We signed a contract with Noonday Solar on 8/19/2023 for 14 solar panels and the controllers to be installed on our roof. We paid $11,000 as the down payment around 9/11/2023. We spoke with a project manager on the progress until 10/10/2023. Since then we haven’t heard anything and no one is returning our texts or calls. Even texting the CEO of the company did no good. We would like the money back since no work is being done. ****** ****** Detective ***** ****** has all the details and paper documents, copies of texts. His number is ***** *********

Noonday Solar has a project with me to install solar panels and also complete the work required to receive the Permission to Operate my solar panels with ****** Illinois. As of today the solar panels have been installed in late May and Early June. On June 19th ****** came out to inspect my solar project and they had many errors for Noonday Solar to fix. As of now these errors seem to be not fixed. All I want is my project to be completed and a resolution to get my solar panels turned on. This has been a project that started in March and is still not completed. The original consultation said that it should only take a couple of months. It has been 7 months now and the project has yet to be completed. Any help in getting this project completed would be greatly appreciated. Thank you, ****** ********

We signed a contract with this company to have solar panels installed on March 7th 2023. We were told that it would be a 2 day install project. We did have a contractor arrive to do the job around May 17 and spent 2 full days here. Things didn’t go well and we were told they would have to order additional parts after multiple holes were drilled in the roof. 3 weeks later we had never heard back. August 6th the project was agreed to be started back up again, and to this date no one will even give me an estimate as to when they will be able to complete it. Nearly every contact we have had with this company has left the company. Noonday solar has been fully funded through our financial Company ******. I’m not sure how that happened as there are a few brackets in my roof and that is it. The project is nowhere near complete and we were told the only way for it to get fully funded is if it was told to the financial company that the job was 75% complete. This company has give us the run around from the start and every person gives you different answers about things. We are now paying our full electric bill as well as a bill for the solar panels. And on top of all this we received a letter in the mail from the original contractor that did the brackets. They claim they are placing a lien on our home due to Noonday solar not paying them for the work they completed. I spoke with this contractor company and they claimed that noonday has not paid them for several jobs. So they have been fully financed for a project that has not been completed. And they have also not paid the contractor that they hired to do the job.

      Dear BBB,

Thank you for allowing us the timed opportunity to respond to this complaint. We understand why there would be frustration based off the way the complaint was communicated, but unfortunately the details mentioned in the complaint are not factual. It is true that initially we had to come back to do the install to properly install the solar. The reason for this is because the customer had a very unique roof and for the customers own benefit, we wanted to ensure we had the correct attachments to secure the solar. We usually pick this up during the site survey but occasionally with certain roof types this is not possible. Rather than waiting 3 weeks to communicate like the customer stated, we went out to the site the following day (May 19th) and told him how we were moving forward (waiting for the correct parts to show). The only reason it took until August 6th to start the project again is because the customer refused to let us finish it. Lastly, the subcontractor has been paid for this job, this is simply a false allegation. One thing I would like to take personal responsibility for is that we could have done better on the communication. We had some internal changes at the time we were working with Mr. ***** so his point of contact changed. I can empathize with and understand why that would be frustrating. At Noonday Solar we strive to take care of every customer in a way they would want to be treated and we will continue to remain true to that goal.

I am rejecting this response because:

The response from Noonday is not accurate.  There was NO site survey done on our property. The first time anyone stepped foot on our property was for the day of installation. This was the contractor, who when I spoke to the date this complaint was filed had not been paid.  We have requested from Noonday proof that this was taken care of and we would not be having a lien placed on our home from the contractor and have not received that.   We have requested multiple times and estimated date that the project would resume and can not be provided one.  It has been 6 weeks or more since an agreement was reached and they can’t even give a suggested estimate date when they should have all the necessary supplies by this time?   The contractor was here on May 18 and again on May 19th.  When they left on the 19th and stated that different brackets needed ordered they did not show up after that. We waited the 3 weeks to reach out to get an update as stated before, and that’s when we were told they were busy working on other projects.  As stated before, either install the solar panels that you have been paid to install, and I have financed, or cancel our contract with the financial office so I am no longer responsible for them.  The solar panels are not on our property and have never been on our property.

"The response from Noonday is not accurate.  There was NO site survey done on our property. The first time anyone stepped foot on our property was for the day of installation."

False. The site survey was conducted March 14th, 2023. We had an engineering design prior to coming out for the date of the installation on May 19th which we wouldn't have been able to procure without a site survey. See screenshots of time stamps.

"When they left on the 19th and stated that different brackets needed ordered they did not show up after that. We waited the 3 weeks to reach out to get an update as stated before, and that’s when we were told they were busy working on other projects."

