We contracted work shelter to produce bandana sets by Christmas delivery. The process started in negotiation may of 2021. We reviewed all the materials and techpacks prior to signing the purchase agreement and down payment. This company made mistakes and admitting to not reviewing files in detail. They said a **** week delivery and we were 35 weeks into an order with no samples being sent to the states. The company was given leeway for textile shortages due to covid as that was not a controllable issue, however the other aspects of poor samples and lack of experience was horrific. We have all emails and timelines of breech of contract as well as the admission of poorly reviewing design instruction, even though the method is in the file 2-3 times. I believe other companies have lost goods due to their poor skills. Also the buyer/ sellers act I believe also addresses breach of contract as not delivering per requested items, but also within timeframes that are "reasonable" as outlined in the terms and conditions. We ordered hats at the same time. Our factory was in lockdown. We still received hats per our techpack within 5 months. Production of style and quantity were similar in style and volumes. You will also note at the start of the year we did request that the company send us fabric. She said unfortunately we can't do that. This is why I would like to see the invoices against her other accounts and orders to see what shared similar materials, etc. Technical packs do generally fall into *****. of the uniform commercial codes. Assurance of performance. and for the continual delay we refer to *****. Procedure on Notice Claiming Excuse.
