MIR Appraisal was asked to facilitate the sale of some artwork that belonged to me. The artwork was appraised at $36,000. When he emailed me a contract to sign, I made several request for edits and I also asked if we could discuss some of the terms of the engagement. He was irritated that I requested the edits and consequently refused to act as the agent to facilitate the sale.I was informed that there was an outstanding $8,000 invoice for shipping costs and storage fees. I refused to pay for this invoice considering I never agreed to these costs.I am requesting that MIR Appraisal, ************************* and, ******************************* release my artwork.

His wife, ***************************** was our client and we did appraise the collection. The court ordered that we liquidate the collection and we did not have any direct contact with *********************************. When we sent the contract after the court order, to both Mr. and **********************, ********************** signed the contract but ********************** called and used profane language and wanted to put a reserve on the items which was not discussed. We are not an auction house, we could not honor that. Per our contract all the fees including transportation, extra research are waived when sold through our company, and since ********************** has made threats and caused an unfortunate situation, we decided to end the sale of his half provided he pays the fees associated with the original contract. Since then, he has left multiple negative reviews about our companies using our employee names. We've contacted ********************************* regarding these problems with ********************** and she apologized for his actions. We are not a charity and we have been kind enough to let him take his portion of the property granted he pay the owed dues associated with the original contract.

I am rejecting this response because: I did not call and use profane language when I reviewed the contract. On the contrary, I emailed the company with my edits and concerns regarding the sale.

See the two page attachment. It contains my email with my edit requests which are all very sensible.  The page that follows is their email response where they terminate the relationship.

I have also filed a complaint with the Office of the Attorney General, the *** and, I have completed the paperwork related to a Small Claims Complaint and Small Claims Summons.

      Sincerely,

      *****************************

Please note that ********************** was not our client to begin with and only ********************************* was our client. He has ruined our name and reputation due to his anger toward his ex wife. She was our contact, and when they separated we - out of courtesy - sent a contract to him regarding his artwork. His edits on the contract were unnecessary since we did not even need ************ to liquidate the artwork, which was court ordered as previously noted. The ********* art has been divided between the two spouses and can be picked up when fees are paid, or will be sold per the court order.

His actions are resulting in undue expenses and decline in our business. He continues to leave angry reviews to smear our name. We have cases in which both the husband and wife are our clients, but this is not the case. Legally we cannot discuss **********************' account with him because he was never our client.

      Complaint: 20761352

I am rejecting this response because: I was their client. It was a joint appraisal.  However, I do not know why that is relevant.

The bad reviews were a result of this business' actions and unfair practices. This dispute has absolutely nothing to do with the fact that my wife and I divorced.  It is solely based on *************************, ******************************* and MIR Appraisal's business practices.

The issue are the fees that have been invoiced.  These fees were not agreed upon by me.  There is no contract - verbal or written.  And now they will not release my property.

Again, I was their client, and these fees were not approved by me.

Holding my property as ****** is illegal and consumers should be made aware of their business practices.

      Sincerely,

      *****************************
