      I hired Roofing by Hernandez to address a problem of leakage from the roof which caused damage to the walls on the first floor. I paid the initial deposit of $1641 with the understanding that the balance would be paid after satisfactory completion of the job.I withheld payment for two reasons:1) until it rained again, it would be difficult to ascertain if the problem had been resolved.2) the job was not completed according to the terms of the contract which was to cover approximately 3/4 of the side of the roof that was not draining properly. Instead, they only covered small patches in random areas, claiming it was sufficient. Also, instead of taking half the day, which they told me to allow, they were here for less than two hours.I have photos showing the accumulation of water on the roof several days after the job was completed. Several contractors Ive consulted confirmed that the job was improperly and inadequately completed. Because they did not correct the pitch of the roof, the water will eventually seep through the seams. Roofing by Hernandez failed to properly address the problem and has threatened to place a lien on my property.

      This is regarding the complaint case Complaint ID: ******** for Emi Kelsey. 

      I am the manager of Roofing BY Hernandez **** I apologize for not responding sooner. Regarding ****************, she was a client of ours. She mentioned that she was elderly and needed help. The situation is that we had a contract with the client for a significant repair. Emi owns a rental property, and when we were contracted to repair, there were buckets inside the property catching water, leading to mold growth. The property had numerous open seams. The link below contains pictures from our initial inspection. 


      The customer signed the contract and wanted to move forward with our company. We performed the repairs. She even wanted to wait for another rainfall to pass before making a payment. We let the rain pass and contacted the client. She said she had no more water in the property and the repairs were great. However, she then said she would not be making a payment because she talked to a contractor friend who suggested that she had paid too much. I went back and forth with the client many times, but she has not made a payment. We tried to talk and reason with her, but she refused. As a result, the client now has a mechanic's lien on her property due to failing to pay our company for our services. Please find the link to the pictures from the repairs performed: [Link].

      Roofing contractor, ROOFING BY HERNANDEZ, INC. Hired on 09/26/2022 to perform full tear off and replacement of roof. Original estimate was for $28112.00 and scheduled for 10/22/22, I paid 50% upfront by 10/17/22. Job was rescheduled twice and finally began on 11/07/22. On 11/08/22 I was informed of additional charges for unseen work totaling $3675.00. Job was supposedly completed on 11/12/22. I was promised and asked for pictures or video of completed work and work progress, I did not receive these until 11/30/22. I received final invoice and completed work order on 11/16/22 with notice of payment for 11/21/22. During that time waiting for photos/video and final invoice, I noticed a leak coming down hood vent above stovetop oven on 11/18/22. Company reps. came on 11/29/22 to inspect roof and hood vent, photos attached. I was promised that rooftop vent shaft parts would be replaced for hood vent and chimney vents would be replaced, this never happened. They have been applying late fees since 11/21/22. I believe I should not have to pay these. On 11/30/22 I forward another payment of $3500.00. On 12/05/22 I hired HVAC company to inspect equipment and roof near HVAC , report and invoice attached. Roofing company did deduct this cost from balance due. Unfortunately, leak still occurring as recently as 12/18/22. I now have been told they believe job is 100% complete and I should lookup on ****** why I am experiencing this leak that has never occurred before. Along with a slew of legal threats and verbal disrespect. I need leak fixed before I make final payment and consideration for this experience and consumed time. This company boasted of their accreditation and A+ rating with the BBB, I expected better. I can email videos and have uploaded photos and documents. Also, I would like a stop to the legal threats and verbal disrespect. I now have concerns about future dealings with this company, especially warranty validity.

      First and foremost. I have answered and talked to this client anytime she has called and asked a question or stated that she had an issue. There are normal business hours of Monday through Friday 8am to 4pm and this client does tend to contact our office after business hours with demands. 

      The allegations that this client has placed against us are untrue.

      Due to the nature of the way that this situation has escalated. I am not able to answer more.

      I am rejecting this response because response was disappointing. First, response was unprofessional, smears and false accusations. Second, problem still persists and I am pretty sure their attorney isn't going to repair the leak.  Unfortunately, I had to employ another Contractor, their inspection and recommendations are attached, who has found defects, structural damage, and wrong material usage..Simply put the leak is not due to condensation as Hernandez Roofing implied, but bad workmanship and materials used. Also, I have filed a complaint with the *************** ********** of ******** Affairs and will be filing with the State of ******** Attorney General' s office. I was also told to contact OSHA for improper work conditions based on my photos and videos. In their contract I was given a workmanship and materials defect warranty for 1yr and 5yrs, these issues were discovered within weeks. I would not recommend this Contractor and will be seeking a financial remedy thru my own legal representation.  I wish we could have settled this amicably.

      We have spent weeks trying to communicate and educate the client in regards to the matters she was stipulating she was having. 

      The problems she is having Had nothing to do with her contract. We went over the property many times to only be spoken to a derogatory tone. She insisted it was a roofing issue. It is not

      The customer ***** will not have civilized conversation with anyone with our firm. She spends her time screaming and repeating herself. She says everything is a waste of her time. 

      We stipulate our warranties and have done everything we could to possibly rectify this situation. The items she is having an issue with has nothing to do with the roof. They have to do with her exhaust not being properly installed and there is nothing in her contract stating that is included. We also do not do that type of work.  Also, our warranty is given when the contract has been paid in full. Her contract is not paid in full. I understand she assumes that the issues she is having has to do with us. They do not. We have hired other contractors that specialize in these departments to go out and inspect. We were allowed two individuals. In which she was also hostile, screamed and was rude to them. There is just so much you can do with a client. We had reached our limit. We have sent several of our outside field managers to speak with *****. She would conclude that everything was fine and she understood the situation. To only either within a matters of hours or days to contact our firm with a hostile tonality and demand things. 

       

      So, from this point forward we have tried as much as we could. This is now has reached an escalated situation which our attorney is the person she will have to reach. Moving forward.
