We hired & signed a turnkey contract with ******************************* (C. Gallagher Construction) to build our dream home on 4/19/22 for a total of $242,842.84 with an additional upgrade of windows in the amount of $3,594.97 he has been paid to date $189,937.81. The house was to be completed in August 2022 on 11/3/22 he signed an amendment of contract that the house would be completed on 12/16/22. On 11/30/22 **** removed all of his ***************** from the construction site & has not returned. At that time he stated he had health issues & that he would get back to us on 12/4/22. He has since ghosted us. On 1/2/2023 we got word he was working another construction site so with permission from the land owner I went & hand delivered a demand letter asking for materials and/or the money that was paid for these items along with labor he was paid but did not perform to be returned to us. Our mortgage company has also reached out to **** with no response either. We have subcontractors that he hired calling us asking for payment that **** has already been paid for. **** was given $189,937 to purchase all materials and perform work he was hired to do. He built a shell & started the exterior work, not only did ******** crew damaged so much of what was done but not one thing is 100% complete. The roof was installed incorrectly, not completely finished and now leaks, we had to have it repaired. The last disbursement he received was on 11/2/22 for $35,500, which was the final allowed amount to him until completion. Those last funds were for ***************** neither has been paid. On 12/14/22 we had a structural inspection done as well in hopes to keep the project going with our savings but that inspection failed as well due to work not being complete or work not being done correctly. We were given allowances which he was to reimburse us for yet we were never reimbursed for that amount either. He fraudulently said he could and would do a job that he had no intentions on completing.
