I had a truck that broke down. I was supposed to return to ******** to get another truck. I return to ******** on a Friday. My employer did not pay me my full amount of the check for the week, I park the truck and him and ******************* agreed that he would deliver the load which I have the text messages to prove and when I got to the other truck I did not move. I refuse to drive or go get Lowes until he finish paying me. Now hes holding onto my check for that week and this week refusing to pay me because I quit. Also, hes holding $1500 for security to cover any damages done by me to the truck. Which there were not any.

Since ************** started working with us again, he had a couple of mistakes in the performance of his work where we kept his money according to the contract he signed with the company when he started working again. I will tell you briefly what happened. *********************** was under loading and people were waiting for him to unload what we paid extra for. Also, ****** was going back to ******* to the Terminal to replace the truck and get another one. We had agreed on everything on Friday, May 12, for him to unload the load in ******* area, to go change the truck and to pick up another load on Saturday, May 13. Which we had to cancel because he didn't answer the phone. ************** did not appear to anyone and blocked everyone in the Company for no reason until May 17. Until then, everyone on my team and myself were blocked. On May 17, we find out where the truck is, and that the previous load was not even unloaded, and the load after that was not loaded. That brought us many losses in the company. We are waiting for the final invoice from the brokers for everything and of course we will send you that too. ************** has violated all principles and rules of the contract he signed himself and does not want to accept responsibility for his unprofessional actions.

I am rejecting this response because:

*********** equipment was the reason the load was not delivered. The turbo on the truck kept causing the truck not to run the right way, which **** was informed and which was the reason I was going to the terminal as well as getting another truck. He suggested if I got the other truck that the load would still be delivered by somebody else. His reason for not paying me was **** was outta state dealing with a health issue. I was supposed to be paid on May 12 for the previous week having nothing to do with the issues hes referring to. Nothing was missed or late on the week before that, so there should be no reason for him to hold my money
      Sincerely,

      ***********************

************** did have problems with that truck, that's true, but with joint cooperation we managed to get it back to ******* so that ************** could take another truck and leave the one he had problems with to be repaired. Also, since ************** was on load, he understood and heard all the company's instructions and said that he understood everything that he needed to be done and how to do it, the day before, namely that he should take another truck and leave it in the same place where that one is another correct truck and to go for unloading and then after that for loading. Instead, ************** blocks all employees in the company, no one can reach him on the phone for 5-6 days and no one has an idea where he is and what is happening with the load, which cost the company a lot of losses. If he had a problem with his check and payment, why he didnt answer the phone to anyone for 5-6 days? Why he didnt say anything to anyone, instead he made a problem for everyone about the load and brokers?
