The company installed a roof without having a reroofing permit and when notified he obtained one then would not comply with the inspector. Now I went to put my house on the market and found out the roof is not code-compliant. I have tried many times to get him to fix it so his fix is for me to sign a statement releasing him of responsibility to get the city to make the roof code compliant. I won't sign so the company is washing their hands of me. I am a handicapped senior citizen what am I to do?

On 12/1/21 a representative *****, from ********* Contractors came out to give me an estimate for replacing my roof. Hearing how badly I needed the repairs, ***** said they could do the roof by the end of the year, as well as take care of the water damage inside the house. Other contractors said I'd have to wait until March. However, in order for them to work within that timeline, I would need to sign the contract and give him a check for half the amount immediately. Otherwise there was no guarantee they could get my project on the books. TALK ABOUT SALES TACTICS! I felt I had no option but to sign the contract and hand over a check for $14,687.50 because I wanted the work done within the timeframe I was promised. They sent a crew out within the week and started the roof replacement. However, today is April 11, 2022 and the job has yet to be completed. There are areas on the back dormer that are not even covered with Tyvek, I sent a photo to my new contact ******* who was out of town. He sent it to ***** to follow up on that and an issue they are having on the front dormer, I have not heard a word. The inside work was a total disaster. They sent a guy to do the demo and drywall that had no clue what he was doing. He left a mess from demoing and installed drywall in bits and pieces. When I contacted ***** about my concern and displeasure, he was rude and yelled at me. I informed ***** about the entire situation, he told me I was right about the mistake and he was sending others to fix and continue the job. The guys were set to come on January 11th, however ***** requested that I pay another $10,000 in "good faith" that the job would be done correctly. Thinking that they may not show if I didn't agree to pay the 10k, I gave ********* a check on that day. This job is also not completed as of today. Website says they are a company with unbeatable integrity, outstanding quality, hands on experience, expedient results. Not my experience!

How dare he say that Im trying to blackmail them into getting the work done for free.  Id also like to know who told me not to paint after the difficulty in getting the drywall installed correctly?  Their SALESMAN was not only using pressure tactics, but trying to upswell me on everything.  Trying to get me to have them do more painting, not suggesting they do not paint at all. That coupled with the berating of customers is probably why he was fired recently.  In addition they took samples from the original paint to match it.  If this is a professional company, they should have noticed that it didnt  match.  They did do the main part of the roof in a timely manner, however I continue to find myself picking up debris in my backyard and had to ask them to replace the items removed from my deck that were simply left on the lawn.  I have not canceled on them other than the time I had Covid-19. I tried to accommodate their schedules based on my work hours, however  they should be the ones accommodating mine as the customer.  If I take off of work for their convenience I do not get paid.  It is also not my issue that the work had to be redone several times, Im sure the subcontractors were told to get in and out ASAP, whether the job was done correctly or not.  While there are other areas of the floor that need work, I am not the one that removed the tape taking off a layer of stain.   I will not agree to close this case until the work is completed.

      Complaint: 17013101

I am rejecting this response because:

It's the exactly the same as the first one.  I would like to address my not telling them the paint color was incorrect until it was finished.  I was told on several occasions throughout the entire process that the paint color will look different once it dried.  It did not happen either time.  As far as the ceiling goes, the professional painter they sent several weeks ago took one look and not only said the color was incorrect, he also said they used a glossy paint instead of a matte paint.   Unfortunately, I settled on some of the drywall and other painting work because they didn't seem to see the issues that were there.  In addition I was told they were not making money on this job because they had to continue to fix things that weren't done correctly the first, second, third time around.  That however is not my issue, if the correct people were assigned to the job and done things right the first time we wouldn't be in this position.  My time is just as valuable as theirs, and I did take off work several times to accommodate their schedule.  Once again, I do not get paid if I am not working, so we can say I lost additional money by not be able to earn it.   They sent another painter out to look at the ceiling last week who said he can do the job.  I informed him that he needed to go through the proper channels at ******* for approval.  I never heard a word back from them about it.

The person that recommended them to me has apologized numerous times.  She also informed me that she never used them for any work inside her home, perhaps if she did I would have found out about their practices sooner and gone a different route.  In addition, she told me that the roofing work they did for her all went through insurance so she didn't have to deal with them financially.  Which reminded me that the first thing the salesman asked me was if there is a way to put through an insurance claim.

