We hired Maximum Heating and Air Conditioning to install a new *** at one of our businesses. They came, did the work and were paid in full. We did not thoroughly inspect the job prior to payment due to it being on the roof and we trusted the owner ***** to do the job he was contracted to do. Since then we had a roof leak and the store was complaining that the ** was not maintaining the temperature that they had set on the thermostat. Once on the roof we discovered the installation for the *** was not done properly and is dangerous. We discovered that Maximum Heating and Air went against all manufacturer recommendations and stacked 2 curb adapters on top of each other. They then modified the unit by placing a rubber flap around the unit in an attempt to stop the lost airflow from stacking two curbs. This is why the new unit is not able to maintain a temperature in the store because air is being lost from this make shift apron or flap. Also, this makes the unit extremely unstable and suseptible to tipping which could cause serious property damage or injur or kill someone. I have attached pictures to show how wood was used in an attempt to link the two curbs together. I have attempted to contact Maximum Heating and Air and my phone calls, text messages and emails have gone unanswered. I would like Maximum Heating and Air to install the machine as recommended by the manufacturer.

Maximum was Hired to install Roof top units per Repair Pro, Repair pro Was to hire roofers to repair any Roof issues found on sites, including any Roof curbs, our job was to secure the curbs to existing, Repair pro Failed to pay roofer to repair jobs on different sites and Failed to Pay Maximum for repairs and installation on different sites, they are in collection now and In process of legal action till all outstanding invoices are due, this issue and repair is their responsibility to repair

I am rejecting this response because:

We are rejecting this response because it doesn't answer the complaint. The complaint is that Maximum Heating stacked two curb adapters on top of each other when they installed the **** In their answer they admit that they were hired to install the *** and they admit that repairs are needed, what they don't admit is who is responsible. Our question is, if repairs are needed who's responsibility is it to make them, the person that hired someone to install the *** or the person that was hired and paid to install the ***?

Attached you will see 3 opinions that it is NEVER recommended to put a new curb adapter on top of an old curb adapter when installing a new unit. Not only are there 3 opinions attached, we consulted with CDI an industry leader in curb adapters and they concur that it is never recommended. This is dangerous because stacking two curbs increases the weight of the unit on the roof, adds to the height of the unit and the gap which greatly increases the chances of the unit tipping in windy conditions, opens the duct to the outside and greatly decreases the efficiency of the unit due to a poor seal. The unit now has to work harder to maintain the set temperature because so much air is lost in the ridiculous fabricated apron or flap that was placed around the machine. This flap does not come from the manufacturer.

Additionally, attached there is also a receipt for the roofing repair that Repair Pro paid to Maximum Heating for this very installation. Maximum refers to multiple jobs in their answer, our complaint is for this one specific job and Repair Pro has no knowledge of mulitple outstanding invoices for repairs or roofing jobs or any legal action pending. It is Repair Pro's position that Maximum Heating's erroneous defamatory response is an attempt to deflect from the root issue of the complaint, the root issue being, they stacked a new curb on top of an old curb which is never recommended by any professional or manufacturer and this needs to be remedied and installed properly ASAP!

If Maximum Heating can provide written documentation from the MANUFACTURER or inspector that placing a new curb on top of an old curb and fabricating an apron around the two is standard installation procedure, Repair Pro will withdrawal this complaint. Again, we attempted to contact Maximum Heating directly about this situation but they have left all phone calls, text messages and emails unanswered.

      Sincerely,

      *******************

According to ** **** complaint they saying that original Curb should of being Replaced, I told them before hand that if they wanna replace new Curb Ductwork will need to be Modified since the layout of new unit is not same, they decided to go with Economic way to save Ez **** Money, we ordered from factory new curb that fits to new Unit, without having to do modification, ***** inspected the site and agreed prior of payment, to assure system was working and installed properly, We told him and ******* to get roofer to Secure and seal roof, they never did, you can see on the report that we address this issue to them and now 2yrs go by and now they are concern and expect us to be responsible, when we are no roofers and 2nd they didnt approve to have roof redone with new curb, they are 100% responsible for leaks ongoing for decline of not addressing the issue

      Complaint: 22023948

I am rejecting this response because: Once again Maximum Heating did not answer the complaint.

First, never ever were we told that a second curb would be placed upon an existing curb. This is not standard installation procedures by any licensed professional ever. We did not inspect this installation or any of them because Maximum Heating and Air were hired as our professionals. They were there for the installation and did all PM's following. We did not inspect this installation until an unrelated roof leak brought us to the leak. At that time we discovered the height of the machine, the two curbs and the ridiculous apron placed around the machine in an attempt to prevent air loss. The store had complained the thermostat wasn't keeping up.

AGAIN, WE PAID MAXIMUM HEATING FOR THE **** REPAIR ON THIS INSTALLATION AND THE RECEIPT IS ATTACHED! Furthermore, the roof is NOT the issue in this complaint.

The ridiculous attempts by Maximum to deflect the cheif complaint are ridiculous and exhausting. The chief complaint is they stacked two curbs on top of one another when installing a new RTU, period! They did not do professional work, went against all industry standards and are not taking ownership and responsibility. This needs to be installed properly ASAP.

      Sincerely,

      *******************