Completely False. We were in constant communication with *****, almost daily right after this was happening. Noonday Solar came out the next day (May 20th) after the customer complained. We updated him on the material status of the project and he got frustrated about the time it was taking. He then decided he wanted to halt the process after we had initiated the installation and ordered all the material, hence why we reached a settlement agreement with him. See screenshots of time stamps.

As far as the comments on the lien and the other contractor, that is the reason *****'s project continues to be held up, despite our willingness to finish it. We are attempting to recover our material so we can finish his project. The lien is not valid and our attorney has already contacted **** ******** to discuss this.

This biusnes noonday solar made many mistakes number one being the order was canceled to begin with .I had picked a system made by another company but they still showed up to install the one that was canceled.Idid not even know that was what they were doing I told them about the cancellation before any work had happened the next day the other company showed up to install the system I was actually waiting on the wrong system had been almost completely installed while I was at work .before I realized it was a different company and the first one knew it had been canceled all along but came out anyway and installed the system because they did not have the one I wanted they also could not tell me how much it cost what the payments would be for it and didn’t have anyone who could speak to me about this I don’t know what information they have for me and they didn’t have a manager or anything who could discuss these details with before the work had begun .I am not sure what their thinking was to begin work without going over the cost payments or the incentive program money I now have two solar systems on my property one that was canceled one that I have financing for .and one on my roof stuck in limbo that was never supposed to go there and no resolution plan to speak of and now they want me to pay or put a lein on my home as they say when they never discussed the cost with me there was never a loan doc sent to me because the system was canceled and they showed up and did the installation anyway and it can not be removed without damaging my roof they offered to have management call me and had said that they called but my phone never rang I need to know what happened and what is going on and what the resolution can be .

I was called by a man named ****** ***** a supposed biusnes under his own name I believe he may have run a scam against me in retaliation of a former employer by cohersing me and other to change our solar contracts to another company at the last minute causing two solar installers to arrive at the same time one having started work that was cancelled and another showing up to do work for an active contract causing homeowners to be in a botched deal paying for a system that yet to be installed and on the hook for one that is but has no loan associated with it because the work is canceled or ****** ***** and noonday solar are running a scam together I have been lied to by both or one or the other and am stuck with two systems now due to the confusion that has been caused by this event and no plan of how it is going to be resolved from either party.

Hi, this is the CEO of Noonday Solar. There are several claims being made and a bit of confusion, so I will try to address Mr. ********** claims one by one.

Claim: "The order was canceled to begin with."

Response: The project was not canceled with us, in fact we confirmed the status of the customer's project weekly all the way up until the actual installation of the solar panels (which we do with every client of ours). If it was canceled, then why did the homeowner allow us to install the panels on his roof?

Claim: "I had picked a system made by another company but they still showed up to install the one that was canceled."

Response: This is because the homeowner confirmed the installation with us. In addition, he was there in person (which is why we confirmed with him over the telephone) and allowed us to go on his roof to install the panels.

Claim: "I was actually waiting on the wrong system [that] had been almost completely installed while I was at work"

Response: This is simply false. We are not allowed to install without the homeowner being there. Plus, by the customer's own admission, he works night shifts and doesn't begin work until later in the day. We arrive in the morning.

Claim: Multiple statements about not discussing the terms of his agreement and not being available to communicate.

Response: Again, we spoke to him on a weekly basis. The customer was confused because he was working with two companies and signed contracts with each, apparently without being aware of it. Feel free to review the contract we've provided.

Claim: Lien being put against home.

Response. This is absolutely true. If you sign a contract with a company and allow us to install it on your home and then try to break your contract, there are consequences. This is why liens exist.

There are other claims he makes, but the general summary is this: The customer signed up for a contract with our company and apparently another and allowed them both to be installed. Why he did this I do not know, but we can not simply take a massive loss because he was confused about what contracts he did or didn't sign. We always serve to go above and beyond for all of our client's but there are some situations where we can not accommodate the customer. I have included his contract with us as an attachment.

The representatives that spoke to me from noonday told me that the salesman that I spoke too was a con man and had conned me into signing to contracts in order to get two commissions from two companies for himself and that they fired him for doing this to others before me.the con man’s name is ****** ***** he conned me by saying that the noonday system wasn’t going to make enough power for my home and suggested I cancel and get the ground mounted system from another company he knew that the contract had specific cancellation details and also knew that I did not know and didn’t say anything about it and he then proceeded to help sign up for a second contract with a different company knowing it was fraudulent behavior and had done it several times before according to noonday and it is ****** *****’s name on the contract from noonday as co owner also only ****** *****’s and my name appears on the contract if they new this than why would they just continue with the contract instead of rejecting the contract from the start and speaking to me about it personally rather than continuing to allow the confusion and fraudulent transaction to continue until the point of the unit being fully or almost fully installed before I notice that it wasn’t right and that I was lied to by there con man .
