      I purchased a 2015 ******* on 1/7/2023. The car had a check engine light on that was supposedly addressed by the dealer. Less than a week after picking the car up it started blowing white smoke and losing all power. I brought it in and was told there was an oil sensor that needed to be addressed. They had the car for 4 days for that fix. I had sent a notification of the issue 14 days from buying it to ensure I was compliant with lemon law guidelines. Less than a week after picking it back up, the same issue happened again but worse. I brought it back and was told they needed to ship it to ******* to get it looked at. I called and told them I didnt want the car anymore. They said to give ******* a chance to look at the car. 4 days went by and I heard nothing. I called and was told that I would receive an update within 48 hours of what was going on with the car. I texted at 72 hours out and received a reply the next day. Instead of settling for a text reply I called back and told them I do not want the car and I expected them to take care of the repay of the loan. The representative there then told me that it was smoking and losing power from 2 separate issues, which is ridiculous. I still have no idea what they plan to do to handle this issue. I understand now how the pricing is so competitive, the vehicle are sub par. I had purchased 2 previous vehicle from them, both of which have had thousands of dollars pumped into them already for repairs. I had a house fire and lost means of transportation and bought these vehicles as replacements. I know there isnt an opportunity to exchange the van I bought (blown transmission already and a clicking engine and warning light, only had since June) but the ******* is not acceptable.

      I purchased a 2017 ***** Impala in November 2021 and I was told that the vehicle from Silver Auto Sales in *********, ******** was in Great Condition and when I drove off I called the dealership back as I was driving off to complain about the vehicle breaks. After a few phone conversations with the manager and i explained to him what my concerns where he told me that i should have brought it back and I told him his sales person ***** told me it was dust on the brakes. The vehicle brakes where so bad i had to beat the rear brakes off, the front brakes was breaks were bad also. I went to trade the vehicle in at ******* dealership in **********, ******** and they informed that the vehicle had been in an accident and the air bags had been deployed When a consumer buys a car which they later learn had been wrecked prior to their purchase, whether or not they have a claim will depend on what they asked and what the dealer says about the car prior to sale. The patterns we see are 1) dealer tells the consumer the car has not been wrecked; 2) dealer says it has not been wrecked and shows a clean Carfax in addition to support that assertion; 3) dealer claims car was inspected and there is nothing wrong. As the attorney, we are looking for some affirmative statement or representation by the dealer that the car had not been wrecked, or flooded or damaged. The consumer needs to ask questions to make the dealer respond. The dealer may not be required to say if the car has been damaged but if the dealer says something descriptive of the car, that has to be the truth. If the consumer can establish that the dealer lied to the consumer about some specific quality or condition of the car prior to sale, then the consumer may be able to make claims for fraud and Unfair Business Practices.
