I requested a 40x64 building from Four Seasons with an attached picture design and received a quote. Estimate 1210. I accepted the quote signed and returned it. Upon start as stated in the bid he requested 50% payment. I paid about 75% ($31,000). During the wait for his start I requested cupola’s, which I originally requested but didn’t get added to the bid and an extra door. He kindly gave me new numbers and thru text accepted terms. At the end of the project he had started on the porch. We had already had two conversations about the porch and the submitted design and how I didn’t think it was going to match the design. He assured me that he could tell the dimensions from the picture and it would be bigger then what he had laid out. I went out to visit the jobsite and noticed that he had started on the porch and poured footings for it. As I suspected from his measurements it was not what I submitted, AT ALL. I reached out to him the next day and when he got back to me he had nearly completed the porch and was wrapping up the project so he could leave to go on vacation. He stopped construction of the porch until we had a meeting to see how to proceed. We went over the design and what was built and both agreed that it WAS NOT what was submitted. He said he was going to order the material and after vacation come back to finish the porch and install cupolas as we agreed. He requested that I pay the remaining amount (approximately $16,000) minus the cupolas. I paid this on site with the agreement we had he’d be complete after vacation and I’d pay for the cupolas when installed. After 2 months he finally called me back and refused to finish the porch for free. We came to an agreement to pay for materials so the project could be finished. It’s now been 4 months, my porch is unfinished, no gutters installed so it’s eroding my porch area and he never even cleaned up the jobsite. His garbage and Metal scraps are still here and he won’t return a call.Business response

He asked about cupolas after verbally agreeing to the price on 1/24/23 (See pic1) The additional door
was requested mid build not before we started as was a change order on the windows that he wanted
to add grids into the windows and both doors. He was quoted 843 each and I wasn’t even charging for
installation. (See pic 3)
The contract was for a 8x8 corner porch and that is what I built. Which means is is 16ft long on each
outside side for a 32ft linear front porch. (See pic2 of him confirming the 8ft and asking if we needed
more rock for the 8ft porch area) Also see (pic4) of a small awning pic he sent me for placement of his
door and windows under porch.
After building was built and all metal was installed the only thing left was the porch. We dug the pier
holes and poured concrete footing pads on 7/5 and left for the day to let concrete dry. The next day 7/6
we built the entire porch minus a few pieces of trim. That night I got a message saying that porch was
smaller then he thought and expected but that was at 6:56pm. He could have called the night before
when he was out there but he didn’t and now porch was built. (see pics 5 ,6 ) I never guaranteed that
the porch was exactly the same size as a pic of a porch that he sent me. That’s impossible but pole barns
are built on either 8 or 10ft centers. That pic looked to be 8ft centers which is why I quoted and built a
8ft porch. I thought the pic was something off the internet but come to find out it was 10 min down the
road at his buddies barn. He could have measured it instead of sending a pic but he admitted that he
doesn’t know about construction and not good with a tape measure. There WAS NEVER A DRAWING
JUST THAT PIC. We only agreed that is was not the size he WANTED after he took me to his buddies barn
and I actually measured it. I never agreed that it was not the size on drawing since there never was one.
At this point the project was finished minus a few pieces of trim and installing the gutters that are all on
the jobsite but I was told to hold off on finishing the porch. (see pic 7) and that materials would take 2 or
3 weeks to get so I had to start another job and that we would meet and I would grab trash and metal
scrap and get a check for the completed job and he would still owe me money (see pics 8 and 9). At this
point 7/9 is the first time we agreed for him to have plumbing in and I would then come back to final
grade rock to get ready for concrete and add on to the porch when I was there getting trash and a
check. Also cupolas had not arrived yet
8/10 (see pic 10) got message asking about how things going. I asked if he had plumbing done and if he
was ready for concrete. He said waiting on plumber.
9/5 (see pic 11) He now is asking to add more windows so I gave price and asked about plumbing. He
says he is not waiting on me to do finish rock grade and wanted tin moved. Not sure how that changed
but that’s not how its done. Plumbing then final rock grade.
9/13 (see pic 12) now plumbing is almost done. I'm back to still waiting on him to get that done to come
back.
9/229see pic 13) No update on if plumbing is finished but I was trying to get him scheduled in but he
decided to schedule spray foam before pad is poured but cant do that since plumbing isn't finished still
which means I still cant come back to add porch the new windows he added and final grade.
10/3 (see pic 14)He called and now septic was getting installed and we could get to back of building and
he never moved spray foam guy back. I explained a simple piece of plastic to cover area that I needed to
cut out and then he started saying that I would have to pay for foam guy to come back and I had to pay
for concrete guy to level rock. I haven't even been paid for the rock or the grading that was already done
so why would I pay for something that I haven't even been paid for and now he is out of contract by
hiring a new concrete guy?
10/3 (see pic 15) Then he says he can't wait any longer for you. I think you’re great and do great work,
I'm sure scheduling is terrible, but I have to move on. To me that means he found someone else.
The amount of phone calls and text message have driven me to a point of having to start taking anxiety
medication and are borderline harassment. I had no choice but to put a block on his number because of

