following are the factual reasons for our amended proposal.

      We do not accept your accounting for the toilets allowances overage because your failure to purchase the items timely despite we provided our selections and paid the deposit amount to purchase material.

      We do not accept your accounting for the additional work because of your failure to disclose the price upfront either orally or written prior to commencing the work. We are noting a violation of (815 ILCS 513/) ******** Home Repair and Remodeling Act. and (815 ILCS 505/) ******** Consumer Fraud and Deceptive Business Practices Act. However, we are offering to pay a fair market value for the work completed.

      We do not accept your accounting for the hallway side door and trim painting because you included the doors and trims painting in the contract signed on June 30, 2022.

      We demand you provide a refund of $4,357.35 immediately. Failure to do so will require us to pursue legal remedies. Your cooperation in this matter is appreciated.