I was certainly hoping for better outcome going into this.  I want to get this resolved and move on.

      Sincerely,

      ***** Grad

I am rejecting this response because:
It's the exactly the same as the first one. I would like to address my not telling them the paint color was incorrect until it was finished.  I was told on several occasions throughout the entire process that the paint color will look different once it dried. Paint always looks a little different after it dries compared to when it's wet  It did not happen either time. As far as the ceiling goes, the professional painter they sent several weeks ago took one look and not only said the color was incorrect, he also said they used a glossy paint instead of a matte paint. Again, the team lead took a sample to match the paint and it obviously did not match well. Painting a partial ceiling was not recommended(and should never have been sold in the first place) but the customer did not want to pay for the entire ceiling to be painted, knowing full well that there could be flashing problems.  Unfortunately, I settled on some of the drywall and other painting work because they didn't seem to see the issues that were there. I dont think you've "settled" for less in any way, and if you feel you have, I ask that you please do not, I would prefer to solve ALL issues that you see so you can at a minimum be satisfied with the completed job, especially after all this back and forth. I agree your time is valuable also, that is why we have/are making arrangements to work on the weekends to accommodate your schedule.  They sent another painter out to look at the ceiling last week who said he can do the job.  I informed him that he needed to go through the proper channels at ******* for approval. He was there to do the job and you sent him away, I sent him, he had already been through the proper channels for approval to do the job, he wouldn't have been there otherwise.

Which reminded me that the first thing the salesman asked me was if there is a way to put through an insurance claim. this is because your entire area had experienced a major catastrophe, which is likely why your roof was leaking. I was certainly hoping for better outcome going into this.  I want to get this resolved and move on.

      To whom it may concern,

We work on old homes all the time and issues come up. People make mistakes, and we correct the mistakes when they are made. Most customers actually appreciate us more after a mistake is made and we correct it because of our willingness to admit a mistake and make it right. This is an example of a customer trying to take advantage of a tiny issue and make it into something bigger to not pay a large balance owed, much bigger than the problem itself. There are many small contractors out there that can't afford to buy their groceries when a customer holds back 5k over a $300 problem. I'm blessed to not be in that position today thank god. I believe an A+ BBB rating isn't for the business that has never made a mistake(because they dont exist) but for the business that stands by their word and deals with the issues even when the customer makes it almost impossible to solve. I hope I don't lose my rating which allows me to make a living over this complaint.

Attached you will see the contract($30,375) and remaining invoice balance($5,687.50). The work contracted to be done quickly was the roof($24,250) in order to stop the leak, we scrambled to get that done for her quickly, rearranging our schedule to accommodate her urgency, the claim of us saying she had to give a downpayment as a sales tactic is inappropriate. The siding and mitigation work($4,850) was done as scheduled. The drywall repair and paint work represents the smallest dollar portion of this contract($1,275) and we have attempted to get someone in to make the fix repeatedly and have been met with problem after problem. I expect that the gentlemen coming to paint her ceiling will schedule that with her for this weekend per her request to not force her to miss work. There was an issue with the drywall repair and paint and it has been exacerbated by the customer insisting on being difficult. I will always make whatever concessions needed to make right a wrong within reason. I truly am sorry that my employee(team manager) sent someone underqualified to make the repair, and that it did not all get corrected in one visit back there as it should have, that is my mistake and I own it. Please just allow us to correct it and close the job. The demand for discounts above the amount for the work that you have a discrepancy with is unacceptable. The reason I warranty my work for a lifetime,  is the same reason I won't be manipulated into giving outrageously demanded discounts. If we finish the job and go above and beyond to solve mistakes when they happen the job still deserves to be paid in full. And my warranty won't be stamped without a paid in full invoice. You owe us for work that has been long finished, the drywall and paint amount was $1,275, at least pay for the work that was done with out issue, open balance being $5,687.50.

      Thank you,

I am rejecting this response because:

The agreement was to pay half upfront, which I did and the remainder when the job was completed.  I also made a $10k payment on January 11 at the request of ******************.

It has been six months since this project started and I would like it completed more than anyone.  However I am not going to settle for a job that is not up to standard.  I have a professional painter come take a look at the work and frankly they were surprised at the quality.  This is not only in reference to the ceiling issue.  I welcome ****************** to make a site visit at my house so he can see, beyond photos, what this issues are.  I am available on 6/13, 6/15 and 6/21 if he wants to schedule a time.
