On March 6, 2022, I deposited a security instrument "ucc3-104" with *********** for the purchase of a Lamborghini Urus 2022 from Baha Sales Auto. Despite initiating the transfer, the dealership abruptly refused payment, alleging fraud and threatening legal action, causing turmoil and casting doubt on their integrity. The security deposit was conducted lawfully, with no indication of fraud. ***********, the transaction intermediary, raised no red flags. Baha Sales Auto claimed *********** was investigating the security, adding to the confusion.Baha Sales Auto's refusal came after *********** initiated the wire transfer, questioning the fraud claim's validity. Moreover, it's improbable for the dealership to address alleged concerns within such a short timeframe Additionally, their dealer, *******************, unprofessionally labeled me a scammer. This behavior reflects the dealership's lack of integrity.I believe possible theft is taking place. I demand a thorough investigation into whether Baha Sales Auto received the funds and is adhering to legal standards. If found acting unlawfully, I'll pursue legal action.Thank you for your attention to this matter. I await updates on the inquiry for a swift resolution.

      Complaint: 21496805

I am rejecting this response because: Dear BBB Customer Relations Representative, Thank you for your email regarding my complaint ID #******** against Baha Auto Sales, Inc. I appreciate your diligence in following up on this matter.

Unfortunately, the complaint has not been resolved to my satisfaction, and I would like to provide further details to ensure a comprehensive understanding of the situation.

As previously mentioned, I sent a security instrument to *********** on March 6th, 2024, which was intended to settle an account associated with Baha Auto Sales, Inc. Despite assurances from *********** that the security would be processed in a timely manner, it remains unprocessed as of today, April 4th, 2024.

Furthermore, *********** allegedly provided misinformation to Baha Auto Sales, Inc., causing delays in the release of property associated with my account. Until *********** rectifies this misinformation with Baha Auto Sales, Inc., I am unable to proceed with necessary transactions, resulting in additional inconvenience and financial implications.

Additionally, Baha Auto Sales, Inc. informed me that a payment attempt was allegedly made on March 27th, 2024. However, due to poor communication from ***********, I am uncertain whether this payment attempt was successful or if funds are being withheld. This uncertainty further complicates the situation and underscores the need for prompt resolution.

Moreover, Baha Auto Sales, Inc. stated that they would not engage with me until *********** clears the matter. If funds are being withheld by ***********, Baha Auto Sales, Inc. has no legal standing to withhold any property associated with my account.

Please confirm if they in fact have the funds?

I have also attempted to escalate this matter directly to ***********'s CEO, Mr.
      ****************** Paracchin
, but have yet to receive a response.

Given the ongoing issues and lack of resolution, I kindly request that my complaint be reopened for further investigation. I am prepared to provide any documentation or additional information necessary to assist in the resolution of this matter.

Thank you for your attention to this issue, and I look forward to your prompt response.

      Sincerely,

      *************************;

I found a Jeep on the CARFAX website that I wanted that was located at Baha Auto in Chicago. I made contact with them via email and then we began to text. I received texts from several different numbers and wasnt always sure who I was talking with. Being that Im from the ******, ** area, I sent them pictures of my Jeep to get a trade-in value for my vehicle. They received several pictures, I included more when asked, and provide the *** number as well. I asked for a BOS so I would understand the costs. They sent me the first BOS on Saturday. I told them I didnt like the deal. I was contacted by a manager on Monday, and was asked what it would take to get the deal done. I told them I wanted $19,500 for my Jeep, they came back at $19,000. I accepted and asked them to send me an updated BOS so that I could get the remaining balance. At no time did they say the trade in value was dependent on an on-site appraisal. I went to my bank, got the title for my Jeep and a check for the balance based on the **** I drove up on Wednesday morning, spent over 4 hrs and over 200 miles. **** I got there, they wanted to rework the deal after I already have a BOS showing the deal. In order to close the deal, I had to give them another $500 because they would only give me $18,500 for my Jeep.

Hello, first id like to congratulate you on  the new purchase. any trade must be evaluated in person, and when we find damage such as scratches or mechanical its going to reflect the trade in value, you sent us pictures of  the jeep and i asked you about the scratches on the hood, you informed that it was due to the dust and it was not scratches, when you came into the dealership, we noticed that there was actually scratches on the hood and we informed you about it and told you that we would not be able to honor the price we agreed prior because of the undisclosed damage. Any vehicle in any dealership is inspected and evaluated in person before closing a deal.

