I am a pediatrician in ******, and I have an obligation to warn families about this company. Initially, when I obtained a night nurse for our newborn, the *** *********************** was very responsive. My husband and I paid the majority up front to take advantage of a 20% off special. ***** personally recommended our night nurse. When the night nurse showed up the first night, she smelled of smoke/marijuana. We asked her to leave. I contacted ***** the next day and told her about the smell of cannabis. ***** offered to replace the caregiver, but our trust in the agency was broken, and we requested a refund. Per the contract, a parent has a right to cancel the contract in the event a night nurse shows up under the influence of a substance. ***** told me their accountant would be reaching out to me for a refund. Two days later, I had to contract ***** to follow up on the status of the refund. She then informed me that their night nurse tested negative (allegedly) on a drug screen and was doing "sage prayers" since she was "very religious." I pointed out her Instagram, which had pornographic pictures on it not consistent with a religious person as well as the fact that any sort of third hand smoke increases an infant's risk of SIDS and is therefore dangerous to a baby. From then on, ***** started ignoring my texts, calls, and emails. When the accountant finally reached out, he blamed us for choosing the night nurse in the first place and said it was up to us to come to an agreement that was fair to the night nurse. We refused anything but a full refund. When I reached out to ***** again, she tried to say we lied about the smell of marijuana as the reason for dismissal (even though the night nurse admitted smelling like smoke) and cited the reason as me wanting to "cosleep" with my child. ***** has been hiding the company's negative Yelp reviews under someone's non-profit organization with a similar name (Sweet Dreams Foundation). This lack of transparency is a red flag.

I am requesting refund from Sweet Dreams ************ Sweet Dreams is an agency that provides night nurses for newborn care. I booked a night nurse (******) for the period of Feb 3 - Mar 30 2024. I paid a deposit of $3264 to secure this contract, by ***** on December 10 2023 to *********************** (Sweet Dreams' owner) to secure the contract. Initially service went smoothly. Then the night of Mon Feb 19, ****** informed me that she was going out of town until Sunday Mar 3. This was the first time I was made aware of this sudden absence, either from her or Sweet Dreams. She stated she would be able to work the night of Mar 3 upon her return. On the morning of ******* 2, I texted ****** to confirm she was returning the 3rd. This was met with no response. I sent a second text the morning of Mar 3, which she responded to saying she was not feeling well and would not be coming in to work. The morning of Mon Mar 4 I texted ****** to see if she was able to return that night. She stated she had a cough. For the sake of not exposing our baby to possible contagious disease we asked ****** to take the remainder of the week off and return Sun Mar 10. The morning of ******* 9 I again texted ****** to confirm she was coming back the 10th. I again did not get a response even after sending a followup message the morning of the 10th. On Mar 10 2024, I discussed with *********************** by phone that ****** had not showed to work several times on short notice and had not responded to confirm that she would be returning. ***** disclosed that she had attempted to contact ****** as well and was unsuccessful. At this point I requested termination of the agency's services w/ a refund of the $3264 deposit. As of today Mar 25 2024 I have not received the refund, have not been told when I will receive it, and have been given no other information than an email for the agency's accountant. I emailed the accountant *********************************************************************** Mar 22 2024 with no response either.

As shown in the contract I uploaded, the deposit was supposed to be refunded/released on the last day of the contract. The contract ended in June 2023. We have tried to seek recovery through *********************** (CEO), and she has claimed administrative errors, but it has been months and she has still not returned our funds.

I spoke with the business under the guise name *********************** who assured me of their infant care services for night time. We received a contract which requested a credit card on file. Our services were to start in December. The company charged our card for services on two separate dates claiming they couldnt charge the full amount of services on one date and had to charge on a separate date. We were charged $6300 on 10/11/23 and $1575 on 10/23/23. I emailed company on 10/25/23 and again on 10/31/23 and had no response. I texted and reached out to the contacts phone number on 11/5/23 stating I had emailed twice and ***** received a response. She responded stating her accountant would reach out to me the following day. They never reached out. I texted and called 11/8/2023 and still no response. I canceled my services (which would not even start until 12/27/23) and emailed the company. They responded stating that they would finally explain the services and would cancel and refund. We were then charged another We were just charged additional $3150 on 11/14/23 when we had already canceled services.Recent reviews on ****** state that others had the same issues so we have disputed the charges through our credit card servicer because of fraudulent and shady practices. Others had issues where they couldnt recoup their money and didnt receive the services as promised.

      Business response

      11/30/2023

Client cancelled and went with another company.  Per our contract on page 3, section 5 it clearly states the following:

Parents agree to provide a credit card to Sweet Dreams Infant Care to be held and charged in the event of cancellation. If the contract is canceled before the case starts, full payment for the contract will be charged to your credit card.

This contract was cancelled before the start date so full payment is due, the client ******************************* owes Sweet Dreams money!

I am rejecting this response because:

I requested to add a 14-day cancellation notice on the contract which would effectively null and void the contract as my cancellation date was well before 14-day notice. This company is requesting full payment from families (see ****** reviews) prior to services and charges wrecklessly without responding to complaints and is not timely in actually providing clients their money back.

This company is effectively requesting full payments without any work done and even with cancellation is charging people for ZERO work done. Their contract is misleading and frankly fraudulent and wouldnt stand ** in a courtroom (I have consulted a lawyer).  And I am sure there are dozens of people who have been also swindled by this company. It is shady practice.

      Sincerely,

      *******************************

The events related to this dispute are as follows. We have supporting documentation as well.Signed Contract, Paid Initial Deposit - On May 9, 2023, I entered into a contract with Sweet Dreams Infant Care to provide 10 weeks of future childcare services beginning on August 15, 2023. The anticipated value of that contract was approximately $12,600. (See attachment #1). The contract required an initial deposit in the amount of $5,040. This deposit was charged and paid from my Citi Card on May 11.Charged Erroneous ************** Services Received - Between July 18 and August 9, before ANY services were received, we were erroneously charged an additional total of $8,960.July 28, 2023 - Two charges for $1680 (for a total of $3360).July 31, 2023 - One charge for $1680 August 2, 2023 - One charge for $1680 August 9, 2023 - One charge for $1680 August 9, ***** - One charge for $560 Vendor Agrees to Reverse Erroneous Charges - On July 27, we contacted the vendor about the erroneous charges and she assured us that she would reverse the charges and that we'd see then returned within ***** business days. This did not happen, despite our following up multiple times. (See attachment #3)Services Not Received, Vendor Agrees to Refund Deposit - On August 15, 2023, we expected our childcare services to begin, as per our contract. However, the day came and went and the individuals never came, leaving our contract unfulfilled. On August 16, we contacted the merchant and asked for a refund of our deposit and for a reversal of all erroneous charges. (See attachment #2) We continued to contact the vendor about the issue without getting it resolved. At this point, the total amount charged to us for this contract by the vendor was $14,000 for no services received.Since the vendor stopped responding to our communications, I disputed the initial $5,040 deposit with my credit card company and received a permanent credit for it, bringing the amount still owed to us to $8960.
