I am a disabled veteran who is now homeless because Villarreal RE ************* ***************************** negligently performed their duties during the course of buying my first home with a VA Home Loan last year. **************** worked for the company when the deal closed on September 2, 2021 They didn't review documents that could have exposed serious sanitation & foundational issues. The documentation I am referring to is the seller's disclosure and contract. The sellers improperly filled out the disclosure form. The form was only marked that the sellers hadn't lived on the property the last 12 months, which is true as it was a rental investment property. The other blocks were not checked. No one at Villarreal RE *** caught that. I didn't know it was an issue until I conferred with litigators after the discovery of those issues in the crawl space by a plumber-contractor on December 13, 2021 (An engineer confirmed the issues and said they were worse January 2022). Litigators said Villarreal RE *** and Ms. ******* should have caught that major issue during the post-inspection/pre-close phase of the deal. If they had caught it, they could have worked with the seller's agent to figure out why those forms were improperly signed & sent another inspector down into the crawl space. The contract has issues as well. I signed & initialed the contract in the company's office on July 15, 2021. **************** didn't tell me to initial paragraph 36. The seller's signed & initialed it via DocuSign on July 16, 2021. Because they negligently didn't check the paperwork, I bought a home I could not and should not have because of the issues in the crawl space. These issues would have come to light had the disclosures and contract been checked by the firm. I have filed IDFPR complaints against the firm and ****************. I want them to file an errors and omissions insurance claim to pay for the repairs. They will be sued if they refuse. Documents are attached.