I am rejecting this response because: it was never stated that you wanted to physically inspect the vehicle to provide a valid trade in value. And when the manager contacts me and asks me directly what it takes to get the deal done, and we agree to the price over the phone, the price stands. Holding my title and registration paperwork hostage isnt acceptable, trying to get a great review from me isnt going to happen. At no time was anything said that trade-in value was dependent on physical inspection. You provided a BOS with all necessary pricing, and you put me in a position that I had to buy the vehicle as my bank had already provided me everything I needed to purchase the Jeep. I already had a loan for the required amount which goes against my credit rating and having to redo everything would have cost me more money. At this point, I believe you owe me the money based on the mental and emotional damage you are causing me. I felt forced to purchased the Jeep after arriving and I honestly believed your assessment of the vehicle was wrong. I think there are issues that you failed to disclose that I will have to pay for to get fixed.

      Sincerely,

      *******************

in no way did we force you to purchase the vehicle or hold the title, when you came into the dealership your vehicle had damages on the hood, damages that you  said was "dust" and when you came in person it was not dust but actual scratches, we told you the hood we need to be repainted and it would cost $500, you agreed and we closed the deal.

I purchased a 2020 ***** Malibu LT from Baha Auto on April 16, 2022 with ****** miles on it with a Manufacturer warranty and a Warrant with Baha. A couple of days after driving the vehicle the check engine light comes on , I contacted the dealership the dealership they told me to contact the Shop. I drove the car for a week After ,me and my toddler was in the vehicle on the expressway and the camshaft breaks on the car almost causing us to crash because I couldn't stop the car, I took the car to Baha shop , I was charged a $100 service fee and the fixed the camshaft and PCV valve hose and I was told that since my vehicle was still under Maufactor warranty that I had to take it to Chevrolet and it would be fixed under warranty. After taking it to ***** I was then told due to lack maintenance and slugged engine its a possibly that i will need another engine, and that there's also a recall on my car and that the Warranty will not cover it if its lack of maintenance from the dealer and they will have to pay to have the slugged removed. I contacted Baha told them exactly what they said, I was told by Baha that everything ***** said was incorrect and I should take it to another ***** Dealership I was charged $150 from *****. I took my car to another ***** dealer ship and they tell me the same exact thing , they also contact Baha dealership and tell them whats the problems Baha refuses to pay to fix the problem while my car is under two different warranty . I was told by the second dealership that I had to pay $508.43 to get my car back because its some parts that one taking apart they are no good , Baha also is giving me the run around and is not trying to fix the car or pay the dealership for repairs. I went up to the dealership once again and spoke the Manager **** and was told that the dealership just don't want to fix it because they want to make money. I was giving the option to split the payment with Baha and pay more than half of the repairs, which is $2500

Baja auto sales did not give accurate information regarding their financing company ******** financial.I believe it to be intentional as they will not work with me to resolve. I purchased a ***** Tahoe late last year with $6,000 down payment. Baja auto sales did not give accurate information and my payment to ******** financial was DENIED due to inaccurate account information. I do have records of trying to make the payments. By the time I was able to get an accurate account number, I had already missed my first two payments. I was told I would be receiving a phone call and packet of information in the mail. I never received a phone call or the packet of information. The first letter I received with my account number in it was a letter of default. I immediately sent in a check to cover any missed payments and make my account up to date. Almost a month later, Baja auto sales repossessed my vehicle. ******** law requires 15 days to reclaim a repossessed vehicle by either getting the loan current, or paying it off In addition to my loan being current, I asked to pay cash for the remainder of the vehicle. Baja auto sales refused and said there was nothing I can do to get my vehicle back. They will also not give me items that were in my vehicle. My purse, wallets, important documents and medications for my sick child.I found out that Baja auto gets to buy back the vehicle from ******** if the customer defaults. They want to keep the down payment as well as my payment check to ********. That puts me out nearly $8,000. Not acceptable.I will be speaking to my attorney.

Hello, you purchased the vehicle on 9/25/21 and have not made a single payment to ******************. westlake has a first payment default. we have made numerous calls to you to resolve this situation and failed every time. our phone calls are never answered. as soon as the vehicle was repossessed you contacted us, the repo would have of been avoided if you contacted us and made a payment. The vehicle owner is responsible to make the payments and baha auto sale does not give out any account numbers, this is information that you would need to acquire from Westlake. Baha auto sale would still like to resolve this matter! you can repurchase the vehicle by contacting us and sending the full payoff including the repo fee and tow fee that we have paid. you have missed 5 payments on the vehicle, as a vehicle owner you have the responsibility of verifying the payments and making sure they have cleared. As for the personal belongings in the vehicle you are able to pick them up as soon as we have the vehicle in our possession as stated when you called us to ask about the vehicle location. per contract that you signed you have a first payment default, that means if the first payment is not made we have the right to repossess the vehicle. You also have a option to purchase the vehicle in full, please contact us and we will discuss the process of doing so at ************.

also ******** is self-help repo state, that means a car can be repossessed as soon as your in default of any payments, in your case is was 5, without any court order.
