We hired the contractor in 2/2023 to build a 3 season room for our 3y.o. daughter with autism to have her own space for her therapies. We tighten our budget as much as we can to have this project happen. When we met with her, she said that she will handle the architectural design as she has an architect who works for her and get the permits needed. She promised that the whole project will be done in 4-6weeks. We paid her downpayment on 3/1/2023. Her team demolished our fully functional deck immediately but when my husband asked where the permit is, she said that she didnt get any. My husband insisted that she should get one. That took time. The architect she hired is not licensed here in ********; she claimed that he is licensed in ********** but the architects and contractors who I spoke with regarding our problem believe that the guy might not even be an architect. We were able to secure a permit but the village required several revisions which the architect refused to update after the 4th time. She kept saying that the inspector has been coming but he only came one time and said that our foundation failed the inspection. She asked for another amount informing us that she needed the money to build more. When we went to the village, they informed us that our permit is not valid anymore because the revisions were not submitted. The contractors solution to have the updated drawings is to have her friend who is a retired architect to revise it then have a licensed architect sign and stamp it. Another shady step that will cause more issues. We ended our contract with her on 9/25 and asked our money back. She built us a foundation which had to be repaired by our new contractor. We also hired a new architect to make the addition structurally stable as the architect she hired made flawed and unsafe design. She kept saying that she will refund us, I followed up and begged almost everyday. She only returned 25% and didnt reply anymore when I messaged her on 12/27.

      Business response

      03/01/2024

I am very sorry that *********** has sent this message and even more that these are false allegations. I have proof of my messages to her. it is true that we signed a contract for 3 seasons. it is false that we began to tear up the deck before we had applied for the permit.  It is also false that the person who I hired is in **********. he is in **********. Unfortunately, I decided to work with someone who scammed me with 5 projects. he presented himself as an architect and took my money and never delivered the drawings. (Mrs.  Kee was one of them). I also have proof of this. I have been able to reimburse most of the money that due to this I owe. Unfortunately, *********** is not telling the truth of the story.  in fact, during the time that we waited for the permits to get out, she has a big leak on her siding which damaged her floor in the bedroom. I got fixed for free, and not once has she mentioned this.
It is also false that I have only paid 15%, it is 45% that I have reimbursed. She also agreed to discount $5,500 for the foundation and materials that we had done and left there. leaving me we a debt of $10,000 of which I had paid $4500. by the way the 3 season was to be built in the same deck. it was necessary to build new foundations. I had all the intensions to reimburse her money as soon as possible but she has done everything in her hands to end business. she has left nasty reviews in ******** groups, my website and other media that has damaged my business and i have had people cancelling their business with my company. I explained this to her, but she claims that she does not care and that is none of her problem. Today is 2/29/24 and I just received this notice from you. It was only this month on 2/20/24 that I sent her $500.
It is truly unfortunate the power that we all to damage someone's business and reputation in a fraction of minutes.

please let me know if you need any information from me or if you have any more questions as I want this cleared up to keep my business with you.

      thank you,
      ***** Salvador

      Customer response

      Complaint: 21240610

I am rejecting this response because:
Per *****, it is false that we began to tear up the deck before we had applied for the permit.
The ***************** has records of when she applied for the permit which is 5/17/23. Her company tore up our deck first week of March 2023 and I have a text message from her that they will pause the project until she gets the permit.
Per *****, It is also false that the person who I hired is in **********. he is in **********.
I have a text message from her that she said that the architect is from ********** when I asked her where he is based from. She even asked me to call him to explain that he needs to finish and update the drawings.
**************, in fact, during the time that we waited for the permits to get out, she has a big leak on her siding which damaged her floor in the bedroom. I got fixed for free, and not once has she mentioned this.
She offered to fix the leak for free to cover for all the inconvenience, headaches and stress that she had caused us. The village informed us that the permit that ***** had secured is not valid anymore since the drawings are not updated and ************ failed the inspections.
We didnt have issues on her tearing up our deck but ************ even failed the inspection as supported by the records from the Village. She informed us that the inspector came again to check the project but the Village has no record of that. The Village required her to submit updated drawings for the permit to be valid again. The drawings she has required at least 20 updates; it didnt even have an architectural seal. ****** solution was to have her friend whos a retired architect to update the drawings and have a licensed architect stamp it. I have text messages of all of these conversations.
Per *****, It is also false that I have only paid 15%, it is 45% that I have reimbursed. She also agreed to discount $5,500 for the foundation and materials that we had done and left there
Despite all the inconvenience she had caused us, we still considered her position. She was only able to built footings that even failed the inspection and asked for additional payment. We paid her and when we asked where the money is, she said that she has it with her. We told her to return the $10k asap thinking that she still has the money with her. She didnt. ************ she built failed the inspection, the materials used didnt meet the code requirements- thus our new contractor needed to fix everything. We lost money and paid more because of her.
**************, I had all the intensions to reimburse her money as soon as possible but she has done everything in her hands to end business. she has left nasty reviews in ******** groups, my website and other media that has damaged my business and i have had people cancelling their business with my company. I explained this to her, but she claims that she does not care and that is none of her problem. Today is 2/29/24 and I just received this notice from you. It was only this month on 2/20/24 that I sent her $500.
She told us that she is signing a new client and she will pay us the downpayment that she will receive from them. The client will pay her through credit card and she told us that she will have her friend who owns a business run it then her friend will give her cash. I told her that I dont that will work but she said it will. It didnt. She then said if we can accept the credit card payment. That is not happening. She then offered us to pay us with her car. I told her that she can sell her car then pay us. She didnt. She also said that she will get a loan. She didnt. I messaged and begged her to pay us. I told her that I will post reviews about her and she told me that it is my right. When I posted the truthful review about her, she got upset and claimed that she had lost potential clients. I have all of these messages saved. Who would trust a shady business? Another client of hers reached out to me with the same problems regarding her business. ***** told me that she will pay us, last message I received from her was on 10/27/23. I messaged her on 12/27/23 for updates, no reply. She has sent $500 on 2/20/24, 2 months later. In her business FB page, numerous projects finished were posted recently.
We signed the contract with her and paid on 2/28/23. She promised that the project will be done 1-2 months.

      Sincerely,

      *****************