I am rejecting this response because:
Mr. ******** response provided us zero information in any sort of resolution.To make it as simple as possible for all parties, it was said on July 9th 2023 that he acknowledged (in recent photo attachment 1 and 2) that I was not satisfied with the porch. This is because we had multiple conversations about it not being remotely close to the design I submitted. After my saying “we have to do something about that porch. It’s not going to do me any good. “
Mr. ******* responded with “I know. I just need to get a size” He then states: “ I haven’t herd on when they will come in”(in regards to my cupola’s) “but I gotta bring equipment back when we change porch and I will install those when I’m there. It’s gonna take 2 weeks minimum to get metal. When metal comes in I will bring equipment back tear off porch rebuild and put cupolas up.”
It’s there in plain sight on July 9th 2023 that he was going to order metal and RETURN WHEN METAL COMES IN. His last response was on October 3rd 2023 86 DAYS after him saying HE WOULD RETURN WHEN METAL CAME IN. 86 Days Mr. ******* neglected my project.
There was never any premise that my plumbing needed to be completed. My plumbing had zero impact on my porch being completed. They are not even in the same area. He wanted my plumbing to be completed so that he only had to make one trip to do my porch and my final grading for concrete.
On August 12th 2023 I followed up with “How’s everything going”. Mr. ******* didn’t reply for two days and even states “Sorry your message got buried. I can barely keep up since I’ve got back” implying he’s behind on his word. He then states: “are you ready for concrete yet?” Concrete wasn’t even a possibility until the porch was completed so it could all be one pour to reduce cost. Or so I was told. I’m not in Construction that’s why I hired a “professional” to complete my build.
In response to Mr. ******* assuming that I hired someone else and breached our contract. That was never stated. I stated after he wanted to contact my insulation contractor to push my dates back again “I can’t wait any longer for you. I think your great and do great work, I’m sure scheduling is terrible, but I have to move forward.” I could not waste anymore time waiting on Mr.*******. I had to get my other contractors going to complete their scope of work completed before it got to cold to spray foam and seal my building.
I think any professional would agree 86 days waiting on a PAID job to be completed especially after implying that it would be around two weeks until he returned. This whole project has been nothing but breached words from Mr. *******. My original quote was requested on 11-20-22. This day October 27 2023 he still has not completed HIS work.
I again request that the work be completed, or pay for additional cost in hiring an additional contractor due to Mr. ******** negligence.

This job is not paid in full!! I am still owed money for the grading and the rock that was previously done before the build even started. Plus the cupolas that should have been paid for since they were custom ordered for his building. Now i still have them and would be more then willing to drop them off if they were paid for so he has cupolas that match his paint color. See invoice that he approved on 9/13/23 So this was not finalized until this date. As stated in last response we were waiting till plumbing was done for me to come back and just make one trip. See last text pics. There never was an agreement to pour any concrete for the porch just the barn pad for on thing. Second pouring a 40x64 pad and pads for the porch in one day are pretty much impossible. So that had nothing to do with this at all since there was never any talk about pouring a porch pad. He never asked for a porch pad.
Yes i acknowledged that it was not what he wanted as it said in previous text pic. Again there never was a design just a picture. That is not a design. Again barns are built on 8 ft centers which to me in that pic looks to be 8ft so each side of his porch is 16ft long . Which is what was built per contract. He wanted me to come right back and add onto porch but i said the metal takes atleast 2 weeks. I cant just sit there not working for 2 weeks and had to start another job but first we had to get costs and the plan again was for him to get plumbing in and me come back and do final grade, add onto porch and then pour concrete in barn.
In previous response see text pic that says (I would have to pay the concrete guy extra to do final grade and pay extra for foam guy to come back) Im not paying extra for any of that. I told him to have foam guy call or i would call to explain how to prep it for me to come in after and it not be a problem but that was not acceptable to *****. Im especially not paying anything extra since i never got paid for the grading or all the money in rock that is there and at thins point he was having another contractor pour concrete so the final grade and any extra rock needed was built into that concrete quote.
At this point the original contract has been completed with the exception of about 1 hours worth of work putting on a few pieces of trim and the already made gutters that are on site and the concrete floor that he has hired another contractor for and breached our contract. I am just still owed the money for all the rock and the grading work that is done. If you want to call it even and remove this complaint that is a 1700.00 credit and the materials for the porch were 1694.00 so that is pretty much even. If you want the cupolas so they match they will need to be paid for. If this is not acceptable I guess i will take the next step in getting the money that i am owed and I will try and sell the cupolas. Thanks, Steve

