      Item: ********** Touch Mirror With Server Storage Unit In Back- Wall Mount Unit, Includes Tool Panel &Ample Storage- .WHITE COLOR ***** $5,605.00 I amwriting in regards to the gross misrepresentation that was committed by your company, American Beauty Equipment, in regards to my order of a Pibbs **** LED Mirror Station White ******* Server, SKU ************. Not only is the quality and the functionality of the product far less than what was represented in both the on line advertisement and from the live representative that I spoke to, but there are federally mandated advertising disclosures that have been violated. First and foremost, your company is in violation of Proposition 65, regarding the disclosure of possible cancer causing materials that *** be present in products. This is regulated by the ****** of ************* Health Hazard Assessment (*****). In addition this falls under the auspices of the ******************************** (FCC)in regards to advertising disclosure requirements. This has great significance in my situation, being that one of my co-workers is a cancer survivor, and I have made it a point to not order equipment that falls under the prop 65 restrictions. There was no disclosure in the on -line advertisement regarding prop 65 and yet, when I received the product, it was clearly labelled with prop 65 disclosures ! As far as he quality and functionality, the actual product did not live up the what was presented in the advertisement and by your representative. I am not satisfied at all with the product and it is evident that the quality and functionality of your product was grossly misrepresented. Finally, the name of your company itself, American Beauty Equipment, in and of itself is misleading as the product is labelled as made in *****.Due to these major issues, I am demanding a full refund of what I paid for the purchase of this product. I am prepared to report these advertising misrepresentations to both the ***** and the ****

      This customer called us and purchased these white stations exactly as pictured and exactly as shown and stated. They waited a long time to get them and when they did, they did not like them because they stated PROP 65 all over and that is the law in **********. Customer apparently had a problem with that immediately and so we offered to return the stations or fix any issues with them. They stated they would like to return them and the factory who made them stated their would be a restocking fee because there the pieces that were dirty can be replaced simply by sending them. They also just did not want them after all the work to pack and send them across the ***. The color is WHITE and that is not a warranted color nor is it returnable since it will never be the same once opened. We are still allowing this customer to return the stations on their own as we lost over $500.00 on their shipping due to spikes in gas prices and the distance it takes to ship them. If they wish to return them they may send them back at any time for a refund less any fee due to ruined or broken merchandise from the manufacturer. We offered to help find shipping but it is no less for us than them. We told them white was a bad idea and no one wants to touch it once opened.
      We almost never have a complaint because we always help the client. Over 30+ years in the same location speaks volumes and honesty is still 100% in a very ugly world of business.

      ************ advertised the merchandise as being made in *****.  It is made in *****. After doing research on these items we found them on amazon for about half the price.  We waited a long time for the items.  *********** representative *************************** asked to be paid with a check.  We complied, however, we should never have done so because we do not have the protection of a credit card.  All we have now is BBB to fight on our behalf.  The manufacturer "PIBBS" through ********************** gave us a return authorization with no guarantees of receiveng any refund in return.  They would dtermine that upon receipt of the items.  The cost to pack, ship, snd return the items from ********** to ******** would be north of $3,000 with no guarantee of a refund.  I asked ********************** if he could help facilitate the shipping with a company they use so that the price would be more palpable.  He stated he would work on that for us.  Since that time almost a montha ago he has avoided all calls and email correspondence.  We have continued to reach out with zero success.  ************ and ********************** are unprofessional and liars.  This is completely untrue.  All we want to do is return the items, however, we cannot take the chance of paying the huge shipping costs without a guarantee of refund.  It would cost more than half of the price we paid for the items just to ship them back.  If American Beauty pays for the shipping label, I would gladly pay for packing all the items.

      At no time did we ever represent or say they were made in ***** or anywhere for that matter. We dont put where most items are made as we dont know. Pibbs makes ******* items in ***** and is Italian from ********.
      They kept mixing ** up with a bad company in Georgia called BUY-RITE and kept using their name as my associate kept saying we are American Beauty Equipment and NOT BUY RITE.

      This is the exact wording from the page they bought their stations from we have NEVER told a customer something was made here or there if it was not and would never as we are AMERICAN BEAUTY EQUIPMENT.

      Dear BBB representative,

       

      I am contacting you regarding our claim #********.  Last evening I attempted to respond to the 2nd response from the company we have a claim against.  I rejected the statement in the claim however, when I attempted to write a narrative and the system shut down.  I posted a couple of images of our partner who is undergoing cancer treatment but could not explain the photos.  In addition to the stations being defective and poorly made, American Beauty did not divulge the material being cancer based.  The stations required extensive assembly.  I uploaded several photos showing the attempts to put together the shotty product.  The stations are not "stand-alone" stations as we requested.  The bases which required assembly and cannot hold the weight of the station and the heavy mirror.  We did not want a wall mounted station as ********************** explained.  We notified the company we were not happy with the product within 24 hours and wanted a return authorization.  ********************** never addressed any of these issues. Rather he just ignores all phone and email messages.  This is not the representation of a reputable company that stands by their product.  We did not delay to notify American Beauty of our dissatisfaction.  We did so immediately.  ********************** also mentions the delivery fee however, if you notice the invoice we PAID the delivery costs ourselves.  We are not fabricating anything.  The timeline of our actions speak for themselves and the correct path to attempt to return the items.  Please help us resolve this.

      These are way past the time the factory will allow a return. There is no way for anyone to know where or how these stations are being stored and what has happened in the months previous. Sending them back for a partial credit is the best we can do at this point. Once you return them please notify us, we have no magic way to get them from ********** to ********. We offered at every point to get new items for the stations if they were dirty, considering they were white and once opened are really not returnable. The factory even offered to send all new drawers and even the parts you did not like, you refused all because of the **** 65 stickers so you must return them on your own. Prop 65 is your law. It states everything must be labeled and therefore was. Check everything you buy now in your state it is labeled and is to protect all of you.       I am rejecting this response because:

      The items have been properly stored in an enclosed storage facility immediately after receiving them.  We reached out to American Beauty from Day 1 immediately after the the items were received regarding our desire to return the items for a refund.  We told ********************** more than once that we did not want any replacement items from this company.  We arranged for the items to be returned, however, we cannot absorb the shipping costs after already paying for the items to be shipped to us.  I told ********************** that I would pay for packing of the items for shipping and his company could arrange for the shipping return label.  He stopped responding to my inquiriies to deliberately delay the process.  We made numerous attempts to call and email, however, the company avoided all of our correspondence.  We did everything in our power to facilitate this return.  It is the responsibility of the distributor to adhere to the wishes of an unhappy customer for all the reasons previously stated.  We don't need any more smug, unprofessional remarks as is the last two sentences of his previous reply.  We asked for and are entitled to a refund for our items and a return shipping label to facilitate a return.
