I was selling a house and the sale was contingent on the driveway being redone. On 9/7/22, I signed a contract and paid a 50% deposit of $9000 to Maria V. Contracting for a concrete driveway, with a verbal and written understanding that they would expedite the job so that I could sell the house. When I paid the deposit, ***** said he was going straight to the Village to apply for the permit. (We both knew it would take up to 2 weeks to get the permit.) On 9/8 the office said he had not applied. I followed up with him on 9/12 and he said he hadn't heard back from the village. On 9/21 he told me that the permit was approved and they would begin work in the next 2-3 days. On 9/22 he told me that actually the permit wasn't approved but that he called several times and thought it should be approved "any day". He asked if I could go to the ************** and help push it. On 9/22, I went to the ************** and learned the permit had actually only been filed the day before, 9/21. On 9/27, their application was denied. (The Village required an alternative material, not concrete or else civil engineering plans.) On 10/17, I told ***** that I definitively would not be able to use them because the village would take 4-6 more weeks to review the engineering plans. I asked ***** repeatedly to work on a refund. He stalled and kept saying his boss *** would get back to me. Several times, he didn't answer and the main phone had a full voicemail. From 10/24 to 11/21, I called weekly and left a message requesting my refund. *** asked for my address on 11/21 and said the check would be mailed that week. It was not. I called several more times and on 12/12 they agreed to deliver it in person. They deducted $1000 for 'their time and costs'. However, they only made one trip to the permit office (2 weeks after promising to do so) and they only paid $65 for the permit. I have offered $250 for the permit and time lost and expected a refund of $8750.