I am rejecting this response because:
Mr. ******* continues to provide false accounts on what was said. I will not accept any response, or delete this complaint unless it’s Mr ******* completing HIS work, or compensating for any additional funds past what it would’ve cost for him to do the contracted job.Concrete for the porch was mentioned in our first contact on November 20th 2022. See new picture attachment 1. Mr ******* states:” the last barn I quoted was same size with w 2 doors built and concrete was 61k. It would be a bit more for porch.” He acknowledges the porch concrete in our very first conversation.
As far as it being able to be poured with the 40x64 pad on the same day, the contractor that I had to hire, (since Mr. ******* failed me), had no problem being able to pour both on the same day. The only thing impossible about doing this at the same time was Mr. ******* not completing the porch that was part of the job scope. So, the porch could not be poured, due to his negligence again.
Mr. ******* continues to deny that the porch/building design that I submitted to him for quote on November 20th 2022 is a design, because it is a picture. A PICTURE IS A DESIGN. It’s actually referred to as a proof of concept. As he continues to mention all of his barns are built on 8ft centers and that the picture I submitted was as well. You can count the porch poles. There are 3 on each side. Spaced 8ft, so that distance equals 16ft, on each side of the wrap around porch, which Mr. ******* asked on the quote and I acknowledged see attached pictures. My porch that he built had two post on each side, not three. My poles are spaced 8ft and there are two, so both sides are 16ft combined the design submitted is 32ft.
Mr. ******* continues to say that I did not pay in full. I paid in full for the building as HE REQUESTED on July 9th at 1020 AM. Mr. ******* states: “I’m not trying to get paid for cupolas since that was an add on but I would like to get paid for the build. No asking for anything for the dirt work or rock yet. I will still be out 1700 for cupolas, 1050 in rock and 400 in grading.” I replied back with “Ok. I’ll have my checkbook with me”. I paid Mr. ******* the exact amount he requested on July 9th 2023 which was $15,660.00. My initial payment was on June 6th 2023 for $31,000.00. Totaled is $46,660.00.(pictures of both check stubs attached.) My building total estimate was $45,900.00. So for Mr. ******* to say that I did not pay in full for my building is a flat out lie. He would’ve been paid for the building additions And any other work, IF he had shown up and done them like he stated he was in July! Again Mr. ******* has shown no evidence that I was in the wrong. All he had to do was keep his end of our contract. I have countless messages on how he couldn’t show up due to not feeling well, lack of workers , or just my messages being buried. I was left in limbo because Mr. ******* can’t keep up with his commitments.
I never broke our contract, as Mr. ******* continues to wrongly allege. Due to Mr. ******* not showing up and not communicating with me, he forced me to move on and hire another concrete contractor. It’s even stated in my original quote request; “ I will be needing concrete. But prefer a separate quote for that.”( picture attached).
All that I am asking for is to have what I asked and paid for. I even went further and was willing to pay for materials, and Mr. ******* still failed to meet his end.
I want my work completed, or to agree to pay the difference from another contractor to complete it. That is all I am willing to accept. It is clear as day that the picture I submitted for a quote and what I received are nothing alike.

Attached are photos of my quote request with the building and porch design that I wanted, versus the porch design that I was given. There are almost no similarities except they both have a roof.
Also pictures of work that was not finished.(trim work)
